with the UNHCR Guidelines on Refugee Childr<strong>en</strong>. The guidelines recognize that<br />
childr<strong>en</strong> are <strong>en</strong>titled to special care and protection and specifically state that childr<strong>en</strong><br />
seeking asylum should not be kept in det<strong>en</strong>tion. The guidelines address the following<br />
issues: access to the territory for childr<strong>en</strong> asylum seekers; id<strong>en</strong>tification and initial<br />
action; access to asylum procedures; interim care and protection of childr<strong>en</strong> seeking<br />
asylum; refugee status determination; id<strong>en</strong>tification and implem<strong>en</strong>tation of durable<br />
solutions; and cooperation and coordination betwe<strong>en</strong> ag<strong>en</strong>cies.<br />
• UNHCR Guidelines on Applicable Criteria and Standards relating to the<br />
Det<strong>en</strong>tion of Asylum Seekers: These guidelines are the primary non-binding<br />
instrum<strong>en</strong>t governing det<strong>en</strong>tion of asylum seekers. According to the UNHCR,<br />
det<strong>en</strong>tion of asylum seekers is inher<strong>en</strong>tly undesirable, especially in vulnerable cases,<br />
such as those involving childr<strong>en</strong>, disabled people, the elderly, pregnant wom<strong>en</strong> and<br />
other persons with special needs. Asylum seekers should not be detained except under<br />
the following circumstances: to verify id<strong>en</strong>tity; to determine the elem<strong>en</strong>ts on which<br />
the claim for refugee status or asylum is based; in cases where asylum seekers have<br />
destroyed docum<strong>en</strong>ts or used false docum<strong>en</strong>ts to mislead authorities; or to protect<br />
national security and public order. Regarding verification of id<strong>en</strong>tity, this refers to<br />
cases where id<strong>en</strong>tity may be undetermined or in dispute. The exception relating to<br />
determining the elem<strong>en</strong>ts upon which a claim is based refers to an initial interview to<br />
confirm that the person needs protection. It does not refer to the full interview to<br />
determine the merits of a claim. The exception relating to false docum<strong>en</strong>ts is applied<br />
wh<strong>en</strong> the applicant has an int<strong>en</strong>t to mislead authorities. Asylum seekers who are<br />
unable to obtain docum<strong>en</strong>ts prior to leaving their country of origin should not be<br />
detained solely for that reason. Regarding the public security exception, this relates to<br />
cases where there is evid<strong>en</strong>ce to show that the asylum seeker has a criminal<br />
background or affiliations which pose a risk to public order or national security. The<br />
guidelines stress that det<strong>en</strong>tion cannot be used to deter the <strong>en</strong>trance of future asylum<br />
seekers. The UNHCR urges governm<strong>en</strong>ts to use alternatives to det<strong>en</strong>tion first before<br />
taking a decision to detain. These alternatives can include the following: a<br />
monitoring or reporting requirem<strong>en</strong>t; the provision of a guarantor; release on bond; or<br />
accommodation in op<strong>en</strong> c<strong>en</strong>tres. In addition to addressing the presumption against<br />
det<strong>en</strong>tion, exceptions to this presumption and alternatives, the guidelines address the<br />
following issues: procedural safeguards; det<strong>en</strong>tion of persons under the age of 18<br />
years; det<strong>en</strong>tion of vulnerable persons; det<strong>en</strong>tion of wom<strong>en</strong>; and conditions of<br />
det<strong>en</strong>tion.<br />
