Ni busara isiyopingika k<strong>wa</strong>mba <strong>wa</strong>toto <strong>wa</strong>na haki. Mkataba <strong>wa</strong> Umoja <strong>wa</strong> Mataifa <strong>wa</strong> Haki<br />

za Watoto (UNCRC au CRC) na Mkataba <strong>wa</strong> nchi za Afrika <strong>wa</strong> Haki na Ustawi <strong>wa</strong> Watoto<br />

(ACRWC) unatoa maelekezo <strong>ya</strong> mfumo <strong>wa</strong> juhudi ambazo nchi zinapas<strong>wa</strong> kutilia mkazo ili<br />

kufanikisha mikataba hiyo .” Hata hivyo, licha <strong>ya</strong> ma<strong>wa</strong>zo ha<strong>ya</strong>, mara nyingi <strong>wa</strong>toto<br />

<strong>wa</strong>meku<strong>wa</strong> kitovu cha udhalilish<strong>wa</strong>ji, unyon<strong>ya</strong>ji na vurugu kutoka k<strong>wa</strong> <strong>wa</strong>tu <strong>wa</strong>liotaraji<strong>wa</strong><br />

Dhumuni la <strong>wa</strong>raka huu ni kuchambua k<strong>wa</strong> kina ki<strong>wa</strong>ngo cha juhudi hizo na jinsi<br />

zinavyoung<strong>wa</strong> mkono au kudhoofish<strong>wa</strong> k<strong>wa</strong> kukiuk<strong>wa</strong> haki za ku<strong>wa</strong>linda <strong>wa</strong>toto nchini<br />

<strong>Tanzania</strong>. TEN/MET ina <strong>wa</strong>si<strong>wa</strong>si k<strong>wa</strong>mba suala la ulinzi <strong>wa</strong> mtoto halitiliwi maanani k<strong>wa</strong><br />

ki<strong>wa</strong>ngo cha kutosha na k<strong>wa</strong>mba mafanikio <strong>ya</strong>liyopatikana chini <strong>ya</strong> Mpango <strong>wa</strong> Maendeleo<br />

<strong>wa</strong> Elimu <strong>ya</strong> Msingi (PEDP), na Mpango <strong>wa</strong> Maendeleo <strong>wa</strong> Sekta <strong>ya</strong> Elimu (EDSP) <strong>ya</strong>ko<br />

hatarini.<br />

<strong>Waraka</strong> huu unaoelezea hali ilivyo, k<strong>wa</strong>nza utafafanua dhana <strong>ya</strong> ulinzi <strong>wa</strong> mtoto, na<br />

baadaye kutathmini k<strong>wa</strong> kiasi gani sheria nchini <strong>Tanzania</strong> inavyo<strong>wa</strong>linda <strong>wa</strong>toto dhidi <strong>ya</strong><br />

madhara. Pia utatoa ufafanuzi juu <strong>ya</strong> ukub<strong>wa</strong> na athari zinazoweza kujitokeza za<br />

udhalilish<strong>wa</strong>ji <strong>wa</strong>toto nchini <strong>Tanzania</strong>, zilizopatikana kutoka katika sampuli za utafiti <strong>wa</strong><br />

hivi karibuni nchini <strong>Tanzania</strong>. Mwishowe, tutatoa mapendekezo kadhaa ambayo tunatumaini<br />

<strong>ya</strong>taihamasisha asasi za utetezi <strong>ya</strong> TEN/MET na hatimaye kuchochea mjadala mpana katika<br />

v<strong>ya</strong>ma v<strong>ya</strong> kiraia na serikali <strong>ya</strong> <strong>Tanzania</strong> jinsi <strong>ya</strong> kujenga mazingira salama k<strong>wa</strong> mtoto<br />

katika maeneo <strong>ya</strong> shuleni na katika jamii yetu.<br />

1.1 Maana <strong>ya</strong> dhana muhimu<br />

Maana zifuatazo zinatoa mfumo unaotambuli<strong>wa</strong> kimataifa utakaotumika kupimia masuala<br />

<strong>ya</strong> kumlinda mtoto nchini <strong>Tanzania</strong>. Maana hizo zinachukulia k<strong>wa</strong>mba mtoto chini <strong>ya</strong> umri<br />

<strong>wa</strong> miaka 18 yumo katika uwezekano mkub<strong>wa</strong> <strong>wa</strong> kudhuri<strong>wa</strong> na kufanyi<strong>wa</strong> maovu, na<br />

k<strong>wa</strong>mba <strong>wa</strong>tu <strong>wa</strong>zima na mashirika <strong>ya</strong>nayofan<strong>ya</strong> kazi na <strong>wa</strong>toto <strong>ya</strong>na <strong>wa</strong>jibu <strong>wa</strong> kujali na<br />

kujenga mazingira “salama k<strong>wa</strong> mtoto” ambapo hatari <strong>ya</strong> madhara inapunguz<strong>wa</strong> sana.<br />

TEN/MET inaamini maana zifuatazo:<br />

<strong>Mtoto</strong>: mtu yeyote mwenye umri <strong>wa</strong> chini <strong>ya</strong> miaka 18 (k<strong>wa</strong> mujibu <strong>wa</strong> UNCRC).<br />

<strong>Kumlinda</strong> mtoto: Neno lenye maana pana inayoeleza falsafa, sera, vi<strong>wa</strong>ngo miongozo<br />

na taratibu za ku<strong>wa</strong>linda <strong>wa</strong>toto dhidi <strong>ya</strong> madhara <strong>ya</strong>liyokusudi<strong>wa</strong> na <strong>ya</strong>siyokusudi<strong>wa</strong>.<br />

Madhara <strong>ya</strong> mtoto: ni dhana tata ambapo mazingira <strong>ya</strong> mtoto yeyote au kijana si<br />

lazima <strong>ya</strong>fae k<strong>wa</strong> ukamilifu katika mipaka iliyoweke<strong>wa</strong>. Hata hivyo makundi <strong>ya</strong>fuatayo <strong>ya</strong><br />

madhara <strong>ya</strong>nasaidia k<strong>wa</strong> ki<strong>wa</strong>ngo fulani kujenga msingi <strong>wa</strong> ku<strong>wa</strong>lindia <strong>wa</strong>toto.<br />

Madhara <strong>ya</strong> mwili ambapo majeraha halisi au <strong>ya</strong>liyojaribi<strong>wa</strong> kufany<strong>wa</strong> k<strong>wa</strong> mtoto<br />

<strong>ya</strong>lifany<strong>wa</strong> au ha<strong>ya</strong>kuzui<strong>wa</strong> k<strong>wa</strong> makusudi<br />

Madhara <strong>ya</strong> kingono ni pamoja na kujamiiana k<strong>wa</strong> maharimu, <strong>ya</strong>ani ndugu <strong>wa</strong> karibu,<br />

kubaka, shambulio la aibu, upigaji picha za aibu <strong>wa</strong>toto<br />

Madhara <strong>ya</strong> kihisia ni kushind<strong>wa</strong> kutoa mahitaji <strong>ya</strong> kimsingi <strong>ya</strong> kihisia k<strong>wa</strong> mtoto kiasi cha<br />

kuathiri viba<strong>ya</strong> mwenendo na maendeleo <strong>ya</strong> mtoto<br />

Kutelekez<strong>wa</strong> ni kushind<strong>wa</strong> kumpatia mahitaji muhimu na <strong>ya</strong> lazima (kama chakula, mavazi,<br />

usafi, makazi) kiasi cha kuthiri af<strong>ya</strong> na maendeleo <strong>ya</strong> mtoto<br />

Ku<strong>wa</strong>linda <strong>wa</strong>toto<br />

k<strong>wa</strong> majibu <strong>wa</strong><br />

sheria <strong>ya</strong><br />

kimataifa.<br />

“Binadamu wote <strong>wa</strong>mezali<strong>wa</strong><br />

utu na haki” mkataba <strong>wa</strong><br />

haki za mtoto unatambua<br />

k<strong>wa</strong>mba k<strong>wa</strong> ka<strong>wa</strong>ida <strong>wa</strong>toto<br />

