MEĐUNARODNI KRIVIČNI SUD ZA BIVŠU JUGOSLAVIJU (MKSJ)OSTVARIVANJE PRAVDE U BIVŠOJ JUGOSLAVIJI“Pravda je neophodan sastojak u procesu nacionalnog pomirenja. Ona je od ključnog značaja za ponovnouspostavljanje mirnih i normalnih odnosa među ljudima koji su morali da žive pod vladav<strong>in</strong>om terora.Ona razbija ciklus nasilja, mržnje i vansudske retribucije. Zato su mir i pravda nerazdvojni.”Izjava Antonia Cassesea, predsednika MKSJ od 1994. do 1996., data u novembru 1995., nakon zaključenjaDejtonskog mirovnog sporazumaPREDVODNIK PROMENE OD NEKAŽNJIVOSTI DO ODGOVORNOSTIPozivanjem pojed<strong>in</strong>aca na odgovornost bez obzira na njihov položaj, MKSJ je svojim delovanjem okončaotradiciju nekažnjavanja za ratne zloč<strong>in</strong>e i druga teška kršenja međunarodnog prava. Zahvaljujući MKSJ, višese ne postavlja pitanje da li vođe treba pozvati na odgovornost, već kako ih se može pozvati na odgovornost.PERSONALIZACIJA KRIVICESuđenjem pojed<strong>in</strong>cima na osnovu njihove lične odgovornosti, MKSJ personalizuje krivicu. Vođe i druga licane mogu se više skrivati iza ‘naroda’ ili bilo koje druge grupe. Oni moraju preuzeti odgovornost i odgovaratiza svoje postupke. Time se zajednice štite od toga da budu označene kao kolektivno odgovorne za patnjedrugih. To može uveliko dopr<strong>in</strong>eti sprečavanju međusobne mržnje i unapređenju pomirenja među ratompogođenim društvima u bivšoj Jugoslaviji.UTVRĐIVANJE ČINJENICATokom postupaka vođenih pred njim, MKSJ je utvrdio van osnovane sumnje mnoge č<strong>in</strong>jenice koje se odnosena zloč<strong>in</strong>e poč<strong>in</strong>jene u bivšoj Jugoslaviji tokom 1990-ih. Time je dopr<strong>in</strong>eo stvaranju istorijskog zapisa odogađajima, borbi protiv negiranja i sprečavanju pokušaja revizionizma.OSTVARIVANJE PRAVDE ZA HILJADE ŽRTAVA I PRILIKA DA SE NJIHOV GLAS ČUJEPozivanjem pojed<strong>in</strong>aca na odgovornost za zloč<strong>in</strong>e poč<strong>in</strong>jene u bivšoj Jugoslaviji, Međunarodni sud ostvarujepravdu za hiljade žrtava širom tog regiona. Zauzvrat, Međunarodni sud žrtvama pružamogućnost da se njihov glas čuje i da govore o svojim patnjama.EFIKASNA I TRANSPARENTNA MEĐUNARODNA PRAVDA JE MOGUĆAOd svog osnivanja, 1993. god<strong>in</strong>e, Međunarodni sud dosledno i sistematski razvija međunarodno pravo.Međunarodni sud je dokazao da je efikasna i transparentna međunarodna pravda moguća.JAČANJE VLADAVINE PRAVAPored svog osnovnog zadatka da sudi pojed<strong>in</strong>cima za ratne zloč<strong>in</strong>e, Međunarodni sud je takođe bio pokretačreformi pravosuđa u bivšoj Jugoslaviji i katalizator u osnivanju specijalizovanih sudova za ratne zloč<strong>in</strong>eu regionu.


INTERNATIONAL CRIMINAL TRIBUNAL FOR THE FORMER YUGOSLAVIA (ICTY)REALISATION OF JUSTICE IN FORMER YUGOSLAVIA“Justice is an <strong>in</strong>dispensable <strong>in</strong>gredient of the process of national reconciliation. Thus Peace and Justice gohand-<strong>in</strong>-hand.”Antonio Cassese, President of the ICTY from 1994-1996, <strong>in</strong> November 1995, upon the conclusion of theDayton Peace AgreementLEADING THE SHIFT FROM IMPUNITY TO ACCOUNTABILITYBy hold<strong>in</strong>g <strong>in</strong>dividuals accountable regardless of their position, the ICTY’s work has dismantled the traditionof impunity for war crimes and other serious violations of <strong>in</strong>ternational law. Thanks to the ICTY, the questionis no longer whether leaders should be held accountable, but rather how can they be called to account.PERSONALISING GUILTBy try<strong>in</strong>g <strong>in</strong>dividuals on the basis of their <strong>in</strong>dividual responsibility, the ICTY personalizes guilt. Leaders andother persons can no longer hide beh<strong>in</strong>d the ‘nation’ or any other group. They have to take responsibilityand answer for their own actions. Accord<strong>in</strong>gly, communities are shielded from be<strong>in</strong>g labelled as collectivelyresponsible for others’ suffer<strong>in</strong>g. This can greatly contribute to prevent<strong>in</strong>g mutual hatred and promot<strong>in</strong>greconciliation among the war-torn societies of the former Yugoslavia.ESTABLISHING THE FACTSIn its proceed<strong>in</strong>gs, the ICTY has established many facts related to the crimes committed <strong>in</strong> the former Yugoslaviadur<strong>in</strong>g the 1990s beyond a reasonable doubt. In so do<strong>in</strong>g it has contributed to creat<strong>in</strong>g a historicalrecord, combat<strong>in</strong>g denial, and prevent<strong>in</strong>g attempts at revisionism.BRINGING JUSTICE TO THOUSANDS OF VICTIMS AND GIVING THEM A VOICEBy hold<strong>in</strong>g <strong>in</strong>dividuals responsible for the crimes committed <strong>in</strong> the former Yugoslavia, the Tribunal is br<strong>in</strong>g<strong>in</strong>gjustice to the many thousands of victims across the region. In testify<strong>in</strong>g at the Tribunal, many victimsdisplay exceptional courage and contribute to the process of establish<strong>in</strong>g the truth. In turn, the Tribunalprovides these victims the opportunity to be heard and to speak about their suffer<strong>in</strong>g.EFFICIENT AND TRANSPARENT INTERNATIONAL JUSTICE IS VIABLES<strong>in</strong>ce its establishment 12 years ago, the Tribunal has consistently and systematically developed <strong>in</strong>ternationallaw. The Tribunal has proved that efficient and transparent <strong>in</strong>ternational justice is viable.STRENGTHENING THE RULE OF LAWIn addition to its primary function of try<strong>in</strong>g <strong>in</strong>dividuals for war crimes, the Tribunal has also been an <strong>in</strong>centiveto reform the judiciaries <strong>in</strong> the former Yugoslavia and has been a catalyst for the creation of specializedwar crimes courts <strong>in</strong> the region.

