Zoraide Sabaini dos Santos Amaro RAZOÁVEL DURAÇÃO DO PROCESSO - DEMORA NA PRESTAÇÃO JURISDICIONAL – IMPLICAÇÕES À VIOLAÇÃO AOS PRINCÍPIOS CONSTITUCIONAIS Zoraide Sabaini dos Santos Amaro* RESUMO O acesso à justiça é o tema em voga nos dias atuais. Não apenas por sua estreita relação com a viabilidade política de um Estado Democrático de Direito, mas porque a jurisdição é de uma parte direito fundamental do cidadão, e de outra dever do Estado. O Estado concentrou a função de exercer a tutela jurisdicional e fazer realizar justiça, cabe a este prestá-la de maneira propícia, eficiente e célere a satisfazer os jurisdicionados que lhe confiaram este serviço. Na ocorrência de lesão ao bem jurídico, decorrente da demora na prestação jurisdicional do Estado, manda o direito ou a eqüidade que pela injustificável demora se não deixe o lesado ao desamparo de sua própria sorte. REASONABLE DURATION OF LAWSUITS - DELAY IN THE JURISDICTIONAL ASSISTANCE - IMPLICATIONS TO THE VIOLATION OF CONSTITUTIONAL PRINCIPLES ABSTRACT 113 Access to justice is the theme in vogue nowadays, not only due to its strict relationship with the political viability of a Democratic State of Law, but because the jurisdiction is on one hand a fundamental right of the citizen, and on another hand, a duty of the State. The State has concentrated the function of exercising jurisdictional tutelage and enforcing the realization of justice; it is the State’s duty to render it in an appropriate, efficient and swift manner, so that it satisfies those under the jurisdiction who entrusted the State with this service. In the occurrence of damage to the legally protected interest, resulting from the delay in jurisdictional assistance from the State, the law or equity states that by the unjustifiable delay the damaged party not be left to the abandonment of his own luck. Reasonability. 1 INTRODUÇÃO O tema, relativo à “razoável duração do processo”, constitui um universo que se reconhece polêmico, não só por descobrir a razoabilidade do tempo, como também a sua significação dentro do sistema de princípios constitucionais. O acesso à justiça é, sem dúvida, o tema mais em voga nos dias atuais, não apenas por sua estreita relação com a viabilidade política de um Estado Democrático de Direito, mas principalmente porque a jurisdição é, então, de uma parte direito fundamental do cidadão, e de outra dever do Estado. * AMARO, Zoraide Sabaini dos Santos.