<strong>wa</strong>natunz<strong>wa</strong> chini <strong>ya</strong> ulezi <strong>wa</strong><br />

mtu mzima na k<strong>wa</strong> hiyo<br />

linasema k<strong>wa</strong>mba “Dola<br />

zinazohusika zitachukua<br />

hatua zote zinazotaki<strong>wa</strong><br />

kuhakikisha ku<strong>wa</strong> mtoto<br />

analind<strong>wa</strong> dhidi <strong>ya</strong> aina zote<br />

za ubaguzi au adhabu k<strong>wa</strong><br />

msingi <strong>wa</strong> hadhi, shughuli,<br />

maoni au imani za <strong>wa</strong>zazi <strong>wa</strong><br />

mtoto, <strong>wa</strong>lezi halali au<br />

<strong>wa</strong>nafamilia”.<br />

Un<strong>ya</strong>n<strong>ya</strong>saji <strong>wa</strong> mtoto. Aina zote za utendeaji viba<strong>ya</strong> kimwili na kihisia, ubakaji, uzembe au<br />

kutende<strong>wa</strong> kiuzembe au kibiashara au unyon<strong>ya</strong>ji mwingine, unaosababisha madhara au<br />

uwezekano <strong>wa</strong> madhara k<strong>wa</strong> af<strong>ya</strong> <strong>ya</strong> mtoto, maisha, maendeleo au utu k<strong>wa</strong> maana <strong>ya</strong><br />

uhusiano <strong>wa</strong> majibu, amani au mamlaka “WHO, 1999”.<br />

2.0 Sheria za <strong>Tanzania</strong> zina<strong>wa</strong>lindaje <strong>wa</strong>toto wetu?<br />

Uchunguzi <strong>wa</strong> hivi karibuni kuhusu vurugu dhidi <strong>ya</strong> <strong>wa</strong>toto uliofany<strong>wa</strong> na UNICEF katika<br />

nchi za Afrika Mashariki na Kusini umeonyesha ku<strong>wa</strong> kumeku<strong>wa</strong> na utoaji taarifa usio<br />

kamili kuhusu vurugu dhidi <strong>ya</strong> <strong>wa</strong>toto. Nchi nyingi katika ukanda huo zinapitia sheria za<br />

kumlinda mtoto, k<strong>wa</strong> sababu <strong>wa</strong>metambua k<strong>wa</strong>mba sheria zilizopo hazitoshi kulinda <strong>wa</strong>toto<br />

na hazilingani na CRC na ACRWC (Zuberi/UNICEF, 2005)<br />

Umuhimu <strong>wa</strong> kuridhia CRC, na ACRWC upo katika ukweli k<strong>wa</strong>mba zimeweka vi<strong>wa</strong>ngo<br />

vinavyokubalika kimataifa na kanuni za msingi k<strong>wa</strong> ajili <strong>ya</strong> kulinda haki za mtoto. Ibara <strong>ya</strong><br />

4 <strong>ya</strong> CRC inazitaka serikali kuhakikisha ku<strong>wa</strong> hatua zote za kisheria, kiuta<strong>wa</strong>la na hatua<br />

nyingine zipo k<strong>wa</strong> ajili <strong>ya</strong> kutekeleza haki zilizowek<strong>wa</strong> na CRC. Jukumu hili k<strong>wa</strong> serikali<br />

kupitisha sheria <strong>ya</strong> ku<strong>wa</strong>linda <strong>wa</strong>toto ni msingi dhidi <strong>ya</strong> <strong>ya</strong>liyobaki <strong>ya</strong> CRC na inabidi<br />

isomwe.<br />

2.1 Sheria <strong>ya</strong> <strong>Tanzania</strong> inatoa maana gani <strong>ya</strong> “<strong>Mtoto</strong>”?<br />

Kusema kweli miongoni m<strong>wa</strong> upungufu mkub<strong>wa</strong> katika mfumo <strong>wa</strong> sheria <strong>wa</strong><br />

<strong>Tanzania</strong> kuhusiana na sheria <strong>ya</strong> ustawi <strong>wa</strong> mtoto ni kushind<strong>wa</strong> kuweka ba<strong>ya</strong>na<br />

mipaka <strong>ya</strong> utoto inayofafanua ni nani anayestahili kupata ulinzi <strong>wa</strong> ziada, kama<br />

“mtoto”. Hii inasababisha kutofahamika kwingi k<strong>wa</strong> umri <strong>wa</strong> chini <strong>wa</strong> mas<strong>wa</strong>la<br />

<strong>ya</strong>nayohusika, kama vile ndoa na ridhaa <strong>ya</strong> ngono (ACPE, 2007, P.25). Ni muhimu<br />

sana kurekebisha sheria za <strong>Tanzania</strong> kuonyesha maana <strong>ya</strong> mtoto ku<strong>wa</strong> ni mtu<br />

mwenye umri <strong>wa</strong> chini <strong>ya</strong> miaka 18 (k.h.j.).<br />

Mifano hai katika sheria za <strong>Tanzania</strong> ambapo tofauti hizi zinajitokeza ni pamoja na:<br />

Ajira: Sheria <strong>ya</strong> ajira Na. 47 <strong>ya</strong> 1955 (sura <strong>ya</strong> 366) inakataza ajira <strong>ya</strong> <strong>wa</strong>toto chini<br />

<strong>ya</strong> umri <strong>wa</strong> miaka 12 na inataka <strong>wa</strong>fan<strong>ya</strong>kazi <strong>wa</strong>toto <strong>wa</strong> umri <strong>wa</strong> miaka 12 hadi 14<br />

<strong>wa</strong>lipwe ujira <strong>wa</strong> kut<strong>wa</strong>, kufan<strong>ya</strong>kazi k<strong>wa</strong> mtindo <strong>wa</strong> siku hadi siku, <strong>wa</strong>pewe usafiri<br />

<strong>wa</strong> kurudi nyumbani kila siku jioni, na <strong>wa</strong>pate ruhusa <strong>ya</strong> kufan<strong>ya</strong>kazi kutoka k<strong>wa</strong><br />

<strong>wa</strong>zazi <strong>wa</strong>o. Umri <strong>wa</strong> chini <strong>wa</strong> miaka 12 unatofautiana na moja k<strong>wa</strong> moja na sheria<br />

<strong>ya</strong> elimu <strong>ya</strong> m<strong>wa</strong>ka 1978, inayotaja uandikishaji <strong>wa</strong> lazima katika elimu <strong>ya</strong> msingi ni<br />

kati <strong>ya</strong> umri <strong>wa</strong> miaka 7 na 13.<br />

Matunzo ndani <strong>ya</strong> familia. Kifungu cha 206 cha sheria zinazoainisha makosa<br />

hakielezi ba<strong>ya</strong>na “mahitaji muhimu” hayo ni <strong>ya</strong>pi. Kunahitajika ufafanuzi mkub<strong>wa</strong>.<br />

Lazima izingatiwe k<strong>wa</strong>mba hakuna masharti katika sheria za <strong>Tanzania</strong> k<strong>wa</strong> ajili <strong>ya</strong><br />

uingiliaji kati <strong>wa</strong> mamlaka <strong>ya</strong> serikali <strong>wa</strong>zazi <strong>wa</strong>naposhind<strong>wa</strong> kutoa matunzo<br />

<strong>ya</strong>nayofaa k<strong>wa</strong> <strong>wa</strong>toto <strong>wa</strong>o.<br />

Unyon<strong>ya</strong>ji <strong>wa</strong> kingono: Sheria <strong>ya</strong> ndoa <strong>ya</strong> 1971 inasema k<strong>wa</strong>mba umri <strong>wa</strong><br />

ridhaa k<strong>wa</strong> ajili <strong>ya</strong> ndoa na hivyo shughuli <strong>ya</strong> ngono ni miaka 15 tu k<strong>wa</strong> <strong>wa</strong>na<strong>wa</strong>ke,<br />

lakini miaka 18 k<strong>wa</strong> <strong>wa</strong>naume. K<strong>wa</strong> hiyo umri <strong>wa</strong> ridhaa unatofautiana, isipoku<strong>wa</strong><br />

k<strong>wa</strong> tahadhari katika sheria maalumu <strong>ya</strong> makosa <strong>ya</strong> ngono (SOSPA) <strong>ya</strong> 1998,<br />

inayoeleza k<strong>wa</strong>mba m<strong>wa</strong>namke ameole<strong>wa</strong> na m<strong>wa</strong>naume ana umri <strong>wa</strong> kati <strong>ya</strong> miaka<br />