UN Tematska grupa za HIV/AIDSTematska grupa Ujed<strong>in</strong>jenih nacija za HIV/sidu u Srbiji i Crnoj Gori je osnovana 2000. god<strong>in</strong>e i sač<strong>in</strong>jenaje od sledećih organizacija: UNDP, UNICEF, WHO, UNHCR, UNHCHR, WB, IFRC, IOM. Unutar Tematskegrupe postoje dve Tehničke radne grupe i Sekretarijat. Predsedavajući Tematske grupe se bira međušefovima agencija UNICEF, UNDP i WHO. Program lokalno f<strong>in</strong>ansiraju sledeće agencije: UNDP, UNICEF,WHO i UNHCR, i po prvi put UNAIDS alocirajući PAF sredstva 2004. god<strong>in</strong>e.Cilj UN Tematske grupe u Srbiji je da dopr<strong>in</strong>ese, u skladu sa <strong>in</strong>dividualnim naporima Agencijačlanica, razvoju i koord<strong>in</strong>aciji održivog i prihvatljivog nacionalnog odgovora na HIV/sida izazove. Zaostvarenje ovog cilja, ustanovljena su 4 specifična projekta i 8 specifičnih ciljeva.Projekat 1. Podrška nacionalnim / republičkim telima koja se bave HIV/AIDS-om.Specifični ciljevi: UN Tematska grupa je pružila punu pomoć i podršku osnivanju Republičkih komisijaza borbu protiv side, kako u Srbiji tako i u Crnoj Gori i u kont<strong>in</strong>uitetu pruža sveobuhvatnu podrškunjihovom radu. Republičke komisije su osnovane tokom 2002. god<strong>in</strong>e. Takođe su osnovani Republičkikoord<strong>in</strong>acioni mehanizmi za potrebe saradnje sa Globalnim fondom za borbu protiv side, tuberkolozei malarije (GFATM), bazirani na multisektorskom partnerstvu. UNICEF, UNDP, WHO i UN TG imaju svojepredstavnike u ovim telima. UN Tematska grupa je pomogla razvoj i pisanje predloga projekta za HIV/sida podnetog Globalnom fondu za borbu protiv side, tuberkuloze i malarije. Srpski predlog projekta jeodobren u 1. krugu, dok se za novi srpski i crnogorski predlog projekta, koji su podneti u 5. krugu, jošuvek čeka odgovor. Kont<strong>in</strong>uirana pomoć UN Tematske grupe u razvoju Republičke strategije za borbuprotiv side traje još od 2002. god<strong>in</strong>e. Strategije su usvojene i za Srbiju i za Crnu Goru u prvoj polov<strong>in</strong>i2005. god<strong>in</strong>e. UN Tematska grupa podržava rad Republičke komisije za sidu u postavljanju Sistema zamonitor<strong>in</strong>g i evaluaciju nad HIV/sidom.Projekat: 2 Razvoj Sistema za monitor<strong>in</strong>g i evaluaciju odgovora na HIV/AIDS.Specifični ciljevi: UN Tematska grupa pruža podršku razvoju Sistema za monitor<strong>in</strong>g i evaluaciju odgovorana HIV/sidu i u okviru toga, unapređenju nacionalnog sistema HIV/sida/PPI nadzora a u ciljuuvođenja i primene druge generacije nadzora. Sprovođenje studija ponašanja u određenim mestima(sent<strong>in</strong>el) među odabranim osetljivim grupama ljudi, č<strong>in</strong>iće još jednu komponentu ovog sistema. Prvestudije ponašanja i biološke studije realizovane su u 2005. god<strong>in</strong>i.Projekat 3: Nacionalna kampanjaSpecifični cilj A. UN Tematska grupa koord<strong>in</strong>ira i razvija tematski okvir za obeležavanje Svetskog danaza borbu protiv side, među partnerima, a prema UNAIDS preporukama. Slogan kampanje Svetskogdana za borbu protiv side u 2005. god<strong>in</strong>i je: “Stop AIDS. Ispunimo preuzete obaveze” i odnosi se naispunjavanje ciljeva postavljenih UNGASS-ovom Deklaracijom o posvećenosti borbi protiv HIV/side,usvojenoj 2001. god<strong>in</strong>e.Specifični cilj B. UN Tematska grupa razvija preventivne aktivnosti usmerene prema raznim grupama:profesionalcima, teško dostupnim grupama ljudi, kao i aktivnosti u cilju borbe protiv stigme i diskrim<strong>in</strong>acijeosoba sa HIV/sidom, osnaživanja njihove uloge u odgovoru na HIV/sidu i šireg uključivanja nevlad<strong>in</strong>ihorganizacija koje rade sa osetljivim grupama u kreiranju i realizaciji adekvatnog odgovora.19


Projekat 4: Izrađivanje mreže i osnaživanje nacionalnih kapaciteta u borbi protiv HIV/AIDS-aSpecifični cilj А: UN Tematska grupa učestvuje u širenju mreže organizacija koje se bore protiv HIV/side, organizujući koord<strong>in</strong>acione sastanke, razmenjujući <strong>in</strong>formacije, i podrškom njihovog učešća nanacionalnim i međunarodnim skupovima u cilju izgradnje kapaciteta.Specifični cilj B: UN Tematska grupa koord<strong>in</strong>iše i pomaže odgovor svih za<strong>in</strong>teresovanih donatorana specifična pitanja, sprečavajući na taj nač<strong>in</strong> preklapanje istih <strong>in</strong>icijativa. UN Tematska grupaobezbeđuje pravilnu izgradnju kapaciteta UN zaposlenika upoznavajući ih sa UN strategijom o HIV/sid<strong>in</strong>a radnom mestu. Ovo iskustvo će biti prenešeno i na lokalne partnere kako bi dopr<strong>in</strong>eli razvoju politikao HIV/sidi u radnom okruženju, na nivou države.UN Theme Group on HIV/AIDSUN Theme Group (TG) on HIV/AIDS works s<strong>in</strong>ce 2000 and consists of UNDP, UNICEF, WHO, UNHCR,UNHCHR, WB, IFRC, IOM. With<strong>in</strong> TG exists two Technical Work<strong>in</strong>g Groups, one <strong>in</strong> each republic, andSecretariat. Secretariat has two staff members: National Programme Officer and Adm<strong>in</strong>istrative Assistant<strong>in</strong> charge to deal with the TG matters on a daily basis. Chair<strong>in</strong>g of the TG rotates among Headsof UNICEF, UNDP, and WHO. Programme is be<strong>in</strong>g co-sponsored locally by the UNDP, UNICEF, WHO, andUNHCR, and for the first time <strong>in</strong> 2004 UNAIDS has assisted local activities by allocat<strong>in</strong>g PAF.The Goal of the UNAIDS TG <strong>in</strong> <strong>Serbia</strong> is to contribute <strong>in</strong> complementarity with <strong>in</strong>dividual agenciesresponse to the design, the set up and the co-ord<strong>in</strong>ation of a susta<strong>in</strong>able and affordable national/republicanresponse to the HIV/AIDS challenges. To implement this goal, five specific objectives areproposed as well as five specific projects.Project 1. Support to the National/Republican bodies deal<strong>in</strong>g with HIV/AIDS.Specific objective: UNAIDS has provided overall support to the Rerpublican AIDS Commission (RAC)full establishment and function<strong>in</strong>g. RACs <strong>in</strong> both republics were established <strong>in</strong> 2002. For the purposesof GFATM, Country Coord<strong>in</strong>ation Mechanisms were also established, based on miltisectorial20


