SCOPUL ACTIUNII:<br />
Intrucat organizatorilor le revin obliga<strong>ti</strong>i <strong>si</strong> responsabilita<strong>ti</strong> pentru cons<strong>ti</strong>en<strong>ti</strong>zarea consumatorilor privind<br />
deseurilor de echipamente electrice <strong>si</strong> electronice pre<strong>cu</strong>m <strong>si</strong> preluarea acestora de <strong>la</strong> magazine in <strong>si</strong>stem unu<br />
<strong>la</strong> unu ( 1:1 ) par<strong>ti</strong>le vor contribui <strong>la</strong> organizarea, desfasurarea <strong>si</strong> finantarea ac<strong>ti</strong>unilor pentru public din cadrul<br />
programului “Time To Go” ( abreviat TTG ), pentru informarea <strong>si</strong> educarea consumatorilor, pentru promovarea<br />
progresului tehnic <strong>si</strong> s<strong>ti</strong>mu<strong>la</strong>rea colectarii DEEE din gospodarii par<strong>ti</strong><strong>cu</strong><strong>la</strong>re.<br />
Programul “Time To Go” se adreseaza consumatorilor <strong>si</strong> are doua direc<strong>ti</strong>i de ac<strong>ti</strong>une:<br />
(a) Informarea publi<strong>cu</strong>lui <strong>si</strong> implicarea lui in problema<strong>ti</strong>ca actua<strong>la</strong> a preo<strong>cu</strong>parilor pentru reducerea eliminarilor de<br />
deseuri in natura, <strong>cu</strong> deosebire privind efectele nocive ale vechii a<strong>ti</strong>tudini <strong>la</strong> debarasarea de deseurile electrice,<br />
context in care progresele industriei in reproiectarea produselor <strong>si</strong> solu<strong>ti</strong>ile inova<strong>ti</strong>ve ce le fac mai usor<br />
recic<strong>la</strong>bile, sunt teme centrale.<br />
(b) Interac<strong>ti</strong>unea ac<strong>ti</strong>va <strong>cu</strong> publi<strong>cu</strong>l consumator, pentru a-l antrena in miscarea de inlo<strong>cu</strong>ire a vechilor aparate<br />
electrice din gospodaria sa, adesea mari consumatoare de energie, <strong>cu</strong> cele moderne, confortabile in<br />
exploatare <strong>si</strong> eficiente energe<strong>ti</strong>c, oferindu-i totodata solu<strong>ti</strong>i prac<strong>ti</strong>ce pentru degajarea celor vechi, ceea ce va<br />
s<strong>ti</strong>mu<strong>la</strong> <strong>si</strong> colectarea deseurilor electrice din gospodariile par<strong>ti</strong><strong>cu</strong><strong>la</strong>re<br />
3. PERIOADA DE DESFASURARE<br />
Cu incepere de <strong>la</strong> 01.11.2010 <strong>si</strong> pana <strong>la</strong> 30.11.2010<br />
4. ARIA DE DESFASURARE<br />
Ac<strong>ti</strong>unea se desfasoara <strong>la</strong> nivel na<strong>ti</strong>onal, in toate magazinele <strong>bauMax</strong> Romania care comercializeaza s<strong>cu</strong>le<br />
electrice conform listei produselor eligibile din tabelele de mai jos.<br />
5. DREPTUL DE PARTICIPARE<br />
Programul este adresat tuturor persoanelor fizice <strong>cu</strong> resedinta in Romania, care au implinit 18 ani pana <strong>la</strong> data<br />
de 01.11.2010.<br />
6. MECANISMUL PROGRAMULUI<br />
Pentru a par<strong>ti</strong>cipa <strong>la</strong> ac<strong>ti</strong>une<br />
a) <strong>si</strong> a achizi<strong>ti</strong>ona o s<strong>cu</strong><strong>la</strong> electrica <strong>noua</strong> din lista produselor eligibile, <strong>cu</strong>mparatorul trebuie sa predea o s<strong>cu</strong><strong>la</strong><br />
electrica portabi<strong>la</strong> <strong>veche</strong> mare* (<strong>veche</strong> mica* ) <strong>si</strong> completa (nedezmembrata) <strong>la</strong> unul din magazinele<br />
par<strong>ti</strong>cipante <strong>la</strong> program, <strong>si</strong>tua<strong>ti</strong>e in care el primeste <strong>la</strong> momentul <strong>cu</strong>mpararii beneficiul valoric aratat in <strong>ti</strong>chet (*)<br />
