POLIARQUIAS E A (IN)EFETIVIDADE DA LEI NA AMÉRICA LATINA ticas, ou o são de modo muito incompleto, se vistas do ângulo do princípio da lei e do Estado legal; de casos que são normalmente chamados "democracias liberais" mas são escassamente liberais; de regimes que são poliárquicos no nível nacional mas às vezes não o são no nível subnacional; e de uma democracia que faz parte tanto da face legal do Estado como do regime. Além de meus parcos talentos literários, a razão para esse estranhamento é que nosso vocabulário foi moldado por um escopo teórico restrito resultante dos pressupostos implícitos mencionados no início do texto e discutidos ao longo dele. Apesar dessas deficiências, espero ter mostrado que os temas do Estado, especialmente o Estado legal, e da efetiva ampliação da cidadania civil e da accountability sob o princípio da lei devem ser vistos tanto como uma parte central da problématique da democracia quanto como o estudo de seu regime (poliárquico). Creio que é nesse contexto que alguns aspectos políticos dos ricos, fascinantes e com freqüência justificadamente melancólicos capítulos deste volume 76 devem ser interpretados. A maioria dos países latino-americanos aos quais esses capítulos se referem são poliarquias. Ter alcançado essa condição é, na verdade, um progresso extremamente importante em relação à extrema arbitrariedade e violência dos sistemas autoritários que, na maioria dos casos, precedeu essas poliarquias. Nesse sentido específico, centrado no regime, não partilho a relutância de alguns de nossos autores em chamar esses casos de "democracias", embora eu prefira nomeá-los poliarquias, ou democracias políticas. Por outro lado, como esses mesmos autores deixam muito claro, a obtenção de uma democracia mais plena que inclua o governo democrático da lei é uma realização urgente e, nas circunstâncias detalhadas neste volume, distante. O fato de que as lutas visando essa meta podem se basear, como devem, nas liberdades políticas da poliarquia assinala o potencial desse tipo de regime, ainda que prejudicado por uma cidadania truncada e uma accountability fraca.