15 hadi 18, shughuli <strong>ya</strong> ngono haitahehabi<strong>wa</strong> kama ubakaji. <strong>Hali</strong> hii imerekebish<strong>wa</strong><br />

hivi karibuni k<strong>wa</strong> mujibu <strong>wa</strong> sheria <strong>ya</strong> Uingereza na Wales na bila shaka kuna upeo<br />

<strong>wa</strong> marekebisho <strong>ya</strong> sheria k<strong>wa</strong> mujibu <strong>wa</strong> SOSPA pia.<br />

Matumizi <strong>ya</strong> mtandao <strong>wa</strong> kimataifa “Intaneti” k<strong>wa</strong> uhalifu dhidi <strong>ya</strong> <strong>wa</strong>toto<br />

haikutaj<strong>wa</strong> <strong>wa</strong>zi<strong>wa</strong>zi katika SOSPA isipoku<strong>wa</strong> katika kifungu 1388 – unyon<strong>ya</strong>ji <strong>wa</strong><br />

kingono <strong>wa</strong> <strong>wa</strong>toto. Kuna upeo <strong>wa</strong> marekebisho <strong>ya</strong> SOSPA kutokana na <strong>wa</strong>tumiaji<br />

wengi na k<strong>wa</strong> hiyo athari kub<strong>wa</strong> itakayoku<strong>wa</strong> nayo “Intaneti” k<strong>wa</strong> mtoto, kuliko k<strong>wa</strong><br />

mfano idadi ndogo <strong>wa</strong>takaohudhuria onyesho.<br />

Haki za kikatiba: Katiba <strong>ya</strong> <strong>Tanzania</strong> (Katiba <strong>ya</strong> Jamhuri <strong>ya</strong> Muungano <strong>wa</strong><br />

<strong>Tanzania</strong>) haijumuishi vifungu vyovyote moja k<strong>wa</strong> moja vinavyohusu <strong>wa</strong>toto na k<strong>wa</strong><br />

hali hiyo, katiba <strong>ya</strong> jamhuri <strong>ya</strong> Muungano <strong>wa</strong> <strong>Tanzania</strong> haisemi chochote kuhusu<br />

haki za <strong>wa</strong>toto. K<strong>wa</strong> hiyo haki za <strong>wa</strong>toto zinaweza kumaanisha kutoka katika katiba<br />

k<strong>wa</strong> ku<strong>wa</strong> ni “binadamu” ambao <strong>wa</strong>metaj<strong>wa</strong> na katiba <strong>ya</strong> Jamhuri <strong>ya</strong> Muungano <strong>wa</strong><br />

<strong>Tanzania</strong>.<br />

Kukosekana huku k<strong>wa</strong> masharti mahususi k<strong>wa</strong> <strong>wa</strong>toto kunaweza kueleza k<strong>wa</strong> nini,<br />

k<strong>wa</strong> uhakika haki za kikatiba za <strong>wa</strong>toto zilizomaanish<strong>wa</strong> mara nyingi hu<strong>wa</strong><br />

haziheshimiwi. K<strong>wa</strong> mfano, katiba <strong>ya</strong> Jamhuri <strong>ya</strong> Muungano <strong>wa</strong> <strong>Tanzania</strong> inasema<br />

ku<strong>wa</strong> kila binadamu amezali<strong>wa</strong> huru na k<strong>wa</strong> usa<strong>wa</strong> na haki <strong>ya</strong> kuheshimi<strong>wa</strong> na hadhi<br />

(sehemu <strong>ya</strong> III (12) <strong>ya</strong> katiba <strong>ya</strong> Jamhuri <strong>ya</strong> Muungano <strong>wa</strong> <strong>Tanzania</strong>). Hii ina maana<br />

k<strong>wa</strong>mba <strong>wa</strong>toto ha<strong>wa</strong>na budi kutende<strong>wa</strong> k<strong>wa</strong> usa<strong>wa</strong> na sheria na taasisi za sheria<br />

kama kati <strong>ya</strong> marika <strong>ya</strong>o na <strong>wa</strong>tu <strong>wa</strong>zima. Masharti <strong>ya</strong> sheria za ajira humaanisha<br />

k<strong>wa</strong>mba <strong>wa</strong>toto kusema kweli, ha<strong>wa</strong>tendewi k<strong>wa</strong> usa<strong>wa</strong>, <strong>wa</strong>napokea nusu <strong>ya</strong> ujira<br />

<strong>wa</strong> <strong>wa</strong>tu <strong>wa</strong>zima, na katika matukio mengine, hufan<strong>ya</strong> kazi muda mrefu zaidi.<br />

3.0 Je, ni lini tutaweka kipaumbele cha ku<strong>wa</strong>linda<br />

<strong>wa</strong>toto wetu?<br />

Inga<strong>wa</strong> 86% <strong>ya</strong> <strong>wa</strong>toto <strong>wa</strong> <strong>Tanzania</strong> <strong>wa</strong>naamini k<strong>wa</strong>mba maisha <strong>ya</strong>o <strong>ya</strong> baadaye<br />

<strong>ya</strong>taku<strong>wa</strong> bora zaidi <strong>ya</strong> maisha <strong>ya</strong> sasa <strong>ya</strong> <strong>wa</strong>zazi <strong>ya</strong> <strong>wa</strong>o (ACPF – UNICEF,2006,<br />

Uk 3) kuna ongezeko la <strong>wa</strong>si<strong>wa</strong>si miongoni m<strong>wa</strong> Asasi za kiraia (AZAKI)<br />

zinazofan<strong>ya</strong>kazi na <strong>wa</strong>toto <strong>wa</strong>naoishi katika mazingira magumu kuhusu kuenea k<strong>wa</strong><br />

un<strong>ya</strong>n<strong>ya</strong>saji na madhara k<strong>wa</strong> vijana.<br />

Mkakati <strong>wa</strong> kukuza uchumi na kupunguza umaskini (2005 – 2010) ni mkakati <strong>wa</strong><br />

taifa <strong>wa</strong> kukuza uchumi na kupunguza umaskini. Kuanzish<strong>wa</strong> k<strong>wa</strong> MKUKUTA ni<br />

tukio muhimu katika mchakato <strong>wa</strong> maendeleo <strong>ya</strong> <strong>Tanzania</strong>, k<strong>wa</strong>sababu, unafan<strong>ya</strong>kazi<br />

k<strong>wa</strong> u<strong>wa</strong>zi katika kuimarisha mbinu za usalama <strong>wa</strong> jamii k<strong>wa</strong> vikundi vinavyoishi<br />

katika mazingira magumu.<br />

MKUKUTA hasa una<strong>wa</strong>fan<strong>ya</strong> <strong>wa</strong>toto na vijana ku<strong>wa</strong> <strong>wa</strong>nahitaji kuangali<strong>wa</strong> kipekee,<br />

<strong>wa</strong>kati huohuo unabainisha ugomvi <strong>wa</strong> nyumbani k<strong>wa</strong> <strong>wa</strong>na<strong>wa</strong>ke kama suala<br />

linalokera. Hata hivyo MKUKUTA hausemi chochote kuhusu un<strong>ya</strong>n<strong>ya</strong>saji <strong>wa</strong> <strong>wa</strong>toto<br />

na <strong>wa</strong>la haubainishi uendelezi <strong>wa</strong> huduma za kumlinda mtoto kama eneo linalohitaji<br />

umuhimu maalumu. Upuuziaji huu unaonyesha mtazamo uliopo nchini <strong>Tanzania</strong><br />

unaokataa k<strong>wa</strong>mba kuna un<strong>ya</strong>n<strong>ya</strong>saji <strong>wa</strong> mtoto na k<strong>wa</strong>mba kipengele<br />

kinachochangia ku<strong>wa</strong>po k<strong>wa</strong> <strong>wa</strong>toto <strong>wa</strong> nje <strong>ya</strong> shule na <strong>wa</strong>toto <strong>wa</strong> mtaani.<br />

