Rating agencies
Activities of rating agencies are now governed by self-regulation measures (codes of particular agencies)
respecting the standards of the IOSCO CRA Code. Application of the IOSCO Code is based on voluntary
exercising of “comply or explain” approach. The European regulations incorporated in the Directives 2004/39/
ES, 2006/48/ES and 2003/6/ES refer to activities of rating agencies only indirectly. The support for
maintaining the present self-regulatory framework of rating agencies prevails. In connection with the fi nancial
crisis the European Commission is of the view that time has come to implementation of legal regulations for rating
agencies. Discussion of the European Commission with the Member States on as to the legislative proposal on
implementing a supervision a regulation of rating agencies is at the very beginning.