ori voucher.<br />

) <strong>si</strong> a achizi<strong>ti</strong>ona un compresor nou din lista produselor eligibile, <strong>cu</strong>mparatorul trebuie sa predea un deseu<br />
electric vechi mare** din categoria compresor electric mare, aparat aer condi<strong>ti</strong>onat, calorifer electric , deseu ce<br />
trebuie sa fie complet (nedezmembrat), <strong>la</strong> unul din magazinele par<strong>ti</strong>cipante <strong>la</strong> program, <strong>si</strong>tua<strong>ti</strong>e in care el<br />
primeste <strong>la</strong> momentul <strong>cu</strong>mpararii beneficiul valoric aratat in <strong>ti</strong>chet (*) ori voucher.<br />
Beneficiul se acorda <strong>la</strong> achizi<strong>ti</strong>onarea unui nou echipament din c<strong>la</strong>sa s<strong>cu</strong>le electrice/compresoare conform<br />
listei produselor eligibile atasata, el se acorda direct pe factura <strong>si</strong> se aplica <strong>la</strong> valoarea de raft a produsului.<br />
Tichetul/voucherul valoric in original este re<strong>ti</strong>nut <strong>la</strong> magazin odata <strong>cu</strong> p<strong>la</strong>ta facturii. La predarea echipamentului<br />
vechi se re<strong>ti</strong>ne <strong>cu</strong>ponul de predare (talonul detasabil), <strong>cu</strong> confirmarea primirii deseului in campul dedicat pe<br />
<strong>ti</strong>chet/voucher, iar <strong>cu</strong>mparatorul trebuie sa anunte vanzatorul inainte de intocmirea facturii ca are un <strong>ti</strong>chet<br />
valoric, pentru a-i fi dedus beneficiul <strong>cu</strong>venit.<br />
*) Prin s<strong>cu</strong><strong>la</strong> electrica portabi<strong>la</strong> <strong>veche</strong> ce poate fi adusa se intelege orice produs, func<strong>ti</strong>onand <strong>cu</strong> alimentare<br />
<strong>la</strong> <strong>cu</strong>rent electric sau <strong>cu</strong> a<strong>cu</strong>mu<strong>la</strong>tor de <strong>ti</strong>pul: ma<strong>si</strong>na de gaurit <strong>cu</strong> per<strong>cu</strong><strong>ti</strong>e, ciocan rotoper<strong>cu</strong>tor, surubelnita <strong>cu</strong><br />
a<strong>cu</strong>mu<strong>la</strong>tor, ferastrau ver<strong>ti</strong>cal/ cir<strong>cu</strong><strong>la</strong>r/ cir<strong>cu</strong><strong>la</strong>r sta<strong>ti</strong>onar/ coada de vulpe, polizor unghiu<strong>la</strong>r, rindea electrica,<br />
ma<strong>si</strong>na de frezat, slefuitor <strong>cu</strong> vibra<strong>ti</strong>i/ excentric/ banda/ mul<strong>ti</strong>func<strong>ti</strong>onal, capsator electric/ <strong>cu</strong> a<strong>cu</strong>mu<strong>la</strong>tor,<br />
foarfeca universa<strong>la</strong> <strong>cu</strong> a<strong>cu</strong>mu<strong>la</strong>tor, suf<strong>la</strong>nta <strong>cu</strong> aer cald, aspirator universal, ma<strong>si</strong>na de <strong>cu</strong>ratat <strong>cu</strong> inalta<br />
pre<strong>si</strong>une, ferastrau electric <strong>cu</strong> <strong>la</strong>nt. Produsele de gradinarit, accesoriile, gama auto, compresoarele marca<br />
B<strong>la</strong>ck&Decker <strong>si</strong> produsele af<strong>la</strong>te in promo<strong>ti</strong>e nu par<strong>ti</strong>cipa <strong>la</strong> aceasta promo<strong>ti</strong>e.<br />
**) In cazul achizitriei unui compresor nou din lista eligibi<strong>la</strong> de produse consumatorul va preda un deseu<br />
electric din categoria aparatelor mari, respec<strong>ti</strong>v compresor electric mare, aparat aer condi<strong>ti</strong>onat, calorifer<br />
electric.<br />
7. CONDITII DE VALIDITATE<br />
Pentru ca un par<strong>ti</strong>cipant sa fie con<strong>si</strong>derat valid, trebuie sa intruneasca concomitent urmatoarele condi<strong>ti</strong>i:<br />