<strong>Nchini</strong> <strong>Tanzania</strong> hakuna vi<strong>wa</strong>ngo vinavyokubalika k<strong>wa</strong> mashirika <strong>ya</strong>nayoshughulika<br />

na <strong>wa</strong>toto <strong>wa</strong>lio katika mazingira magumu na <strong>wa</strong>la si lazima k<strong>wa</strong> mashirika<br />

<strong>ya</strong>nayoshughulikia <strong>wa</strong>toto ku<strong>wa</strong> na sera za ku<strong>wa</strong>linda <strong>wa</strong>toto wengi<br />

<strong>wa</strong>naon<strong>ya</strong>n<strong>ya</strong>s<strong>wa</strong> katika taasisi (shule, vituo v<strong>ya</strong> kulelea <strong>ya</strong>tima n.k.) lililo ba<strong>ya</strong> zaidi<br />

ni k<strong>wa</strong>mba Idara <strong>ya</strong> Ustawi <strong>wa</strong> jamii haifanyi mafunzo yoyote <strong>ya</strong> kujiendeleza kazini<br />

k<strong>wa</strong> <strong>wa</strong>fan<strong>ya</strong>kazi <strong>wa</strong>ke na k<strong>wa</strong>hiyo ha<strong>wa</strong>wezi ku<strong>wa</strong>tambua <strong>wa</strong>toto <strong>wa</strong>naoonyesha<br />

dalili za kun<strong>ya</strong>n<strong>ya</strong>s<strong>wa</strong> au kuingilia kati k<strong>wa</strong> kutambua umuhimu na ipasavyo k<strong>wa</strong><br />

maslahi <strong>ya</strong> mtoto.<br />

<strong>Kumlinda</strong> mtoto ni u<strong>wa</strong>nja mpana na wenye vipengele mbalimbali k<strong>wa</strong> ku<strong>wa</strong> kila<br />

maingiliano na <strong>wa</strong>toto <strong>ya</strong>na uwezekano <strong>wa</strong> kuleta madhara au uovu. Katika sehemu<br />

hii tutaangalia namna un<strong>ya</strong>n<strong>ya</strong>saji <strong>wa</strong> mtoto unavyochangia un<strong>ya</strong>n<strong>ya</strong>saji <strong>wa</strong> kingono<br />

na ukatili <strong>wa</strong> polisi k<strong>wa</strong> <strong>wa</strong>toto.<br />

3.1 Un<strong>ya</strong>n<strong>ya</strong>saji <strong>wa</strong> kimwili na kihisia<br />

Hivi karibuni Mkombozi ilifan<strong>ya</strong> sensa <strong>ya</strong> <strong>wa</strong>toto <strong>wa</strong> mtaani na vijana katika miji <strong>ya</strong><br />

moshi na Arusha. Matokeo <strong>ya</strong>meonyesha k<strong>wa</strong>mba 53% <strong>ya</strong> <strong>wa</strong>toto na vijana<br />

<strong>wa</strong>mesema k<strong>wa</strong>mba <strong>wa</strong>zazi wengine katika ka<strong>ya</strong> <strong>wa</strong>li<strong>wa</strong>apiza, ku<strong>wa</strong>tukana,<br />

ku<strong>wa</strong>dharau au ku<strong>wa</strong>fanyia mambo ambayo <strong>wa</strong>nadhani <strong>ya</strong>ngeweza ku<strong>wa</strong>dhuru<br />

kimwili. Kilichoonekana ni k<strong>wa</strong>mba 61% <strong>ya</strong> <strong>wa</strong>liohoji<strong>wa</strong> <strong>wa</strong>lisema ku<strong>wa</strong> mtu mzima<br />

ali<strong>wa</strong>sukuma, ku<strong>wa</strong>kamata, ku<strong>wa</strong>piga makofi au ku<strong>wa</strong>tupia mtu na/au kupig<strong>wa</strong> na<br />

kitu k<strong>wa</strong> nguvu kiasi cha ku<strong>wa</strong> na alama au makovu na <strong>wa</strong>kati mwingine<br />

ku<strong>wa</strong>umiza, mara k<strong>wa</strong> mara au baadhi <strong>ya</strong> <strong>wa</strong>kati. Hii inaonyesha k<strong>wa</strong>mba<br />

un<strong>ya</strong>n<strong>ya</strong>saji kimwili ni mwenendo <strong>wa</strong> ka<strong>wa</strong>ida k<strong>wa</strong> <strong>wa</strong>tu <strong>wa</strong>zima. Hasa katika sensa<br />

hii, 19% <strong>wa</strong>mesema ku<strong>wa</strong> <strong>wa</strong>meathirika na mwenendno huo “mara nyingi”. Kuna<br />

un<strong>ya</strong>n<strong>ya</strong>paa mkub<strong>wa</strong> nchini <strong>Tanzania</strong> unaohusu kuelekeza un<strong>ya</strong>n<strong>ya</strong>saji na kutokana<br />

na hali hiyo, idadi <strong>ya</strong> <strong>wa</strong>toto <strong>wa</strong>naon<strong>ya</strong>n<strong>ya</strong>s<strong>wa</strong> inaweza ku<strong>wa</strong> kub<strong>wa</strong> zaidi uzoefu <strong>wa</strong><br />

Mkombozi katika kushughulikia <strong>wa</strong>toto na vijana ni k<strong>wa</strong>mba <strong>wa</strong>kati <strong>wa</strong>tu <strong>wa</strong>na<br />

<strong>wa</strong>si<strong>wa</strong>si <strong>wa</strong> kutoa taarifa <strong>ya</strong> mwenendo mba<strong>ya</strong>, <strong>wa</strong>kati huohuo imeku<strong>wa</strong> ni ka<strong>wa</strong>ida<br />

k<strong>wa</strong> <strong>wa</strong>toto <strong>wa</strong>sio na nidhamu na k<strong>wa</strong>mba adhabu <strong>ya</strong> viboko na lugha <strong>ya</strong> kumtisha<br />

mtoto k<strong>wa</strong> baadhi <strong>ya</strong> <strong>wa</strong>zazi ha<strong>wa</strong>oni ku<strong>wa</strong> ni mwenendo mba<strong>ya</strong> (Mkombozi, 2007).<br />

Hakimu <strong>wa</strong> Mahakama <strong>ya</strong> M<strong>wa</strong>nzo<br />

<strong>ya</strong> Maromboso aliyesikiliza shauri la<br />

msako <strong>wa</strong> kukamata <strong>wa</strong>toto <strong>wa</strong><br />

mtaani mnamo mwezi Machi,<br />

aliamuru <strong>wa</strong>toto hao <strong>wa</strong>achiwe.<br />

Katika kukiuka amri <strong>ya</strong> mahakama<br />

<strong>ya</strong> kuachi<strong>wa</strong> k<strong>wa</strong> <strong>wa</strong>toto,<br />

kulisababisha <strong>wa</strong>toto hao<br />

kurudish<strong>wa</strong> katika kituo cha polisi<br />

na kufikia kupig<strong>wa</strong>: “Nilipig<strong>wa</strong> sana,<br />

kiasi k<strong>wa</strong>mba mpaka sasa nina<br />

maumivu <strong>ya</strong> kifua, niliogopa sana na<br />

nilidhani nitakufa“. Ni baada <strong>ya</strong><br />

kipigo hiki katika kituo cha polisi<br />

ndipo <strong>wa</strong>toto <strong>wa</strong>lipoachi<strong>wa</strong> na<br />

kutish<strong>wa</strong> k<strong>wa</strong>mba <strong>wa</strong>tachuku<strong>wa</strong><br />

hatua hali zaidi kama <strong>wa</strong>taonekana<br />

tena mitaani (Kikundi cha kupigania<br />

haki za <strong>wa</strong>toto cha Caucus, 2005).<br />

Tarehe 26 Agosti 2005, kiasi cha<br />

<strong>wa</strong>toto 15 <strong>wa</strong>likamat<strong>wa</strong> na<br />

kupelek<strong>wa</strong> kwenye kituo cha polisi<br />

ambacho <strong>wa</strong>liorodhesh<strong>wa</strong> na<br />

kukesha kituoni katika chumba cha<br />

rumande cha <strong>wa</strong>tu <strong>wa</strong>zima (Inga<strong>wa</strong><br />

