inte förlovningen eller äktenskapet som tvingande<br />

förrä de utsätts för fysisk misshandel<br />

medan övertalningsförsök och en otrevlig atmosfär<br />

i hemmet för en annan person kan innebära<br />

att de känner sig tvingade till äktenskap. I<br />

”From the outset the Working Group has<br />

been very clear that it is a marriage conducted<br />

without the valid consent of both<br />

parties, where duress is a factor. It is a<br />

violation of internationally recognised human<br />

rights standards and cannot be<br />

justified on religious or cultural grounds.”<br />

”The Working Group has found that duress<br />

is invariably a factor of forced marriages.<br />

The Court of Appeal has ruled that<br />

the test for duress for these purposes is simply<br />

”whether the mind of the applicant (the<br />

victim) has in fact been overborne, howsoever<br />

that was caused.” (The Working<br />

”There is a spectrum of behaviours behind<br />

the term forced marriage, ranging from<br />

emotional pressure, exerted by close family<br />

members and the extended family, to the<br />

more extreme cases, which can involve<br />

threatening behaviour, abduction, imprisonment,<br />

physical violence, rape and in<br />

some cases murder. People spoke to the<br />

Working Group about ‘loving manipulation’<br />

in the majority of cases, where parents<br />

genuinely felt that they were acting in their<br />

children and family’s best interests.” (The<br />

distinction lies in the right to choose. In<br />

the tradition of arranged marriages, the<br />

families of both spouses take a leading role<br />

in arranging the marriage, but the choice<br />

whether to solemnise the arrangement<br />

remains with the spouses and can be<br />

exercised at any time. The spouses have the<br />

right to choose – to say no – at any time.<br />

In forced marriage, there is no choice.”<br />
