The Physical Prejudice
Abstract. The prejudice represents a condition in the absence of
which the civil liability cannot be conceived within the accelerated rhythm of
the development of nowadays society. Any modern attempt to classify
prejudices includes injuries caused to a natural person’s health and physical
or psychical integrity; the consequences usually being both pecuniary and
moral. The current Romanian Civil Code does not expressly regulate the
forms of the prejudices that can be compensated. However, the jurisprudence
and the literature on the matter have dwelt upon, at length, the notion of
physical prejudice and the variety of physical damages – loss of leisure,
esthetic prejudice, pretium doloris.
The new Civil Code regulates, in distinct texts, the material (economic)
compensation, subsequent to any injury, as well as that for the non-patrimonial
losses in case of damages caused to the physical integrity or health, for
reductions in a person’s possibilities of social and family life. This represents a
start, which beyond doubt, will ground a necessary theory of the physical
prejudice, especially from the perspective of compensating the victims.

Una din definiţiile consacrate prejudiciilor nepatrimoniale operează
diviziunea prejudicii cauzate personalităţii fizice, prejudicii cauzate
personalităţii afective şi prejudicii cauzate personalităţii sociale 1 .