<strong>wa</strong>toto <strong>wa</strong>na haki <strong>ya</strong> kutenganish<strong>wa</strong><br />

na <strong>wa</strong>tu <strong>wa</strong>zima <strong>wa</strong>napoku<strong>wa</strong><br />

rumande).Zaidi <strong>ya</strong> hayo <strong>wa</strong>kati<br />

<strong>wa</strong>ki<strong>wa</strong> kizuizini katika kituo cha<br />

polisi <strong>wa</strong>toto hao <strong>wa</strong>lipig<strong>wa</strong> k<strong>wa</strong><br />

mjeledi na kulazimish<strong>wa</strong> <strong>wa</strong>safishe<br />

kituo cha polisi kama “adhabu” <strong>ya</strong>o.<br />

K<strong>wa</strong> mujibu <strong>wa</strong> mtoto mmoja <strong>wa</strong><br />

umri <strong>wa</strong> miaka 13: “Nilipelek<strong>wa</strong><br />

katika kituo cha polisi na <strong>wa</strong>o<br />

(polisi) <strong>wa</strong>litupiga mimi na <strong>wa</strong>toto<br />

wengine tulilazimish<strong>wa</strong> kujitwisha<br />

mawe makub<strong>wa</strong> vich<strong>wa</strong>ni mwetu<br />

<strong>wa</strong>lituadhibu na kufurahi (k.h.j.)<br />

<strong>Hali</strong> hii inaweza ikathibitish<strong>wa</strong> zaidi na vi<strong>wa</strong>ngo v<strong>ya</strong> msongo ulioelez<strong>wa</strong> na <strong>wa</strong>toto na vijana. 14%<br />

miongoni m<strong>wa</strong>o <strong>wa</strong>lisema mara nyingi <strong>wa</strong>liogopa sana, <strong>wa</strong>liku<strong>wa</strong> na msongo k<strong>wa</strong> muda mrefu,<br />

<strong>wa</strong>liota ndoto za jinamizi au hofu <strong>ya</strong> usalama <strong>wa</strong>o. Ni 44% tu, ndio <strong>wa</strong>liosema ha<strong>wa</strong>ja<strong>wa</strong>hi ku<strong>wa</strong> na<br />

hisia hizo. Hii inaonyesha k<strong>wa</strong>mba <strong>wa</strong>toto na vijana hao <strong>wa</strong>naishi katika ki<strong>wa</strong>ngo kikub<strong>wa</strong> cha<br />

msongo sugu. Hii ina athari k<strong>wa</strong> uwezo <strong>wa</strong>o <strong>wa</strong> kujifunza, kujenga uhusiano na kufan<strong>ya</strong>kazi katika<br />

ki<strong>wa</strong>ngo chochote cha utambuzi na hisia cha ka<strong>wa</strong>ida k<strong>wa</strong> umri <strong>wa</strong>o. Vi<strong>wa</strong>ngo hivi v<strong>ya</strong> kihoro<br />

vinaweza kuhusish<strong>wa</strong> na matukio <strong>ya</strong> un<strong>ya</strong>n<strong>ya</strong>si <strong>wa</strong> kimwili, kingono na kihisia. Inasikitisha k<strong>wa</strong>mba<br />

44% <strong>ya</strong> <strong>wa</strong>liohoji<strong>wa</strong> <strong>wa</strong>meku<strong>wa</strong> <strong>wa</strong>athiri<strong>wa</strong> au <strong>wa</strong>meshuhudia ugomvi <strong>wa</strong> kiasi fulani (Mkombozi,<br />

2007).<br />

Adhabu <strong>ya</strong> viboko inahusu “majeraha halisi <strong>ya</strong> mwili au <strong>ya</strong>nayokusudi<strong>wa</strong> k<strong>wa</strong> mtoto (Mtandao <strong>wa</strong><br />

ku<strong>wa</strong>weka salama, Watoto, 2007) na hivyo kumsababishia madhara mtoto. Inataki<strong>wa</strong> ku<strong>wa</strong><br />

kipaumbele cha mfumo <strong>wa</strong> shule ku<strong>wa</strong>weka <strong>wa</strong>toto salama, hata hivyo adhabu <strong>ya</strong> viboko bado<br />

inatumika sana katika shule za <strong>Tanzania</strong> na katika mfumo <strong>wa</strong> hukumu za <strong>wa</strong>toto na katika familia.<br />

Serikali imepitia kanuni <strong>ya</strong> adhabu <strong>ya</strong> viboko <strong>ya</strong> m<strong>wa</strong>ka 1979 k<strong>wa</strong> kupunguza idadi <strong>ya</strong> viboko<br />

kutoka 6 hadi 4 na kusisitiza utumizaji <strong>wa</strong> adhabu hiyo k<strong>wa</strong> kuongeza sharti kuhusu hatua kali k<strong>wa</strong><br />

viongozi <strong>wa</strong>takaokiuka kanuni hii <strong>ya</strong> elimu <strong>ya</strong> m<strong>wa</strong>ka 2007 (NNOC, 2005). Hata hivyo mabadiliko<br />

<strong>ya</strong> sheria zinazohusu adhabu <strong>ya</strong> viboko mara nyingi <strong>ya</strong>naping<strong>wa</strong>. Watoto <strong>wa</strong>nachap<strong>wa</strong>, kupig<strong>wa</strong><br />

mateke, kupig<strong>wa</strong> makofi kubamiz<strong>wa</strong> ukutani na kudhalilish<strong>wa</strong> k<strong>wa</strong> makosa madogo sana katika<br />

shule na familia (UNICEF, 2001).<br />

Utafiti <strong>wa</strong> Mkombozi kuhusu sababu za <strong>wa</strong>toto ku<strong>wa</strong> katika mazingira magumu katika mkoa <strong>wa</strong><br />

Kilimanjaro (2006) umegundua <strong>ya</strong>fuatayo:<br />

Takribani kila shule katika utafiti huu inajaribu kukabiliana na<br />

utata <strong>wa</strong> namna <strong>ya</strong> kuadhibu <strong>wa</strong>toto. Shule <strong>ya</strong> Kifumbu inasema<br />

k<strong>wa</strong>mba “<strong>wa</strong>toto <strong>wa</strong>nape<strong>wa</strong> adhabu kali shuleni na nyumbani na<br />

hivyo ku<strong>wa</strong>ogopesha <strong>wa</strong>toto”… <strong>wa</strong>nahisi k<strong>wa</strong>mba “baadhi <strong>ya</strong> <strong>wa</strong>limu<br />

ni <strong>wa</strong>kali kupita kiasi”. Sababu za adhabu ni pamoja na kuchele<strong>wa</strong> kufika<br />

shule, kutofuata nidhamu <strong>ya</strong> shule na kutofan<strong>ya</strong> mazoezi <strong>ya</strong> masomo<br />

Kanuni za sasa za shule kuhusu adhabu <strong>ya</strong> viboko hazieleweki na<br />

hazifuatwi mara k<strong>wa</strong> mara. Walimu na <strong>wa</strong>zazi wengi <strong>wa</strong>naona k<strong>wa</strong>mba<br />

kukomesh<strong>wa</strong> k<strong>wa</strong> adhabu <strong>ya</strong> viboko kunasababisha kuanguka k<strong>wa</strong><br />

nidhamu katika shule. Kuna tatizo la pamoja la adhabu kali bila ku<strong>wa</strong> na<br />

mbadala au kutoku<strong>wa</strong>po k<strong>wa</strong> aina yoyote <strong>ya</strong> matokeo kutokana na<br />

mwenendo mba<strong>ya</strong>. <strong>Hali</strong> hii ina<strong>wa</strong>fan<strong>ya</strong> <strong>wa</strong>limu wengi <strong>wa</strong>changanyikiwe<br />

na mwishowe ku<strong>wa</strong> <strong>wa</strong>vivu kuhusu kuweka masharti yoyote<br />

<strong>ya</strong>takayoleta mwenendo unaotaraji<strong>wa</strong> miongoni m<strong>wa</strong> <strong>wa</strong>nafunzi.<br />

Adhabu <strong>ya</strong> viboko na un<strong>ya</strong>n<strong>ya</strong>saji wowote <strong>wa</strong> mtoto kimwili au matusi ni<br />

mashirika mengine <strong>ya</strong>nayohusika na matunzo <strong>ya</strong> <strong>wa</strong>toto ha<strong>wa</strong>oni ku<strong>wa</strong><br />

