ABSTRACT8This work analyses changes occurred to the Brazilian superior educational system in theperiod from 1990 to 2006. It shows as being the basis to these recent changes the crisis thewelfare state has been through, which, in its turn, led to a reduction of the national statesparticipation in the public services financing, especially of the superior education. It examinesthe police orientations to this educational level designed by multilateral organisms (WorldBank and UNESCO) and compares them to the policies implemented in Brazil. To show howthese directives were applied in this country, this works studies recent legislation (1988Constitution, LDB and Regulatory Acts) emphasising aspects that helped and encouraged ahuge expansion to the private educational system verified from the second-half of the 1990´s,by using data from the Paraná State Census for the Superior Education it demonstratesregional impacts caused by changes in the federal legislation. In order to give some continuityto the study of the legislation related to the mass-privatisation in the Brazilian superioreducation system it analyses the "Decreto 5773" ("Decreto-Ponte", some sort of TransitionalAct) and the "Projeto de Lei da Reforma Universitária" (Project of University Reform Act),still to be voted by the National Congress. The exam of all documents and statistical datasevidences that in the last fifteem years the Brazilian superior educational system went trougha deeply process of institucional diversification, making larger the distance of a variety oftypes of academic organization in terms of quality, production of new kwowledge and socialcommitment.Key words: Superior education, Neoliberalism, Multilateral organisms, Legislation, Paraná,Decreto-ponte, University Reform.
I - INTRODUÇÃO9A educação superior 1 , em sentido amplo, tem sido objeto de inúmeros trabalhoscientíficos 2 na atualidade. A recorrência do tema justifica-se pelo enorme crescimento dessenível de ensino, mundialmente, em termos de demanda e investimentos. Nas últimas quatrodécadas, a educação superior no Brasil passou por duas fases de forte expansão. A primeiradelas coincidiu exatamente com o período militar. De 1964 a 1980, o número de matrículasnesse nível de ensino aumentou quase dez vezes.Contraditoriamente, no períodosubseqüente, de abertura política e redemocratização do país (1980-1995), o sistemaapresentou um crescimento meramente vegetativo. Em 1980, havia 882 instituições de ensinosuperior no país.Em 1995, apenas 12 instituições tinham se agregado ao sistema,contabilizando um modesto crescimento de 1.36% no período (MACEDO, 2005, p. 3).A segunda fase de forte expansão se iniciou a partir de 1996. Em apenas nove anos(1996-2004), segundo dados do Censo da Educação Superior 2004, outras 1091 novas escolasde nível superior foram criadas. O aumento do número de instituições desencadeou umaelevação do número de matrículas. De 1991 a 1996, o número de matrículas em instituiçõespúblicas e privadas havia crescido 21.4 e 18.1%, respectivamente.De 1996 a 2004, ocrescimento desse indicador, na mesma ordem, chegou a 60.2 e 163.5%. Ou seja, o ano de1996 inaugurou uma nova fase da história da educação superior no Brasil. A partir desse ano,o sistema privado começou a se expandir numa velocidade inédita. No gráfico número um1 Segundo DIAS SOBRINHO (2003, p. 99), “educação superior é uma expressão de conteúdo um tanto elásticoque engloba um subsistema posterior ao nível médio e que comporta um leque de instituições educacionais,diferenciadas quanto à natureza jurídica, mantenedoras, qualidade, história, tamanho, áreas de atuação, vocação,função, etc”. Na classificação do Ministério da Educação (fonte: www.mec.gov.br), fazem parte dessesubsistema os cursos de graduação (bacharelado, licenciatura e tecnólogo), os cursos seqüenciais (de formaçãoespecífica e de complementação), os cursos de pós-graduação Lato Sensu (Especialização, MBA e ResidênciaMédica) e os cursos de pós-graduação Strictu Sensu (Mestrado, Doutorado e Pós-doutorado).