partnership. UNICEF,UNDP, WHO and UNAIDS TG have their representatives <strong>in</strong> these bodies. UNAIDSTG assisted development of the Proposals for HIV/AIDS submitted to the GFATM. <strong>Serbia</strong>n applicationhas been granted <strong>in</strong> the 1st round, while new <strong>Serbia</strong>n as well as Montenegr<strong>in</strong> applied <strong>in</strong> 5th round,still wait<strong>in</strong>g answer. Cont<strong>in</strong>uous assistance to the development of Republican AIDS Strategy has beenprovided as of 2002. Both Republics have endorsed their respective AIDS Strategies <strong>in</strong> 2005. UNTG isassist<strong>in</strong>g to the RACs <strong>in</strong> sett<strong>in</strong>g of System for Monitor<strong>in</strong>g and Evaluation of overall HIV/AIDS.Project 2: Development of System for Monitor<strong>in</strong>g and Evaluation of HIV/AIDS ResponseSpecific Objective : UN TG is provid<strong>in</strong>g assistance to the development of System for Monitor<strong>in</strong>g andEvaluation of HIV/AIDS Response and with<strong>in</strong> it improvement of the National/Republican HIV/AIDS/STIsurveillance system <strong>in</strong> order to <strong>in</strong>troduce 2nd Generation of Surveillance. The new system will haveimproved report<strong>in</strong>g and data process<strong>in</strong>g system, merged HIV/AIDS and STIs surveillance, and behaviouralsent<strong>in</strong>el studies (BSS) among selected vulnerable groups set <strong>in</strong> place. The first BSS and BiologicalStudies are expected to be conducted <strong>in</strong> 2005.Project 3: The national campaignSpecific objectives:A. Reproduktivno zdravlje je jedno od ljudskihprava. Međutim, zdravstveni uslovi iz domena reproduktivnog zdravlja predstavljaju vodeći uzrok smrtnostii oboljenja žena u reproduktivnom periodu u svetu. Oko 350 miliona parova nije u mogućnostida planira zasnivanje porodice ili vremenski razmak među decom. UNFPA promoviše holistički pristupreproduktivnoj zdravstvenoj zaštiti što podrazumeva:• Univerzalni pristup tačnim <strong>in</strong>formacijama, niz bezbednih i dostupnih metoda kontracepcijei senzitivno savetovanje,• Obezbeđenje kvalitetne akušerske i postporođajne nege dostupne svim trudnicama,• Prevenciju i savetovanje o polno prenosivim <strong>in</strong>fekcijama, uključujući i o virusu HIV.Investiranje u reproduktivno zdravlje spašava živote, unapređuje njihov kvalitet, usporava širenje virusaHIV i podstiče jednakost polova. Ove dobrobiti šire se sa pojed<strong>in</strong>aca na porodice i dalje na svet.Bezbednije majč<strong>in</strong>stvoU svetu svakog m<strong>in</strong>uta po jedna žena umire od komplikacija, nastalih tokom trudnoće ili porođaja. Ovekomplikacije mogle su biti otklonjene. Svakog m<strong>in</strong>uta po jedna porodica biva razorena. Životi preživeledece bivaju ugroženi. Zajednice pate. A na svaku ženu koja umire dolazi 20 drugih koje bivaju ozbiljnopovređene fistulom ili nekom drugom povredom nanesenom tokom porođaja. Strategija UNFPA zasprečavanje smrtnosti majki obuhvata sledeće ciljeve:Planiranje porodice u cilju smanjenja broja neželjenih trudnoća, Stručnu negu pri porođaju, Pravovremenunegu za sve porodilje koje imaju komplikacije tokom porođaja. UNFPA takođe, na mnogim nivoima,promoviše pravo majki na bezbedan porođaj.26


Pomoć adolescentima i omlad<strong>in</strong>iPolov<strong>in</strong>a sveta - oko tri milijarde ljudi - ima manje od 25 god<strong>in</strong>a. Rešavanje ključnih problema sa kojimaje suočena najbrojnija generacija mladih u istoriji, predstavlja prevashodni prioritet ukoliko se naporiuloženi u društveni i ekonomski razvoj žele krunisati uspehom, a pandemija side zaustaviti.UNFPA ulaže u programe koji će zadovoljiti potrebe mladih za zdravstvenom negom, obrazovanjem,ekonomskim mogućnostima i vešt<strong>in</strong>ama življenja. Fond ima za cilj da obezbedi adolescentima imladim ljudima tačna obaveštenja, objektivno savetovanje i sveobuhvatne i dostupne usluge u ciljusprečavanja neželjene trudnoće i polno prenosivih <strong>in</strong>fekcija, uključujući i HIV. Support<strong>in</strong>g Adolescents and YouthHalf of the world - some 3 billion people - are under the age of 25. Address<strong>in</strong>g the critical challengesfac<strong>in</strong>g the largest youth generation <strong>in</strong> history is an urgent priority if social and economic developmentefforts are to succeed and the AIDS pandemic is to be reversed.UNFPA <strong>in</strong>vests <strong>in</strong> programmes to meet young people’s needs for health care, education, economicopportunity and life skills. The Fund works to ensure that adolescents and young people receive accurate<strong>in</strong>formation, non-judgmental counsell<strong>in</strong>g and