3.2 Unyon<strong>ya</strong>ji kingono na ubakaji.<br />

Serikali imechukua hatua mbalimbali za kushughulikia tatizo linaloongezeka la unyon<strong>ya</strong>ji<br />

kingono na ubakaji. Hatua hizo ni pamoja na kutung<strong>wa</strong> k<strong>wa</strong> SOSPA m<strong>wa</strong>ka 1998, kupitish<strong>wa</strong><br />

k<strong>wa</strong> Yokohama Global commitment 2001 (k<strong>wa</strong> ajili <strong>ya</strong> ku<strong>wa</strong>linda <strong>wa</strong>toto dhidi <strong>ya</strong> adhabu, sura<br />

<strong>ya</strong> 13, 1986 <strong>ya</strong> Zanzibar (NNOC, 2006).<br />

“Pamoja na kufan<strong>ya</strong> ku<strong>wa</strong> jinai na ku<strong>wa</strong>po k<strong>wa</strong> sheria zinazoainisha makosa na adhabu zake,<br />

sura <strong>ya</strong> 16 na SOSPA, ambazo zote zina masharti <strong>ya</strong> jumla <strong>ya</strong>nayolinda <strong>wa</strong>toto dhidi <strong>ya</strong> ubakaji<br />

bado tabia hiyo imeenea sana katika maeneo <strong>ya</strong> miji yenye <strong>wa</strong>tu wengi <strong>wa</strong> maeneo <strong>ya</strong> miji<br />

midogo. Umaskini na migogoro ndani <strong>ya</strong> familia hu<strong>wa</strong>fan<strong>ya</strong> <strong>wa</strong>toto <strong>wa</strong>tafute njia nyingine za<br />

maisha mbali na nyumbani k<strong>wa</strong>o. Wasichana wengi ha<strong>wa</strong>oni matarajio mazuri <strong>ya</strong> maisha <strong>ya</strong>o<br />

baada <strong>ya</strong> kuvunja ungo. Wana njia chache sana zenye uhakika <strong>wa</strong> maisha <strong>ya</strong>o k<strong>wa</strong> sababu<br />

wengi <strong>wa</strong>o ha<strong>wa</strong>hudhurii au kumaliza elimu <strong>ya</strong> msingi au <strong>ya</strong> sekondari. Wasichana wengi<br />

ha<strong>wa</strong>na haki <strong>ya</strong> kumiliki mali au ardhi, <strong>wa</strong>la uwezo au fursa <strong>ya</strong> kuanzisha shughuli endelevu za<br />

uzalishaji kipato. Mvuto <strong>wa</strong>o kingono ni miongoni m<strong>wa</strong> rasilimali chache za chache<br />

<strong>wa</strong>nazodhani<strong>wa</strong> ku<strong>wa</strong> nazo” NNOC, 2006).<br />

Mkombozi ilifan<strong>ya</strong> utafiti na viongozi <strong>wa</strong> jamii <strong>wa</strong> Majengo kuhusu matukio <strong>ya</strong> ubakaji <strong>wa</strong>toto<br />

miongoni m<strong>wa</strong> <strong>wa</strong>nafunzi <strong>wa</strong> shule <strong>ya</strong> msingi <strong>ya</strong> eneo hilo. Waligundua matukio <strong>ya</strong> ubakaji<br />

ambapo <strong>wa</strong>nafunzi kutoka shule za jirani <strong>wa</strong>natoa kiasi kidogo cha fedha k<strong>wa</strong> <strong>wa</strong>nafunzi <strong>wa</strong><br />

shule <strong>ya</strong> msingi k<strong>wa</strong> ajili <strong>ya</strong> kupe<strong>wa</strong> ngono. Wabakaji wengi ni <strong>wa</strong>naume <strong>wa</strong>naofan<strong>ya</strong>kazi<br />

katika magereji, karakana na shughuli nyingine za biashara karibu na eneo la shule. Yaelekea<br />

kuna mtandao <strong>wa</strong> <strong>wa</strong>naume ha<strong>wa</strong> <strong>wa</strong>naosaidiana kuficha shughuli zao za ubakaji na kukwepa<br />

kukamat<strong>wa</strong> <strong>wa</strong>kifan<strong>ya</strong> kitendo hicho. Bahati mba<strong>ya</strong>, miongoni m<strong>wa</strong> v<strong>ya</strong>nzo vikub<strong>wa</strong> sana v<strong>ya</strong><br />

ubakaji k<strong>wa</strong> <strong>wa</strong>toto <strong>wa</strong> majengo ni <strong>wa</strong>naume <strong>wa</strong> ndani, <strong>ya</strong>ani jamii hiyo. matukio kama hayo<br />

<strong>ya</strong>elekea ha<strong>ya</strong>tolewi taarifa mpaka na isipoku<strong>wa</strong> <strong>wa</strong>kamatwe” kisirisiri. K<strong>wa</strong> mfano, katika<br />

tukio la hivi karibuni lililoripoti<strong>wa</strong> katika shule <strong>ya</strong> msingi <strong>ya</strong> Majengo, m<strong>wa</strong>limu alimgundua<br />

m<strong>wa</strong>nafunzi mwenye maumivu <strong>ya</strong> mwili. K<strong>wa</strong> msaada na kuti<strong>wa</strong> moyo, hatimaye mtoto alikiri<br />

k<strong>wa</strong>mba ameku<strong>wa</strong> akibak<strong>wa</strong>. Hata hivyo, <strong>wa</strong>kati m<strong>wa</strong>limu alipom<strong>wa</strong>rifu baba <strong>wa</strong> mtoto kuhusu<br />

ubakaji huo, hakuchukua hatua yoyote. Baadaye mama <strong>wa</strong> mtoto alichukua hatua <strong>ya</strong> kumsaidia<br />

mtoto <strong>wa</strong>ke, lakini amejikuta akikabili<strong>wa</strong> na upinzani <strong>wa</strong> mara k<strong>wa</strong> mara kutoka k<strong>wa</strong> mume<br />

<strong>wa</strong>ke aliyemwelekeza asiiarifu polisi. K<strong>wa</strong> msaada <strong>wa</strong> m<strong>wa</strong>limu, hatimaye mama <strong>wa</strong> mtoto<br />

alieleza tukio hilo katika mkutano <strong>wa</strong> kamati <strong>ya</strong> shule. Iliku<strong>wa</strong> katika mkutano huo mzazi<br />

mwingine alipotoa taarifa k<strong>wa</strong>mba baba <strong>wa</strong> mtoto huyo aliku<strong>wa</strong> aki<strong>wa</strong>baka <strong>wa</strong>toto wengi <strong>wa</strong><br />

shule hiyo akiwemo mtoto <strong>wa</strong>ke mwenyewe <strong>wa</strong> kiume (Mkombozi, 2006).<br />

3.3 Ukatili <strong>wa</strong> polisi k<strong>wa</strong> <strong>wa</strong>toto na vijana<br />

Inga<strong>wa</strong> <strong>Tanzania</strong> imeridhia UNCRC na ibara <strong>ya</strong> 37 na 40 za mkataba huo zinatoa maelekezo <strong>ya</strong><br />

kutosha k<strong>wa</strong> ajili <strong>ya</strong> utendeaji na haki za <strong>wa</strong>toto kuhusiana na haki, maofisa wengi <strong>wa</strong> Polisi <strong>wa</strong><br />

<strong>Tanzania</strong> ha<strong>wa</strong>na uele<strong>wa</strong> <strong>wa</strong> kutosha <strong>wa</strong> kufan<strong>ya</strong>kazi k<strong>wa</strong> mujibu <strong>wa</strong> haki za mtoto. Chuki na<br />

ubaguzi dhidi <strong>ya</strong> <strong>wa</strong>toto <strong>wa</strong> mtaani ni za ka<strong>wa</strong>ida miongoni m<strong>wa</strong> jeshi la Polisi <strong>wa</strong>nao<strong>wa</strong>ona<br />

