6.10. Ook ACT on<strong>de</strong>rlijnt dat het niet re<strong>de</strong>lijk is dat een operator een business case maakt<br />

door gebruik te maken van inhoud die zij gratis verkrijgt of waarover niet direct met <strong>de</strong><br />

omroep wordt on<strong>de</strong>rhan<strong>de</strong>ld: “the fact that a channel can be received via a terrestrial<br />

signal does not automatically mean that it should be freely available on other<br />

distribution networks such as encrypted DTT, cable and IPTV. In these networks<br />

there is a third party operator involved who benefits commercially by charging a<br />

subscription fee to its end users or who may sell other services such as telephony,<br />

broadband or other television services. It is not reasonable that an operator should be<br />

able to build a business using content that it obtains from broadcasters for free or with<br />

a fee that is not negotiated directly with the broadcaster or its agent.” 122<br />

D. Kabelmaatschappijen: Cable Europe 123<br />

6.11. Voor Cable Europe is een kritiek punt in het actuele systeem <strong>de</strong> inconsistente<br />

toepassing van Satcab op verschillen<strong>de</strong> distributie technologieën: “while satellite<br />

TV/direct-to-home, terrestrial TV and mobile TV are <strong>de</strong>emed direct communication to<br />

the public – for which all copyrights are cleared between CRMOs/producers and<br />

broadcasters-, cable TV- and internet-based IP TV are <strong>de</strong>emed secondary<br />

communication to the public and hence re-transmission – which require separate<br />

copyrights clearance. The activity of simulcasting of radio and television programmes<br />

over the Internet is also unclear. The regulatory differentiation between distribution<br />

platforms stems from the traditional analogue TV world in which satellite operators did<br />

not have a direct customer relationship. In today’s world, this differentiation is no<br />

longer valid”.<br />

6.12. Cable Europe staat achter het <strong>voor</strong>stel van <strong>de</strong> Europese Commissie om het<br />

toepassingsgebied van Satcab uit te brei<strong>de</strong>n naar online levering van audiovisuele<br />

inhoud, parallel met het toepassingsgebied van <strong>de</strong> Richtlijn Audiovisuele <strong>Media</strong>. Dit<br />

<strong>de</strong>nkproces moet echter zo ver mogelijk doorgetrokken wor<strong>de</strong>n tenein<strong>de</strong> te vermij<strong>de</strong>n<br />

dat an<strong>de</strong>re exploitatievormen (mobiel, vast, kabel, DTT enz.) uitgesloten zou<strong>de</strong>n zijn<br />

van het toepassingsgebied. <strong>De</strong> herziening van Satcab moet op een technologie<br />

neutrale basis gebeuren <strong>voor</strong> zowel uitzendactiviteiten als doorgifte activiteiten.<br />

Cable Europe ijvert daarnaast <strong>voor</strong> een erkenning van <strong>de</strong> ARI overeenkomsten en<br />

het invoeren van het principe van <strong>de</strong> “one stop shop”: “Furthermore, Cable Europe<br />

believes that the system of collective management of rights should be recognized as<br />

having the same weight as ‘all rights inclu<strong>de</strong>d packages’ (ARI) provi<strong>de</strong>d by<br />

broadcasters who wish to do so to cable operators, as this would increase the overall<br />

efficiency of the rights clearance system. Broadcasters should in<strong>de</strong>ed be able to offer<br />

these cleared packages legally, as inten<strong>de</strong>d by art.10 Satcab.<br />