� Sa indeplinesca condi<strong>ti</strong>ile de <strong>la</strong> Sec<strong>ti</strong>unea 5 a prezentelor Condi<strong>ti</strong>i;<br />
� Sa predea un echipament vechi in oricare din <strong>si</strong>tua<strong>ti</strong>ile men<strong>ti</strong>onate <strong>la</strong> punctul 6.<br />
� Sa achizi<strong>ti</strong>oneze in perioada ac<strong>ti</strong>unii un echipament din lista produselor eligibile, contra predarii unui DEEE.<br />
8. RESPONSABILITATE<br />
Organizatorii ac<strong>ti</strong>unii nu îşi asumă răspunderea pentru:<br />
- Tichete/vouchere nefolo<strong>si</strong>te pana <strong>la</strong> data de 30.11.2010 (ul<strong>ti</strong>ma zi din ac<strong>ti</strong>une).<br />
- Tichetele/vouchere distruse sau completate incorect sau incomplet.<br />
Dovada de predare a echipamentului vechi il reprezinta <strong>ti</strong>chetul/voucher, care trebuie sa fie corect completat,<br />
semnat <strong>si</strong> stampi<strong>la</strong>t de cei care fac preluarea produsului uzat, conform <strong>si</strong>tua<strong>ti</strong>ilor men<strong>ti</strong>onate <strong>la</strong> punctul 6.<br />
Predarea echipamentelor vechi de catre par<strong>ti</strong>cipan<strong>ti</strong> unor persoane neautorizate exonereaza Organizatorii de<br />
orice raspundere <strong>si</strong>/sau obliga<strong>ti</strong>e fata de par<strong>ti</strong>cipan<strong>ti</strong>i respec<strong>ti</strong>vi.<br />
Organizatorii nu vor fi responsabili de pierderea <strong>ti</strong>chetului/voucher, de instrainarea lui <strong>si</strong> de prezentarea unor<br />
copii, deteriorate sau fal<strong>si</strong>ficate <strong>si</strong> nici nu vor fi obliga<strong>ti</strong> sa acorde bonifica<strong>ti</strong>a pe baza unor astfel de <strong>ti</strong>chete ori<br />
voucehre, care nu intrunesc toate condi<strong>ti</strong>ile prevazute in aceste Condi<strong>ti</strong>i de par<strong>ti</strong>cipare pentru a fi validate.<br />
9. FORTA MAJORA<br />
Pentru scopul acestor Condi<strong>ti</strong>i de par<strong>ti</strong>cipare, forta majora inseamna orice eveniment care nu poate fi contro<strong>la</strong>t,<br />
remediat sau previzionat de catre Organizatori <strong>si</strong> a carui apari<strong>ti</strong>e pune pe aces<strong>ti</strong>a din urma in impo<strong>si</strong>bilitatea de<br />
a-<strong>si</strong> indeplini obliga<strong>ti</strong>ile asumate. In categoria acestor evenimente sunt incluse, fara a se limita <strong>la</strong> acestea:<br />
razboaie, incendii, inunda<strong>ti</strong>i, greve <strong>si</strong> blocade, <strong>cu</strong>tremure, alte catastrofe de orice fel, pre<strong>cu</strong>m <strong>si</strong> orice<br />
reglementare care poate aparea ulterior intrarii in vigoare a Condi<strong>ti</strong>ilor <strong>si</strong> care poate interzice/ modifica termenii<br />
acestora, etc.<br />
Daca o <strong>si</strong>tua<strong>ti</strong>e de forta majora, inclu<strong>si</strong>v impo<strong>si</strong>bilitatea Organizatorilor din mo<strong>ti</strong>ve independente de vointa lor,<br />
impiedica sau intarzie total sau par<strong>ti</strong>al exe<strong>cu</strong>tarea acestor Condi<strong>ti</strong>i <strong>si</strong> con<strong>ti</strong>nuarea ac<strong>ti</strong>unii, Organizatorii vor fi<br />
exonera<strong>ti</strong> de raspunderea privind indeplinirea obliga<strong>ti</strong>ilor lor pentru perioada in care aceasta indeplinire va fi<br />
impiedicata sau intarziata, conform art.1082 <strong>si</strong> 1083 C.civ. Organizatorii, daca invoca forta majora, sunt obliga<strong>ti</strong><br />

sa comunice par<strong>ti</strong>cipan<strong>ti</strong>lor <strong>cu</strong>mparatori, in termen de 5 zile de <strong>la</strong> apari<strong>ti</strong>a cazului de forta majora, existenta<br />