<strong>wa</strong>toto na vijana hao ni <strong>wa</strong>halifu na <strong>wa</strong>kosaji. Maofisa hao <strong>wa</strong> Polisi mara nyingi ha<strong>wa</strong>elewi<br />

sababu zinazo<strong>wa</strong>fan<strong>ya</strong> <strong>wa</strong>toto hao <strong>wa</strong>ingie mitaani na katika hali ambapo <strong>wa</strong>talazimika<br />

kuomba, kuiba au kulala ovyo. Watoto na vijana mara nyingi <strong>wa</strong>nawek<strong>wa</strong> rumande katika vituo<br />

v<strong>ya</strong> polisi k<strong>wa</strong> tuhuma za uzururaji na kuomba, na mara nyingi ha<strong>wa</strong>tendewi haki na ha<strong>wa</strong>pewi<br />

malezi/mafunzo na msaada <strong>wa</strong> kutosha kuhusu haki zao na shughuli nyingine k<strong>wa</strong> maisha <strong>ya</strong>o<br />

<strong>ya</strong> baadaye. Haki hii inazidish<strong>wa</strong> na mamlaka <strong>ya</strong> Halmashauri <strong>ya</strong> Jiji na Wila<strong>ya</strong> ambao mara<br />

k<strong>wa</strong> mara huagiza polisi <strong>wa</strong><strong>wa</strong>kamate <strong>wa</strong>toto <strong>wa</strong> mitaani. Mwezi Mei 2005, Mkombozi<br />

ili<strong>wa</strong>bainisha <strong>wa</strong>toto 21 <strong>wa</strong>lioku<strong>wa</strong> <strong>wa</strong>mefung<strong>wa</strong> katika jela <strong>ya</strong> <strong>wa</strong>tu <strong>wa</strong>zima <strong>ya</strong> Kisongo. Mara<br />

baada <strong>ya</strong> kuti<strong>wa</strong> ndani <strong>wa</strong>toto <strong>wa</strong>nakabili<strong>wa</strong> na vurugu na kubak<strong>wa</strong> na kufung<strong>wa</strong> pamoja na<br />

<strong>wa</strong>tu <strong>wa</strong>zima <strong>wa</strong>halifu.<br />

za kilimo. Katika eneo hili, <strong>wa</strong>toto<br />

kutoka nchini kote <strong>wa</strong>najihusisha na<br />

ukahaba.<br />

Wasichana 25 <strong>wa</strong>likubali kukaa<br />

kubadilishana uzoefu kuhusu<br />

mazingira mbalimbali<br />

<strong>wa</strong>naoweza kutoa huduma za ngono<br />

bila <strong>ya</strong> matatizo yoyote.<br />

majukumu yoyote <strong>ya</strong> ulezi.<br />

Niliambi<strong>wa</strong> niondoke siku 30 baada<br />

<strong>ya</strong> kujifungua. Nimejikuta niko hapa<br />

kupitia k<strong>wa</strong> rafiki <strong>ya</strong>ngu Emmy.<br />

K<strong>wa</strong> hiyo nafan<strong>ya</strong>kazi <strong>ya</strong> kumsaidia<br />

mama mmoja anayetengeneza<br />

pombe <strong>ya</strong> “Kimpumu” (Pombe <strong>ya</strong><br />

kienyeji <strong>ya</strong> kabila la Wan<strong>ya</strong>kyusa).<br />

4. Hitimisho na mapendekezo<br />

shule na <strong>wa</strong>toaji huduma wengine k<strong>wa</strong> <strong>wa</strong>toto. K<strong>wa</strong> kufuata ulinganisho wetu <strong>wa</strong><br />

kulind<strong>wa</strong> k<strong>wa</strong> <strong>wa</strong>toto ndani <strong>ya</strong> sheria za <strong>Tanzania</strong> dhidi <strong>ya</strong> vi<strong>wa</strong>ngo vilivyowek<strong>wa</strong> na<br />

sheria <strong>ya</strong> kimataifa, tunapendekeza pia hatua zifuatazo zichukuliwe kuhakikisha ku<strong>wa</strong><br />

ku<strong>wa</strong>linda “<strong>wa</strong>toto” kama hakuna kikundi cha <strong>wa</strong>tu nchini <strong>Tanzania</strong> kinachotambuli<strong>wa</strong><br />

kama hivyo. Tafsiri <strong>ya</strong> maana kama hiyo inahitajika katika muundo <strong>wa</strong> sheria <strong>ya</strong><br />

kumpanga mtu <strong>wa</strong> jinsia yoyote kama mtoto mpaka umri ulioelez<strong>wa</strong> bila <strong>ya</strong> kujali<br />

hadhi <strong>ya</strong>ke <strong>ya</strong> ndoa.<br />

l Katika kutofautiana k<strong>wa</strong> masharti <strong>ya</strong>ke mengine sheria zinazoainish<strong>wa</strong> makosa na<br />

adhabu zake nchini <strong>Tanzania</strong> zinaruhusu kuole<strong>wa</strong> k<strong>wa</strong> msichana mwenye umri <strong>wa</strong> chini<br />

<strong>ya</strong> miaka 12, i<strong>wa</strong>po ndoa hiyo haikusudiwi ku<strong>wa</strong> timilifu k<strong>wa</strong> ngono kabla <strong>ya</strong> umri <strong>wa</strong><br />

miaka 12. Umri huu uko chini sana <strong>ya</strong> umri <strong>wa</strong> <strong>wa</strong>stani <strong>wa</strong> kimataifa k<strong>wa</strong> ndoa halali<br />

na husababisha matatizo mengi makub<strong>wa</strong>. K<strong>wa</strong>nza, si rahisi k<strong>wa</strong> msichana <strong>wa</strong> chini <strong>ya</strong><br />

umri <strong>wa</strong> miaka 15 ku<strong>wa</strong> na uhuru <strong>wa</strong> uchaguzi au kutakakomwezesha kufan<strong>ya</strong> uamuzi<br />

<strong>wa</strong> aina hiyo peke <strong>ya</strong>ke. Hii inapingana na sharti la katiba <strong>ya</strong> Jamhuri <strong>ya</strong> Muungano <strong>wa</strong><br />

<strong>Tanzania</strong> linalo<strong>wa</strong>pa <strong>wa</strong>toto haki <strong>ya</strong> maisha huru. Pili, sheria zinazoainisha makosa na<br />

adhabu zake zinategemea sana kuacha kufan<strong>ya</strong> ngono k<strong>wa</strong> pande zote zinazohusika,<br />

pale ambapo msichana (ambaye mara nyingi ataku<strong>wa</strong> na mwenza mwenye umri<br />

mkub<strong>wa</strong> zaidi) ataku<strong>wa</strong> mdogo mno, rahisi kuathirika na asiyejua chochote kuweza<br />

kufan<strong>ya</strong> ngono. Sheria hizo zinaelekea kupingana moja k<strong>wa</strong> moja na ibara <strong>ya</strong> 34 <strong>ya</strong><br />

CRC inayosema ku<strong>wa</strong> “Serikali hazina budi [………..] kuchukua hatua zote muhimu<br />

kuzuia [……] kushawishi au kushurutisha <strong>wa</strong>toto kujihusisha na ngono haramu”. Tatu,<br />

hata kama m<strong>wa</strong>nandoa ataacha kujihusisha na ngono mpaka msichana afikishe umri <strong>wa</strong><br />

miaka 12, umri huo bado unaonekana kimataifa ku<strong>wa</strong> uko chini <strong>ya</strong> umri <strong>wa</strong> kukua v<strong>ya</strong><br />

kutosha kimwili na kihisia, k<strong>wa</strong> uhusiano <strong>wa</strong> kingono na ku<strong>wa</strong> mama mtaraji<strong>wa</strong>. Ili<br />

ku<strong>wa</strong>linda <strong>wa</strong>toto, serikali inahitaji kuongeza umri <strong>wa</strong> ridhaa <strong>ya</strong> ndoa hadi angalau<br />

miaka 16, kusimamia na kuhimiza kukubaliana na sharti hili, na ku<strong>wa</strong>elimisha<br />

