tendervoorwaarde, wat bepaal dat geen redes verskaf word vir <strong>die</strong> toekenning <strong>van</strong> ʼn<br />

tender nie, in stryd is met <strong>die</strong> vereistes gestel in Artikel 33 <strong>van</strong> <strong>die</strong> Grondwet. 800<br />

Die plig wat opgelê word om redes te verskaf, dra ook ʼn verpligting om inligting en<br />

dokumentasie te verskaf. In <strong>die</strong> ABBM Printing-saak stel <strong>die</strong> hof dit volgens bladsy 119C,<br />

soos volg :<br />

“The applicant clearly requires the documents referred to in the notice of motion in<br />

order to determine whether the tender process complied with the requirements of<br />

section 33 of the Constitution. Until it has had sight thereof, it cannot decide whether<br />

it has any claim to relief against the respondents. Sight of the documents could well<br />

result in forestalling any further litigation which is in itself good reason for ordering<br />

their production at this stage …”<br />

In <strong>die</strong> saak <strong>van</strong> Trend Finance (Pty) Limited and Another v Commissioner for SARS and<br />

Another801 het regter Van Reenen aandag geskenk aan Artikel 5(3) <strong>van</strong> PAJA, wat <strong>die</strong><br />

vermoede ten gunste <strong>van</strong> persone wat onderhewig is aan administratiewe optrede,<br />

daarstel. Waar <strong>die</strong> administrateur versuim of weier om redes vir <strong>die</strong> administratiewe<br />

handeling te verskaf, word daar by <strong>die</strong> afwesigheid <strong>van</strong> bewyse tot <strong>die</strong> teendeel vermoed<br />

dat <strong>die</strong> administratiewe handeling sonder goeie rede geneem is.<br />

Met verwysing na Artikel 5 en <strong>die</strong> verskaffing <strong>van</strong> redes, kan <strong>die</strong> volgende gewysdes<br />

geraadpleeg word, naamlik Lategan and Others v Lategan NO and Others802 ; MEC, Public<br />

Services (Pty) Limited and Others, 803 Minister of Environmental Affairs and Tourism and<br />