comprehensive and affordable services to preventunwanted pregnancy and sexually transmitted <strong>in</strong>fections, <strong>in</strong>clud<strong>in</strong>g HIV. In this work, UNFPA seeks toengage young people as active participants <strong>in</strong> programmes that affect them.Prevent<strong>in</strong>g HIV/AIDSThree million people died of AIDS-related diseases <strong>in</strong> 2005, and more than 40 million people are liv<strong>in</strong>gwith HIV. It is mandated by the UN General Assemblyto promote socially and environmentally susta<strong>in</strong>able towns and cities with the goal of provid<strong>in</strong>gadequate shelter for all.Settlement and Integration of Refugees Programme <strong>in</strong> <strong>Serbia</strong>The Settlement and Integration of Refugees Programme (SIRP) aims to develop susta<strong>in</strong>able settlementand <strong>in</strong>tegration solutions for low-<strong>in</strong>come refugees and other vulnerable households and to build capacitiesat municipal and central levels for replication and up scal<strong>in</strong>g.The SIRP Programme is f<strong>in</strong>anced by the Government of Italy and is executed together with the M<strong>in</strong>istryof Infrastructure. Visoki komesarijat Ujed<strong>in</strong>jenih nacijaza ljudska pravaKancelarija Visokog komesarijata Ujed<strong>in</strong>jenih nacija za ljudska prava (OHCHR) je odgovorna zasprovođenje programa Ujed<strong>in</strong>jenih nacija za ljudska prava.Međunarodna zajednica je dodelila mandat OHCHR da štiti i promoviše ljudska prava u celom svetu.Pod vođstvom Komesarijata za ljudska prava, koji je osnovala Generalna skupšt<strong>in</strong>a UN 1993. god<strong>in</strong>e,OHCHR radi na jačanju svesti i poštovanju ljudskih prava - kroz osnaživanje pojed<strong>in</strong>ca da se bori zasvoja prava, ali i kroz podržavanje države da ta prava ostvari. OHCHR je deo Sekretarijata Ujed<strong>in</strong>jenihnacija, sa sedištem u Ženevi.Tokom god<strong>in</strong>a, OHCHR je povećao svoje prisustvo na terenu, i na taj nač<strong>in</strong> došao do onih kojima jepodrška bila najpotrebnija. Misija OHCHR u Srbiji je počela 1996. a mandat je def<strong>in</strong>isan potpisanimsporazumima sa Vladom koji kao osnovne funkcije uključuju posmatranje, izveštavanje, zaštitu i promovisanjeljudskih prava na teritoriji Srbije.U skladu sa Strateško-menadžerskim planom, OHCHR je zatvorio svoju kancelariju u Beogradu juna2007. Ipak, OHCHR će nastaviti da podržava ljudska prava u Srbiji, kroz zapošljavanje Nacionalnog savetnikaza ljudska prava pri timu agencija Ujed<strong>in</strong>jenih nacija u Srbiji od novembra 2007. Ovaj savetnikće da podrži rad kancelarije Stalnog koord<strong>in</strong>atora za Ujed<strong>in</strong>jene nacije kao i tim agencija Ujednijenihnacija u Srbiji, u posmatranju situacije ljudskih prava. Takođe će pomoći i Vladi Srbije da izgradi sopstvenekapacitete za promovisanje i zaštitu ljudskih prava u Srbiji.OHCHR je trenutno u procesu jačanja svog prisustva na Kosovu, usled mogućeg pogoršanja stanja ljudskihprava. Trenutne aktivnosti su fokusirane na dimenziju ljudskih prava u okvirima procesa tranzicijena Kosovu, sa ciljem omogućavanja kont<strong>in</strong>uirane zaštite ljudskih prava i promovisanja odgovornostisvih <strong>in</strong>stitucija na Kosovu. Ostali prioriteti uključuju razvoj novih pristupa pitanjima tranzicione pravde;podržavanje razvoja zakonodovstva i <strong>in</strong>icijativa usklađenih sa među- narodnim pr<strong>in</strong>cipima ljudskihprava; posmatranju posledica nedostataka u vladav<strong>in</strong>i prava na manj<strong>in</strong>ske zajednice na Kosovu, kao ipovećana pažnja na ljudska prava u timu agencija Ujed<strong>in</strong>jenih nacija na Kosovu34


<strong>United</strong> <strong>Nations</strong> High Commissionerfor Human RightsThe Office of the <strong>United</strong> <strong>Nations</strong> High Commissioner for Human Rights (OHCHR) has lead responsibilityfor implement<strong>in</strong>g the <strong>United</strong> <strong>Nations</strong> human rights programme. The <strong>in</strong>ternational communityhas given OHCHR a mandate to promote and protect human rights around the world. Headed by theHigh Commissioner for Human Rights, a position established by the UN General Assembly <strong>in</strong> 1993,OHCHR works to build awareness of and respect for human rights – empower<strong>in</strong>g <strong>in</strong>dividuals to claimtheir rights and assist<strong>in</strong>g States to uphold them. OHCHR, a part of the <strong>United</strong> <strong>Nations</strong> Secretariat, isheadquartered <strong>in</strong> Geneva.Over the years, OHCHR has <strong>in</strong>creased its presence <strong>in</strong> the field, reach<strong>in</strong>g out to people who need protectionthe most. In <strong>Serbia</strong>, OHCHR’s field presence was established <strong>in</strong> 1996, and status agreementssigned with the authorities stipulate its mandate <strong>in</strong> the country with core functions of monitor<strong>in</strong>g,report<strong>in</strong>g, protection and promotion of human rights.In l<strong>in</strong>e with its Strategic Management Plan, OHCHR closed its Office <strong>in</strong> Belgrade <strong>in</strong> June 2007. However,OHCHR will cont<strong>in</strong>ue to provide human rights support <strong>in</strong> <strong>Serbia</strong> through the deployment of a NationalHuman Rights Advisor to the UN Country Team <strong>in</strong> <strong>Serbia</strong> as of November 2007. This