direito material, com base em títulos diferentes, inadmitida pela exegese do art. 573,
do CPC, salvo na hipótese de devedor insolvente.

Abstract
The Author analyses active and passive legitimacy in executive actions, the
hypotheses of supervening legitimacy and the many possibilities of accumulation.
He points out the viability of subjective and objective accumulation in the same
action. The aims of the article is to inquire the possibility of subjective active
accumulation, and to identify the hypotheses in which it is appropriate, and the
cases in which coalition is shaped. Coalition means bringing together, in a single
execution, different creditors in the material right, on the basis of different titles.
Coalition is not accepted according to the exegesis of art. 573, of the Procedural
Civil Code, except in the event of insolvent debtor.

Resumen
El autor analiza la legitimación activa y pasiva en acciones ejecutivas, las hipótesis
de legitimación superveniente y las distintas posibilidades de comulación, poniendo
en relieve la viabilidad de en una misma acción, verificarse la legitimación objetiva
y subjetiva. El escobo del artículo es investigar la posibilidad de comulación
subjetiva activa e identificar las hipótesis en que esta sea apropiada así como los
casos en que se delinea la coalición. Coalición significa la reunión, en una única
acción, de diferentes acreedores en derecho material, con base en los diferentes
títulos. Esto n es aceptado según la exégesis del Art. 573 el Código Civil, excepto en
el caso de deudor insolvente.
