accountability in the new order, with a democratically elected<br />

government embarking on major restructuring of the South African<br />

“In the past four years, however, there have been signs that this tide<br />

might be turning. This has come at a time when political events have<br />

made constitutional negotiations the centre of attention, further<br />

emphasising the urgency of the need for a viable system of both<br />

empowerment and accountability of a future South African executive.” 203<br />

Gedurende hier<strong>die</strong> tydperk het ʼn vloedgolf <strong>van</strong> artikels, handboeke en<br />

regsartikels verskyn, wat ʼn welkome uitbreiding <strong>van</strong> <strong>die</strong> administratiefregtelike<br />

literatuur was. 204<br />

Die aanloop tot <strong>die</strong> Grondwetmakende proses in Suid-Afrika, wat inter alia<br />

uitgeloop het op <strong>die</strong> administratiewe geregtigheidsklousule, sal onvolledig<br />

wees as daar nie na Artikel 18 <strong>van</strong> <strong>die</strong> Namibiese Grondwet verwys word<br />

nie. 205<br />

Die Namibiese Grondwet se Handves <strong>van</strong> Menseregte poog om <strong>die</strong> individu<br />

se regte tot “administratiewe geregtigheid” bykomend tot <strong>die</strong> gewone basiese<br />

of fundamentele burgerlike, politieke, kulturele, sosiale en ekonomiese regte<br />

te beskerm. Artikel 18, getiteld “Administrative Justice”, lees soos volg :<br />

“Administrative bo<strong>die</strong>s and administrative officials shall act fairly and<br />

reasonably and comply with the requirements imposed upon such<br />

bo<strong>die</strong>s and officials by common law and any rele<strong>van</strong>t legislation and<br />

persons aggrieved by the exercise of such acts and decisions that have<br />

the right to seek redress before a competent Court or Tribunal.”<br />

Artikel 18 <strong>van</strong> <strong>die</strong> Namibiese Grondwet verseker ʼn vaste fondament vir <strong>die</strong><br />

ontwikkeling <strong>van</strong> administratiewe geregtigheid. Dit <strong>die</strong>n ook as katalisator vir<br />

<strong>die</strong> ontwikkeling <strong>van</strong> demokratiese beginsels en gedrag, omdat ʼn individu se<br />

regte tot regterlike hersiening en buite-geregtelike beregting <strong>van</strong><br />

administratiewe handelinge deur Artikel 18 beskerm word.<br />

Die voorwaardes en begrippe wat in Artikel 18 gebruik word, lig <strong>die</strong> betekenis<br />

<strong>van</strong> sekere administratiefregtelike beginsels uit en benadruk sekere<br />

hoofaspekte <strong>van</strong> <strong>die</strong> regshersieningsbeginsels <strong>van</strong> administratiewe optrede<br />
