The group includes drama and dramamusicalpieces, works of choreography and pantomime. The common denominatorof this works is a manner in which they are presented to public. Acomparative overview of other national legal orders enables a clear view toadopted solutions related to the subject-matter, pointing out specific and differentcharacteristics of legal provisions on works of choreography. Furthermore, ananalysis of the Croatian copyright law after the new 2003 Law on Copyright andOther Related Rights is given. In conclusion, the author offers a theoreticaldefinition of theater works of authorship with an analysis of related but alsoheterogeneous categories of works of authorship. Theater works of authorship,thus, include only those works of authorship that are intended for theater (scene)“publication” presented through performance of one or more artists-performers.Key words: drama, drama-musical piece, work of choreography, pantomime,theater work of authorship, work of authorship, copyright.ZusammenfassungWERKE IM THEATER UND URHEBERRECHTDie Arbeit beschäftigt sich mit einigen der Kategorien von Werken, die demUrheberrecht unterliegen und zwar jenen Werken, die insgesamt mit demTheater verbunden sind. Es handelt sich um Dramen und Musikdramen bzw.Choreografien und Pantomimen. Was diese Werke miteinander verbindet ist dieArt ihrer Mitteilung an die Öffentlichkeit. Die vergleichende Darstellung vonBestimmungen in anderen nationalen Legislaturen gibt ein Bild von derSituation auf diesem Gebiet, das besonders spezifisch und unterschiedlich ist,wenn es sich um die gesetzliche Regulierung choreografischer Werke handelt.Des Weiteren wird in der Arbeit die Situation in unserem Urheberrecht nachder Verabschiedung des neuen Gesetzes zu Urheberrecht und verwandtenRechten aus dem Jahre 2003 untersucht. Abschließend wird theoretisch derBegriff von Werken im Theater, die dem Urheberrecht unterliegen ausgelegt,wobei die verwandten aber gleichzeitig heterogenen Kategorien dieser Werkeanalysiert werden. Unter Werken im Theater versteht man also diejenigenWerke, die durch die Vermittlung eines oder mehrerer Künstler zur szenischenAufführung bestimmt sind.Schlüsselwörter: Drama, Musikdrama, Choreografie, Pantomime, Werk imTheater, Werk eines Autoren, Urheberrecht.

La voce include le operedrammatiche e drammatico-musicali, le opere coreografiche e pantomimiche.Il comune denominatore di queste opere è il modo in cui esse sono presentateal pubblico. La rassegna comparata di altre legislazioni nazionali consente unachiara visione delle soluzioni adottate in materia, con le caratteristichespecifiche e differenti date alle questioni giuridiche sulle opere coreografiche.Inoltre è fornita l’analisi del nostro diritto d’autore dopo la nuova Legge suldiritto d’autore e i diritti affini del 2003. In conclusione si offre la definizionedottrinale di opera d’autore teatrale, con l’analisi delle categorie affini ma ancheeterogenee di opere d’autore.