Advisor will supportthe Office of the Resident Coord<strong>in</strong>ator and the UN Country Team <strong>in</strong> <strong>Serbia</strong> to monitor the humanrights situation and assist the Government of <strong>Serbia</strong> to develop its capacity to promote and protecthuman rights <strong>in</strong> <strong>Serbia</strong>.In light of the demands of the human rights situation expected to emerge dur<strong>in</strong>g the com<strong>in</strong>g periodOHCHR is currently <strong>in</strong> the process of strengthen<strong>in</strong>g its presence <strong>in</strong> Kosovo. Current activities focus onthe human rights dimension of the transition processes <strong>in</strong> Kosovo, with the aim of ensur<strong>in</strong>g cont<strong>in</strong>uedhuman rights protection and promot<strong>in</strong>g accountability for all <strong>in</strong>stitutions <strong>in</strong> Kosovo. Other priorities<strong>in</strong>clude the development of new approaches to transitional justice issues; encourag<strong>in</strong>g legislation andpolicy <strong>in</strong>itiatives that are compatible with <strong>in</strong>ternational human rights pr<strong>in</strong>ciples; monitor<strong>in</strong>g the consequencesof rule of law gaps on m<strong>in</strong>ority communities <strong>in</strong> Kosovo; and <strong>in</strong>creased attention to humanrights <strong>in</strong> the UN Kosovo Team.35

Danas je UNHCR jedna od vodećih humanitarnih agencija koja pruža pomoćza oko 20 miliona izbeglica i osoba kojima se bavimo u preko 120 zemalja u svetu. Tokom više od polaveka rada, agencija je obezbedila pomoć za više od 50 miliona ljudi i za svoj rad dobila dve Nobelovenagrade – 1954. god<strong>in</strong>e i 1981. god<strong>in</strong>e.UNHCR je otvorio kancelariju u Beogradu 1976. god<strong>in</strong>e da bi, u odsustvu nacionalnog sistema azila,odgovorio na potrebe sve većeg broja azilanata koji su dolazili iz zemalja istočne Evrope, Azije i Afrike.Međutim, raspadom SFRJ i prilivom izbeglica u Srbiju. Beogradska kancelarija UNHCR je 1992. počelada se bavi zbr<strong>in</strong>javanjem izbeglica iz Bosne i Hercegov<strong>in</strong>e i Hrvatske sarađujući sa Vladom u pružanju<strong>in</strong>terventne humanitarne pomoći. Accord de Siege (Sporazum između UNHCR i Savezne Vlade SRJ),koji je potpisan sa Vladom 1996. predstavlja pravni osnov aktivnosti UNHCR u zemlji. Broj izbeglica sesmanjio zahvaljujući programima doborovoljnog povratka, lokalne <strong>in</strong>tegracije i preseljenja. Procenjujese da u Srbiji danas boravi 97.000 izbeglih lica.Mandat UNHCR za <strong>in</strong>terno raseljena lica (IRL) proizlazi iz zahteva, koji je Generalni sekretar uputioagenciji 1991. god<strong>in</strong>e, da pomogne osobama koje su raseljene usled sukoba na teritoriji prethodne Jugoslavije.Rezolucija 1244 Saveta bezbednosti UN predviđa odgovornost UNHCR za praćenje procesapovratka. Nakon sukoba na proleće 1999. god<strong>in</strong>e, Vlada je uputila molbu UNHCR u Srbiji i Crnoj Gorida proširi svoj mandat u zemlji i na 223.353 <strong>in</strong>terno raseljenih lica sa Kosova. Obzirom na nestabilnubezbedonosnu situaciju na Kosovu, ograničenu slobodu kretanja i neadekvatne uslove za održivu re<strong>in</strong>tegraciju,UNHCR promoviše pravo na povratak, pomaže <strong>in</strong>dividualni povratak onih lica koja se za toopredele, te pruža pomoć i pravnu zaštitu najugroženijim kategorijama IRL, i Romima, putem svojihizvršnih partnera. Prema procenama, u Srbiji 2007. god<strong>in</strong>e boravi 206.000 <strong>in</strong>terno raseljenih lica.Redukujući humanitarnu komponentu, UNHCR istovremeno nastavlja da sprovodi aktivnosti u okvirusvog osnovnog mandata. Kancelarija je <strong>in</strong>tenzivirala i pojačala pomoć vlastima tokom izrade nacrtazakona o azilu i uspostavljanja <strong>in</strong>stitucija azila u Srbiji. Glavne aktivnosti na polju azila sastoje se izlobiranja, zagovaranja, pravne ekspertize u razvoju nacionalnog zakonodavstva i pružanju tehničkepomoći. The <strong>United</strong> <strong>Nations</strong> High Commissionerfor RefugeesThe <strong>United</strong> <strong>Nations</strong> High Commissioner for Refugees was established by the UN General Assembly on14 December 1950. Today, UNHCR is one of the world’s pr<strong>in</strong>cipal humanitarian agencies help<strong>in</strong>g some20 million refugees and persons of concern <strong>in</strong> over 120 countries. Dur<strong>in</strong>g more than half a centuryof work, the agency provided assistance to more than 50 million people earn<strong>in</strong>g two Nobel Prizes – <strong>in</strong>1954 and 1981.UNHCR first opened its office <strong>in</strong> Belgrade <strong>in</strong> 1976 to deal with the <strong>in</strong>creas<strong>in</strong>g number of asylum seekersfrom eastern European countries, Asia and Africa <strong>in</strong> the absence of the national asylum system.However, with the dissolution of the SFRY and the <strong>in</strong>flux of refugees <strong>in</strong>to <strong>Serbia</strong>, UNHCR office <strong>in</strong> Belgrade<strong>in</strong>creas<strong>in</strong>gly took over <strong>in</strong> 1992 the care and accommodation of refugees from BiH and Croatia,assist<strong>in</strong>g the Government <strong>in</strong> provid<strong>in</strong>g emergency assistance. Accord de Siege, signed with the Government<strong>in</strong> 1996, represents the legal basis of UNHCR operation <strong>in</strong> the country. Thanks to the programsof voluntary repatriation, local <strong>in</strong>tegration and resettlement, the number of refugees has decreasedand today there are an estimated 97,000 refugees <strong>in</strong> <strong>Serbia</strong>.UNHCR’s mandate with respect to IDPs stems from a Secretary General’s 1991 request to assistthose displaced as a result of the conflict <strong>in</strong> former Yugoslavia. The UNSC Resolution 1244 stipulatesUNHCR’s role as supervis<strong>in</strong>g the return process. After the conflict <strong>in</strong> spr<strong>in</strong>g 1999, UNHCR <strong>Serbia</strong> andMontenegro was asked by the Government to extend its mandate <strong>in</strong> the country to the 223,353 <strong>in</strong>ternallydisplaced persons from Kosovo. In view of the volatile security situation <strong>in</strong> Kosovo, limitedfreedom of movement and <strong>in</strong>adequate conditions for susta<strong>in</strong>able re<strong>in</strong>tegration UNHCR cont<strong>in</strong>ues topromote the right to return, to facilitate <strong>in</strong>dividual returns for those wish<strong>in</strong>g to do so and to provideassistance and protection, through its implement<strong>in</strong>g partners, for the most vulnerable IDPs, <strong>in</strong>clud<strong>in</strong>gRoma. In 2007 there are an estimated 206,000 IDPs <strong>in</strong> <strong>Serbia</strong>.While scal<strong>in</strong>g down its humanitarian component, UNHCR cont<strong>in</strong>ues with its core mandate activities.The Office <strong>in</strong>tensified and strengthened its assistance to the authorities <strong>in</strong> draft<strong>in</strong>g asylum legislationand establish<strong>in</strong>g asylum <strong>in</strong>stitutions <strong>in</strong> <strong>Serbia</strong>. Major activities <strong>in</strong> the field of asylum <strong>in</strong>clude lobby<strong>in</strong>g,advocacy, provision of legal expertise <strong>in</strong> development of national legislation and provision of technicalassistance. At the same time, the agency has with the EU funds, identified and helped reconstruct andfurnish the reception centre for asylum seekers <strong>in</strong> Banja Koviljaca where the beneficiaries will mov<strong>in</strong>gto on 1 November. Given the absence of a legislative framework on refugee protection and asylumstructures deal<strong>in</strong>g with asylum-seekers and refugees orig<strong>in</strong>at<strong>in</strong>g from outside the region <strong>in</strong> <strong>Serbia</strong>,UNHCR cont<strong>in</strong>ues, on “ad <strong>in</strong>terim” basis, to provide <strong>in</strong>ternational protection under its Mandate throughthe Refugee Status Determ<strong>in</strong>ation procedure and resettlement.37

Sveobuhvatni cilj našeg Programa zazemlju za period 2005-2009. god<strong>in</strong>e je da obezbedi da sva deca, posebno ona koja žive u siromaštvui socijalnoj isključenosti, uživaju i ostvaruju svoja prava. UNI-CEF podržava donošenje i implementaciju Lokalnih planova akcije za decu (LPA) u određenimopšt<strong>in</strong>ama u Srbiji. LPA ne samo što mobilišu čitavu zajednicu da promoviše i štiti dečija pravai da identifikuje isključenu decu već i pojačava učešće građana. Na centralnom i na lokalnomnivou uspostavljen je sistem za prikupljanje podataka i nadgledanje sprovođenja planova akcijeza decu i progresa ka dostizanju Milenijumskih ciljeva razvoja (DevInfo). Identifikovano je nahiljade dece koja nisu vakc<strong>in</strong>isana, koja ne idu u školu ili žive u izolaciji zato što imaju smetnjeu razvoju, i njima će vremenom biti omogućen ravnopravan pristup zdrastvenom i obrazovnomsistemu.• Program Partnerstvo za prava deteta promoviše poštovanje prava deteta što omogućavauključenje sve dece u društvena dešavanja. Cilj ovog programa je podizanje svesti o siromaštvui isključenosti dece među opštom populacijom, privatnim sektorom i donosiocima odluka. Ovajprogram takođe mobiliše lokalne resurse iz privatnog sektora da podrže i daju svoj dopr<strong>in</strong>osimplementaciji UNICEF-ovih programa i na taj nač<strong>in</strong> podrže stvaranje boljih uslova za život svedece u zemlji.39

The Country Programme2005-2009 sets the overall goal to ensure that all children enjoy and exercise their rights. Inorder to best contribute to reach<strong>in</strong>g this goal, UNICEF is support<strong>in</strong>g the development of policies andprogrammes that will br<strong>in</strong>g <strong>Serbia</strong> <strong>in</strong> l<strong>in</strong>e with European standards and see that 30 % of children, whostill have to grow <strong>in</strong> poverty and exclusion, get their chance to grow healthy, go to school and developtheir full potentials.The 2005-2009 Country Programme comprises four programmes/areas of <strong>in</strong>tervention:• The Social Policy Reform programme seeks to establish a national legislation and a nationalsocial policy framework for children. To that end, UNICEF is assist<strong>in</strong>g the government <strong>in</strong> the developmentof important laws, policies and strategies <strong>in</strong> various fields, such as De<strong>in</strong>stitutionalisation,Juvenile Justice, Child Abuse and Neglect, as well as <strong>in</strong> the reform of the health and educationsectors.