In Pharmaceutical Manufactures Association of South Africa : In Re : Ex parte President of<br />

the Republic of South Africa 2000 (3) BCLR241(KH) het <strong>die</strong> appellant gesteun op<br />

bogemelde beslissing en aangevoer dat ʼn gedingvoerder op <strong>die</strong> gemeenregtelike<br />

hersieningsgronde kan steun en dat <strong>die</strong> saak in daar<strong>die</strong> geval as ʼn gemeenregtelike saak<br />

behandel moet word en nie as ʼn grondwetlike saak nie. 944<br />

Hoofregter Chaskalson het nie <strong>die</strong> appellante se betoog aanvaar dat <strong>die</strong> gemenereg ʼn<br />

korpus <strong>van</strong> regsreëls is, wat afsonderlik en onderskeie <strong>van</strong> <strong>die</strong> Grondwet bestaan nie.<br />

Hy merk soos volg op:<br />

“There are not two systems of law, each dealing with the same subject matter, each<br />

having similar requirements, each operating in its own field with its own highest court.<br />

There is only one system of law. It is shaped by the Constitution which is the supreme<br />

law, and all law, including the common law, derives its force from the Constitution and<br />

is subject to constitutional control.” 945<br />

Wat is <strong>die</strong> uitwerking <strong>van</strong> hier<strong>die</strong> uitspraak? Dit beteken dat konstitusionalisme verskuif<br />

het <strong>van</strong> <strong>die</strong> sfeer <strong>van</strong> <strong>die</strong> gemenereg na <strong>die</strong> voorskrifte <strong>van</strong> <strong>die</strong> skriftelike grondwet.<br />

Hoofregter Chaskalson het gesê dat <strong>die</strong> beginsels <strong>van</strong> <strong>die</strong> gemenereg steeds wesenlik is<br />

vir <strong>die</strong> ontwikkeling <strong>van</strong> <strong>die</strong> publiekreg, omdat dit <strong>die</strong> inhoud <strong>van</strong> <strong>die</strong> administratiefreg en<br />

ander aspekte <strong>van</strong> <strong>die</strong> publiekreg beïnvloed en ook sal bydra tot <strong>die</strong> toekomstige<br />

ontwikkeling <strong>van</strong> <strong>die</strong> publiekreg. Die gemenereg vul <strong>die</strong> bepalings <strong>van</strong> <strong>die</strong> Grondwet aan,<br />

maar ontleen sy regskrag aan <strong>die</strong> Grondwet. Wanneer ʼn mens <strong>die</strong> gemenereg as ʼn<br />

regsbron gebruik om <strong>die</strong> grondwetlike bepalings aan te vul, moet jy altyd in gedagte hou<br />

dat ons gemenereg sterk beïnvloed is deur <strong>die</strong> tradisie <strong>van</strong> parlementêre soewereiniteit.<br />

As ʼn mens dus <strong>die</strong> gemeenregtelike reëls wil gebruik wat in <strong>die</strong> voor grondwetlike<br />

gewysdes aangetref word, moet jy seker wees dat dit nie met <strong>die</strong> Grondwet of PAJA in<br />

stryd is nie.<br />

Die bevindings <strong>van</strong> <strong>die</strong> hof kan soos volg saamgevat word :<br />

• Daar is slegs een regstelsel.<br />

• Die Grondwet is <strong>die</strong> hoogste reg en alle ander wetsvoorskrifte moet daaraan<br />

voldoen.<br />

procedurally fair within the purview of section 24 is for the courts to decide and I have little doubt that, to the extent that there is no inconsistency with the<br />

Constitution, the common-law grounds for review were intended to remain intact”.<br />

944 Chaskalson, 1985:257 het egter bevind dat <strong>die</strong> “control of public power by the courts through judicial review as and always has been a constitutional<br />

matter. Prior to the adoption of the interim Constitution this control was exercised by the Courts through the application of common law constitutional<br />

principles. Since the adoption of the interim Constitution such control has been regulated by the Constitution which contains express provisions dealing with<br />

these matters. The common law principles that previously provided the grounds for judicial review of public power have been subsumed under the<br />

Constitution, and in so far as they might continue to be rele<strong>van</strong>t to judicial review, they gain their force from the Constitution. In the judicial review of public<br />

power, the two are intertwined and do not constitute separate concepts.”<br />