<strong>wa</strong>sichana na <strong>wa</strong>vulana kuanzia umri ndogo kuhusu ngono, ujauzito na ndoa. Umri <strong>wa</strong><br />

ridhaa <strong>ya</strong> ndoa na kufan<strong>ya</strong> ngono lazima uwianishwe k<strong>wa</strong> jinsia zote ili ku<strong>wa</strong> na sheria<br />

moja inayoeleweka k<strong>wa</strong> kila mmoja ili kuhimiza kusudio la ibara <strong>ya</strong> 34 <strong>ya</strong> CRC.<br />

l Picha za uchi k<strong>wa</strong> <strong>wa</strong>toto zinakataz<strong>wa</strong> chini <strong>ya</strong> SOSPA, lakini kosa halina budi<br />

<strong>wa</strong> “kutumia hatua zote zinazofaa ili kuhakikisha k<strong>wa</strong>mba <strong>wa</strong>toto <strong>wa</strong>nalind<strong>wa</strong> dhidi <strong>ya</strong><br />

aina zote za […..] un<strong>ya</strong>n<strong>ya</strong>saji au majeraha kimwili”, na katika ibara <strong>ya</strong> 24, kuhakikisha<br />

ku<strong>wa</strong> <strong>wa</strong>toto <strong>wa</strong>napata ki<strong>wa</strong>ngo cha juu kinachopatikana cha af<strong>ya</strong>. Adhabu <strong>ya</strong> viboko<br />

k<strong>wa</strong> <strong>wa</strong>toto ni halali katika taasisi za umma na binafsi nchini <strong>Tanzania</strong>. Hii itaku<strong>wa</strong><br />

uvunjaji <strong>wa</strong> ibara <strong>ya</strong> 19 <strong>ya</strong> CRC kutegemea imetumi<strong>wa</strong> k<strong>wa</strong> ki<strong>wa</strong>ngo gani, na<br />

haikubaliani na vi<strong>wa</strong>ngo v<strong>ya</strong> kimataifa. Tunapendekeza k<strong>wa</strong> nguvu zote kupig<strong>wa</strong><br />

marufuku k<strong>wa</strong> adhabu <strong>ya</strong> viboko kama hatua <strong>ya</strong> kuleta nidhamu shuleni, magereza <strong>ya</strong><br />

<strong>wa</strong>toto <strong>wa</strong>tukutu, mfumo <strong>wa</strong> haki k<strong>wa</strong> <strong>wa</strong>toto (mfano <strong>wa</strong> mahakama k<strong>wa</strong> <strong>wa</strong>toto), na<br />

vituo vingine vinavyoshughulikia <strong>wa</strong>toto.<br />

l Tunaamini k<strong>wa</strong>mba <strong>Tanzania</strong> haina budi kutimiza na kuheshimu kanuni za ubinadamu<br />

zilizohifadhi<strong>wa</strong> na kulind<strong>wa</strong> katika sheria za kitaifa na kimataifa ili <strong>wa</strong>toto na vijana<br />

<strong>wa</strong>naohusika/<strong>wa</strong>naopingana na sheria <strong>wa</strong>nalind<strong>wa</strong>. Hatua mahususi zinazotaki<strong>wa</strong><br />

kuchukuli<strong>wa</strong> ni pamoja na kutumia (k<strong>wa</strong> usahihi na k<strong>wa</strong> haki) masharti <strong>ya</strong> sheria<br />

<strong>ya</strong>nayotumika na kutekeleza (kama vile, masharti <strong>ya</strong>liyotaj<strong>wa</strong> katika kifungu cha 12, 14,<br />

15, 21 na 32 v<strong>ya</strong> CRC k<strong>wa</strong> kukamat<strong>wa</strong> bila hati) na kutoa “tahadhari <strong>ya</strong> polisi” au<br />

“mikataba <strong>ya</strong> mwenendo” k<strong>wa</strong> <strong>wa</strong>toto <strong>wa</strong>naopingana na sheria.<br />

l Kama suala la kupe<strong>wa</strong> kipaumbele, sheria za <strong>Tanzania</strong> hazina budi kupiti<strong>wa</strong> up<strong>ya</strong>,<br />

kuhuish<strong>wa</strong> na kurekebish<strong>wa</strong> ili mfumo <strong>wa</strong> kisheria unaomjali mtoto unaku<strong>wa</strong>po. Mikakati<br />

itakayotumika ni pamoja na kupitia na kurekebisha sheria, sera na mikakati <strong>ya</strong> taifa k<strong>wa</strong><br />

maslahi zaidi <strong>ya</strong> <strong>wa</strong>toto, hasa sheria ki<strong>wa</strong>ngo cha chini cha adhabu, sheria za <strong>wa</strong>toto na<br />

vijana, sheria <strong>ya</strong> kumtia mtu kizuizini, sheria zinazoainisha makosa na adhabu zake na<br />

CPA. Serikali <strong>ya</strong> <strong>Tanzania</strong> hasa inataki<strong>wa</strong> kuzifasiri sheria za kimataifa katika sheria za<br />

nchi, ili maslahi <strong>ya</strong> mtoto <strong>ya</strong>pewe umuhimu mkub<strong>wa</strong>. <strong>Tanzania</strong> haina budi ku<strong>wa</strong>silisha<br />

sheria <strong>ya</strong> <strong>wa</strong>toto Bungeni na ndani <strong>ya</strong> sheria hii mp<strong>ya</strong> mashirika yote <strong>ya</strong>nayoshughulikia<br />

<strong>wa</strong>toto, iwe shule, polisi, ustawi <strong>wa</strong> jamii, au vituo v<strong>ya</strong> malezi/matunzo, vi<strong>wa</strong>jibishwe<br />

kisheria ku<strong>wa</strong> na taratibu za kumlinda mtoto zinazoeleweka.<br />

K<strong>wa</strong> ujumla, TEN/MET inaamini k<strong>wa</strong>mba <strong>wa</strong>toto <strong>wa</strong> <strong>Tanzania</strong> <strong>wa</strong>nastahili sera na kanuni<br />

zinazojali zaidi kero zao ili vizazi vijavyo v<strong>ya</strong> <strong>wa</strong>toto <strong>wa</strong> <strong>Tanzania</strong> vitaweza kutende<strong>wa</strong><br />

haki, k<strong>wa</strong> hadhi na heshima.<br />

Mifumo <strong>ya</strong> kumlinda mtoto haina budi kupiti<strong>wa</strong> up<strong>ya</strong> na kuimarish<strong>wa</strong> ili ku<strong>wa</strong>wezesha<br />

<strong>wa</strong>toto <strong>wa</strong>athirika <strong>wa</strong> un<strong>ya</strong>n<strong>ya</strong>saji/ubakaji kupata haki, kupata msaada unaofaa na kubaki<br />

mahali pa usalama. AZISE na AZAKI lakini zijihusishe katika kazi kub<strong>wa</strong> <strong>ya</strong> kubuni na<br />

kupima njia mbadala/nyingine za kushughulikia vikundi vinavyoishi katika mazingira<br />

magumu.<br />

<strong>Tanzania</strong> haina budi kuhakikisha k<strong>wa</strong>mba <strong>wa</strong>dau wote muhimu katika mifumo <strong>ya</strong><br />

mahakama k<strong>wa</strong> <strong>wa</strong>toto na kumlinda mtoto (ikiwemo polisi, mahakama, serikali, <strong>wa</strong>limu,<br />

<strong>wa</strong>uguzi na <strong>wa</strong>tumishi wengine <strong>wa</strong> umma) <strong>wa</strong>naelimish<strong>wa</strong> kuhusu haki na <strong>wa</strong>jibu<br />

vilivyomo katika sheria za kitaifa na kimataifa na <strong>wa</strong>nafunz<strong>wa</strong> kuandaa mfano <strong>wa</strong><br />

utendaji <strong>wa</strong> mwenendo bora <strong>wa</strong>kati <strong>wa</strong> kushughulikia <strong>wa</strong>toto. Hii ni pamoja na kuandaa<br />

na kutoa mafunzo <strong>ya</strong>nayofaa kuhusu haki za mtoto na kumlinda mtoto na mahitaji <strong>ya</strong><br />

vijana <strong>wa</strong>naoishi katika mazingira magumu <strong>wa</strong>naohusika/<strong>wa</strong>naopingana na sheria.<br />

na matokeo <strong>ya</strong> un<strong>ya</strong>n<strong>ya</strong>saji k<strong>wa</strong> maendeleo <strong>ya</strong> mtoto.<br />