• The System and Institution Build<strong>in</strong>g programme aims to ensure access to quality, child-centredsocial services, especially for poor and excluded children. Svetska zdravstvena organizacijaSvetska zdravstvena organizacija je specijalizovana agencija Ujed<strong>in</strong>jenih nacija za zdravstvena pitanja.Osnovana je 7. aprila 1948. god<strong>in</strong>e. Misija i mandat SZO iskazani su u Ustavu SZO:“Dostizanje najvećeg nivoa zdravlja za sve ljude”, polazeći od prava na zdravlje kao osnovnog ljudskogprava. Ustav SZO def<strong>in</strong>iše zdravlje kao “stanje potpunog fizičkog, mentalnog i socijalnog blagostanja, ane samo kao odsustvo bolesti ili onesposobljenosti - <strong>in</strong>validiteta”Svetska zdravstvena organizacija je decentralizovana i pored svoje centrale u Ženevi. Programi i aktivnostiu zemljama su kreirani i rukovođeni kroz 6 regionalnih biroa – koji su nadležni za “regioneSZO”, pri čemu se regionalni programi zasnivaju na globalnim priorititetima koje zemlje def<strong>in</strong>išu naSvetskoj zdravstvenoj skupšt<strong>in</strong>i koja se u maju svake god<strong>in</strong>e održava u Ženevi. Programi SZO zasnovanisu na osnovnim pr<strong>in</strong>icipima i načelima UN i SZO.Regionalna strategija SZO, Regionalnog biroa za Evropu je “Usklađivanje službi SZO prema potrebamazemalja članica”. Regionalna kancelarija SZO za Evropu je imala pionirski zadatak u oblasti zdravlja iživotne sred<strong>in</strong>e koristeći multisektorski pristup, predvodila je rad na prevenciji hroničnih masovnihnezaraznih bolesti i promociji zdravlja, predvidela starenje stanovništva, a sva su ova pitanja postalaznačajna na svetskoj zdravstvenoj sceni u prvoj deceniji 21. veka. Uz to je evropski region prednjačio


u radu na reformi f<strong>in</strong>ansiranja zdravstvenog sistema, i identifikaciji potrebe za jačanje zdravstvenihsistema. U Evropi i u svetu su apsolutno neophodnizdravstveni sistemi koji dobro funkcionišu, kako bi se ovi ciljevi postigli; nedovoljni kapaciteti zdravstvenihsistema da dosegnu siromašne, predstavljaće nepremostivu prepreku u dostizanju MCR kojise odnose na zdravlje, a i sada je najmanje verovatno da će ovi ciljevi biti dostignuti u predvidjenomroku. Rad SZO u jugo-istočnoj Evropi se fokusirao na mir, ljudska prava i zdravlje. SZO, Savet Evrope iodredjeni broj zemalja su počeli projekte pod okriljem Pakta za stabilnost Evrope kako bi izgradili miru regionu kroz zajedničke programme javnog zdravlja. …Regionalna kancelarija SZO za Evropu nastavlja da poboljšava usluge koje pruža u 53 zemlje Evropskogregiona SZO, što je uključilo i dalji razvoj nacionalnih kancelarija SZO. Od posebnog su značajadostignuća u 4 oblasti: zarazne i nezarazne bolesti, jačanje zdravstvenih sistema i životna sred<strong>in</strong>ai zdravlje. Regionalna kancelarija SZO za Evropu je organizovala 2. Evropsku nedelju imunizacije, ukojoj je učestvovalo 25 zemalja (Srbija je učestvovala i 2006 i 2007); a sastanak 44 nacionalna koord<strong>in</strong>atoraza elim<strong>in</strong>aciju morbila i rubele je takodje održan; SZO pruža podršku zemljama članicama uplaniranju za moguću pandemiju izazvanu virusom ptičjeg gripa i planira da održi m<strong>in</strong>istarski forum“Svi protiv tuberkuloze” (oktobar, 2007, Berl<strong>in</strong>) i nastavlja da radi na povećanju dostupnosti prevenciji ilečenju HIV/side. Direktna podrška je pružena brojnim zemljama (uključujući Srbiju) da primene Evropskustrategiju za prevenciju i kontrolu nezaraznih bolesti i direktnu podršku za poboljšanje prevencijeraka grlića materice je dobilo 44 zemlje.Regionalna kancelarija SZO za Evropu je podržala 25 zemlje u Evropskom regionu, u naporima dasmanje nejednakosti u zdravstvenim sistemima i unapredjenju zdravstvene politike i upravljanjazdravstvenim sistemima ili u procesu restrukturiranja m<strong>in</strong>istarstava zdravlja. Evropski izveštaj ozdravstvenoj bezbednosti je pripremljen, a u toku su pripreme za održavanje m<strong>in</strong>istarske konferencijeo zdravstvenim sistemima koja će se održati u Estoniji, 2008.Obraćanje Nj. Predsednik je izrazio zadovoljstvo što ima priliku da izrazisvoju zahvalnost za rad i rezultate koji je SZO ostvarila od 1948 na ostvarivanju zdravstvenih ciljeva zastanovništvo kroz napore da se kreiraju zdravstvene politike, jačaju zdravstveni sistemi i u borbi protivbolesti. On je naglasio da je svet svedok ogromnog napretka koji ima uticaj na čitavo čovečanstvo,i iako je tehnologija postala <strong>in</strong>tegralni deo svakodnevog života, imperativ je za sve zemlje da uložezajedničke napore kako bi se prevazišli negativni efekti tako brzih promena, a ostvarila maksimalnadobrobit. Predvidjanje budućeg razvoja, naročito u pogledu novih tehnologija je bio veoma važan zadatak.Uspostavljanje veza i <strong>in</strong>tegrisan rad su bili ključni za to. Predsednik Tadic je naglasio da SZOpruža primer svojom voljom da rešava globalne probleme zajedno sa vladama i drugim agencijamai partnerima. Pažljivo planiranje je bilo od kritičnog značaja za savladavanje značajnih izazova. Sviučesnici imaju svoju ulogu, a Srbija će dati svoj dopr<strong>in</strong>os gde god bude mogla. Srbija je pažljivo pratilanaučna dostignuća koja utiču na zdravlje, i ponosna je što je dala dopr<strong>in</strong>os naučnom saznanjukoje unapredjuje čovečanstvo, uz pomoć SZO i kao deo svetske mreže stručnjaka. WHO Regional Committee for Europe – 57 th session, held from 17 – 20September 2007 <strong>in</strong> Belgrade, <strong>Serbia</strong>The 57th session of the WHO Regional Committee for Europe (govern<strong>in</strong>g body of 53 Member statesof WHO European Region) was held at the National Assembly <strong>in</strong> Belgrade. Direct support is provided to numerous countries (<strong>in</strong>clud<strong>in</strong>g<strong>Serbia</strong>) to implement the European Strategy for the Prevention and Control of noncommunicable diseasesand direct support was provided to 44 countries to improve prevention of cervical cancer.The Regional office supported 25 countries <strong>in</strong> the European Region, <strong>in</strong> their work to reduce <strong>in</strong>equalities<strong>in</strong> health systems and was help<strong>in</strong>g countries to improve policies on and management of health56

