This proposed new holistic approach to copyright clearing would then create a “onestop-shop” for clearance of all content exploitation forms (fixed, mobile, online, cable, DTT, etc) both on the horizontal (i.e. multi-territory) and vertical (i.e. one negotiation partner only) level.” 124 6.13. Cable Europe is ook voorstander van een eengemaakt communautair auteursrecht. Zij beroept zich onder meer op een studie van IVIR: “At first blush, the potential advantages of a Community copyright are undeniable. A Community Copyright Regulation (or ‘European Copyright Law’) would immediately establish a truly unified legal framework. A Community copyright would have instant Community-wide effect, thereby creating a single market for copyrights and related rights, both online and offline. A Community copyright would enhance legal security and transparency, for right owners and users alike, and greatly reduce transaction costs. Unification by regulation could also restore the asymmetry that is inherent in the current acquis, which mandates basic economic rights, but merely permits limitations. A regulation would give rights and limitations equal status, and could restore the necessary ‘delicate balance’, provided it were the product of a transparent legislative process wherein all interests concerned are fairly represented.” 125 E. Rechthebbenden 6.14. International Federation of Film Distributors Associations (FIAD) – International Federation of Film Producers Associations (FIAPF) – Independent Film & Television Alliance (IFTA) – International Video Federation (IVF) 126 FIAD onderlijnt dat auteursrechten niet louter een vergoedingssysteem zijn voor rechthebbenden, maar ook een cruciaal strategisch instrument om zich te verzekeren van financiering en de exploitatie van werken door het verlenen van licenties aan commerciële gebruikers (film en video distributeurs, omroepen, online platformen enz.). Wat betreft het idee van een communautair auteursrecht, stelt FIAD dat “introducing a new Regulation on a “Community copyright title” alongside national titles would add an unnecessary layer of complexity. “Mandating a single clearance framework for the whole of Europe will not create a pan-European market or audience for European films: the audience must be attracted to films by topic, language, timing and mode of distribution, all items which are the subject of the special expertise of the producer and the various distributors. (...) All parties are best served by arms-length commercial negotiations based on the principle of contractual freedom and the exclusive rights established and protected by copyright law.” 127 6.15. European Federation of Joint Management Societies of Producers for Private Audiovisual Copying (Eurocopya) 128 “As the simultaneous & unabridged retransmission of TV programmes, initially limited to cable, has gradually spread to other types of networks (satellite, ADSL, mobile, etc..), one could envisage a possible extension of these provisions along a principle of technological neutrality (i.e. align other networks on the regime applicable to cable networks). As a matter of fact, such extension is already well underway in some Member States, through voluntary collective management agreements that could here be consolidated. Furthermore, some online services are also acts of simultaneous and unaltered retransmission of pre-existing TV programmes”. Om die reden zou het volgens Eurocopya gepast zijn om de bepalingen van artikel 9 Satcab van toepassing te verklaren op alle vormen van gelijktijdige en ongewijzigde doorgifte aan het publiek door gelijk welke operator die niet de originele uitzender of omroep is: operatoren van kabel, satelliet, mobiele telefoon, IPTV enz. Deze bepaling zou aldus de gelijktijdige en ongewijzigde doorgifte van televisieprogramma’s via het Internet dekken door om het even welke derde partij (operator) die deze verdeelt naar zijn abonnees. Deze operator zou dan onderworpen zijn aan een systeem van collectief beheer van rechten om doorgifte toe te staan of te verbieden. Dit zou individuele rechthebbenden niet verhinderen om individueel de uitzending van hun werken toe te laten (in overeenkomsten met de omroep zelf), of om – via hun collectieve beheersvereniging – zulke doorgifte te weigeren in gevallen waar deze in conflict zijn met de politiek van individueel rechtenbeheer en/of vooraf bestaande exploitatievormen van de doorgegeven programma’s. Eurocopya vraagt zich af of een Interpretatieve Mededeling van de Europese Commissie met betrekking tot Hoofdstuk II van Satcab niet zou kunnen volstaan om het actuele kader op korte tijd te moderniseren. 6.16. Om die re<strong>de</strong>n zou het volgens Eurocopya gepast zijn om <strong>de</strong> bepalingen van artikel 9<br />

(operator) die <strong>de</strong>ze ver<strong>de</strong>elt naar zijn abonnees. <strong>De</strong>ze operator zou dan on<strong>de</strong>rworpen<br />
zijn aan een systeem van collectief beheer van rechten om doorgifte toe te staan of te<br />
verbie<strong>de</strong>n. Dit zou individuele rechthebben<strong>de</strong>n niet verhin<strong>de</strong>ren om individueel <strong>de</strong><br />
uitzending van hun werken toe te laten (in overeenkomsten met <strong>de</strong> omroep zelf), of<br />
om – via hun collectieve beheersvereniging – zulke doorgifte te weigeren in gevallen<br />
waar <strong>de</strong>ze in conflict zijn met <strong>de</strong> politiek van individueel rechtenbeheer en/of <strong>voor</strong>af<br />
bestaan<strong>de</strong> exploitatievormen van <strong>de</strong> doorgegeven programma’s.<br />
