ABSTRACT<br />
This paper addressed the court medical expert in gastroenterology and<br />
hepatology in the actions pension, when it assesses the ability or inability of the<br />
insured labor, determining their rights to claim benefits or not. The issue of<br />
research was: What is the contribution of medical expertise in judicial gastrohepatology<br />
in the granting of benefits? The general objective was to conduct a<br />
survey of the numbers of Expertise in gastroenterology and hepatology held in<br />
Special Federal Court of Sorocaba, for pension purposes. The specific<br />
objectives were: to analyze the number of expertise in gastroenterology and<br />
hepatology in the Federal Court of Special Sorocaba, for pension purposes in<br />
the period 2005 to 2008 and describe the work of the court expert specialist in<br />
gastroenterology and hepatology in the actions which have the object the<br />
granting of benefits. The methodology used for its development and rationale<br />
was the retrospective study and review by the removal of cases relating to the<br />
subject. It was concluded that conditions in gastro-hepatology are secondary<br />
causes of refusal of benefits and that most of the administrative differences that<br />
lead to the insured Federal Court litigation are mainly related to the divergence<br />
of the beginning of the disability or the onset of the disease.<br />