Svetska banka8. maja 2001. Savezna Republika Jugoslavija (kasnije Srbija i Crna Gora) nasledila je članstvo bivšeSocijalističke Federativne Republike Jugoslavije u Svetskoj banci. Nakon referenduma o nezavisnostiodržanog u Crnoj Gori 21. maja 2006, Srbija i Crna Gora postale su dve nezavisne države. Republika Srbijanastavlja članstvo Srbije i Crne Gore u Međunarodnom monetarnom fondu i u Grupi Svetske banke.U Srbiji i u Crnoj Gori cilj Svetske banke jeste da pomogne stvaranje privrednih uslova za otvaranje novihradnih mesta, efikasanog f<strong>in</strong>ansijskog sistema, adekvatnih zakona i pravnog sistema. U proteklih desetgod<strong>in</strong>a dug period nestabilnosti, ratovi, međunarodne izolacije kao i teške ekonomske situacije negativnosu uticali na životni standard velike već<strong>in</strong>e stanovništva. Loše stanje u privredi zemlje dovelo je do smanjenjarealnih zarada, uz istovremeno pogoršanje socijalne zaštite i zdravstvenih usluga. Kao rezultat toga,siromaštvo je naglo poraslo tokom devedesetih god<strong>in</strong>a i ostaje rasprostranjeno u obema republikama.Iako 10 posto stanovništva spada u kategoriju ispod granice siromaštva (10.6 posto u Srbiji i 9.4 postou Crnoj Gori), treć<strong>in</strong>a stanovnika su neposredno iznad granice siromaštva i postoji opasnost da skliznu uapsolutno siromaštvo u slučaju lošeg razvoja ekonomske situacije.Svetska banka je pomogla Srbiji i Crnoj Gori da poboljšaju stanje u oblasti penzija i socijalne pomoći,unoseći tako sušt<strong>in</strong>sku promenu u živote najugroženijih. The World BankOn May 8, 2001, the Federal Republic of Yugoslavia (later <strong>Serbia</strong> and Montenegro) succeeded to theWorld Bank membership of the former Socialist Federal Republic of Yugoslavia. After the referendum on<strong>in</strong>dependence <strong>in</strong> Montenegro on May 21, 2006, <strong>Serbia</strong> and Montenegro became two <strong>in</strong>dependent states.The Republic of <strong>Serbia</strong> cont<strong>in</strong>ues the membership of <strong>Serbia</strong> and Montenegro <strong>in</strong> the IMF and the WorldBank Group.In <strong>Serbia</strong> and Montenegro the World Bank’s goal is to help create an economy that creates jobs, a f<strong>in</strong>ancialsystem that operates effectively, laws that make sense and a justice system that is honest. We do thisthrough f<strong>in</strong>ance, advice and analysis that <strong>in</strong>form the country’s reform agenda.S<strong>in</strong>ce 2001, the Bank has helped the country move towards a market economy. It is spurr<strong>in</strong>g job creationby help<strong>in</strong>g develop the private sector and simplify the procedures for new bus<strong>in</strong>esses registration. An effectivef<strong>in</strong>ancial structure was put <strong>in</strong> place with the Bank’s support, and the first state-owned bank has been privatized.The power situation <strong>in</strong> <strong>Serbia</strong> has improved with Bank assistance, and the focus has now shifted todevelop<strong>in</strong>g a regional energy market and tackl<strong>in</strong>g the critical power situation <strong>in</strong> Montenegro.Poverty and unemployment rema<strong>in</strong> a major concern <strong>in</strong> both <strong>Serbia</strong> and Montenegro. Dur<strong>in</strong>g the past decade,a long period of <strong>in</strong>stability, wars, <strong>in</strong>ternational isolation, and economic turmoil adversely affected theliv<strong>in</strong>g standards of a vast majority of the population. The country’s poor economic performance led to adecrease <strong>in</strong> real earn<strong>in</strong>gs and was accompanied by deterioration <strong>in</strong> social protection and health services.As a result, poverty rose sharply <strong>in</strong> the 1990s and rema<strong>in</strong>s widespread <strong>in</strong> both republics.Although 10 percent of the population falls below the poverty l<strong>in</strong>e (10.6 percent <strong>in</strong> <strong>Serbia</strong> and 9.4 percent<strong>in</strong> Montenegro), one third of the country’s people are barely above it and rema<strong>in</strong> <strong>in</strong> danger of slipp<strong>in</strong>g <strong>in</strong>toabsolute poverty if any adverse economic developments occur.The World Bank has helped the country clear arrears <strong>in</strong> pensions and social benefits, mak<strong>in</strong>g a material difference<strong>in</strong> the lives of the most vulnerable. It is also f<strong>in</strong>anc<strong>in</strong>g programs that help people adjust to chang<strong>in</strong>gdemands <strong>in</strong> the labor market and is equipp<strong>in</strong>g the younger generation to compete <strong>in</strong> Europe by moderniz<strong>in</strong>gthe education system, refurbish<strong>in</strong>g schools and <strong>in</strong>troduc<strong>in</strong>g <strong>in</strong>novative teach<strong>in</strong>g methods.The World Bank is assist<strong>in</strong>g the <strong>Serbia</strong>n authorities implement policy reforms through a three-year (2005-2007) Country Assistance Strategy (CAS) program of $400 to $550 million.