acesteia.<br />
10. LITIGII<br />
In cazul unor li<strong>ti</strong>gii aparute intre Organizatori <strong>si</strong> par<strong>ti</strong>cipan<strong>ti</strong>i <strong>cu</strong>mparatori, acestea vor fi solu<strong>ti</strong>onate pe cale<br />
amiabi<strong>la</strong>. Daca nu este po<strong>si</strong>bi<strong>la</strong> rezolvarea li<strong>ti</strong>giilor pe cale amiabi<strong>la</strong>, par<strong>ti</strong>le implicate vor inainta li<strong>ti</strong>giul spre<br />
solu<strong>ti</strong>onare instantelor competente romane.<br />
11. CLAUZE FINALE<br />
Prezentele Condi<strong>ti</strong>i de par<strong>ti</strong>cipare pentru <strong>cu</strong>mparatorii din ac<strong>ti</strong>unea TTG “<strong>Vino</strong> <strong>la</strong> <strong>bauMax</strong> <strong>si</strong> <strong>schimba</strong>-<strong>ti</strong><br />
<strong>unealta</strong> <strong>veche</strong> <strong>cu</strong> <strong>una</strong> <strong>noua</strong>!”, vor fi disponibile in magazinele par<strong>ti</strong>cipante <strong>la</strong> ac<strong>ti</strong>une.<br />
PROTECTIA DATELOR PERSONALE<br />
Prin înscrierea <strong>la</strong> promo<strong>ti</strong>a “<strong>Vino</strong> <strong>la</strong> <strong>bauMax</strong> <strong>si</strong> <strong>schimba</strong>-<strong>ti</strong> <strong>unealta</strong> <strong>veche</strong> <strong>cu</strong> <strong>una</strong> <strong>noua</strong>!”, par<strong>ti</strong>cipan<strong>ti</strong>i sunt<br />
de acord <strong>cu</strong> prevederile prezentului Regu<strong>la</strong>ment. Par<strong>ti</strong>cipan<strong>ti</strong>i trebuie sa-<strong>si</strong> dec<strong>la</strong>re datele personale, pentru a<br />
u<strong>ti</strong>liza voucherul <strong>si</strong> pentru a beneficia de reducere.<br />
Inscrierea <strong>la</strong> promo<strong>ti</strong>e reprezinta acordul expres al par<strong>ti</strong>cipan<strong>ti</strong>lor ca datele lor personale sa fie pastrate <strong>si</strong><br />
prelucrate de Asocia<strong>ti</strong>a RoRec inregistrata ca operator de date <strong>cu</strong> caracter personal in scopul de marke<strong>ti</strong>ng,<br />
rec<strong>la</strong>ma , publicitate <strong>si</strong> sta<strong>ti</strong>s<strong>ti</strong>ca, pre<strong>cu</strong>m <strong>si</strong> b<strong>una</strong> desfasurare a promoţiei “<strong>Vino</strong> <strong>la</strong> <strong>bauMax</strong> <strong>si</strong> <strong>schimba</strong>-<strong>ti</strong><br />
<strong>unealta</strong> <strong>veche</strong> <strong>cu</strong> <strong>una</strong> <strong>noua</strong>!”.<br />
Par<strong>ti</strong>cipan<strong>ti</strong>lor <strong>la</strong> campania promo<strong>ti</strong>ona<strong>la</strong> “<strong>Vino</strong> <strong>la</strong> <strong>bauMax</strong> <strong>si</strong> <strong>schimba</strong>-<strong>ti</strong> <strong>unealta</strong> <strong>veche</strong> <strong>cu</strong> <strong>una</strong> <strong>noua</strong>!” le<br />
sunt garantate drepturile prevazute de Legea nr. 677/2001 privind protec<strong>ti</strong>a persoanelor <strong>cu</strong> privire <strong>la</strong><br />
prelucrarea datelor <strong>cu</strong> caracter personal <strong>si</strong> libera cir<strong>cu</strong><strong>la</strong><strong>ti</strong>e a acestor date, in special urmatoarele drepturi:<br />
dreptul <strong>la</strong> informare, dreptul de acces <strong>la</strong> date, dreptul de interven<strong>ti</strong>e asupra datelor, dreptul de opozi<strong>ti</strong>e.Pentru<br />

departamentului PR <strong>si</strong> Comunicare. De asemenea, par<strong>ti</strong>cipantului ii este re<strong>cu</strong>nos<strong>cu</strong>t dreptul de a se adresa<br />
jus<strong>ti</strong>ţiei.<br />
