In <strong>die</strong> vorige hoofstuk is daar in besonderhede gekonsentreer op <strong>die</strong> aspek <strong>van</strong><br />

administratiewe optrede en wat dit behels. Dit is duidelik dat <strong>die</strong> bestek en toepassing <strong>van</strong><br />

<strong>die</strong> beginsels <strong>van</strong> regverdige administratiewe optrede (administratiewe geregtigheid)<br />

bepaal word deur <strong>die</strong> vraag of <strong>die</strong> handeling administratiewe optrede behels, al dan nie en<br />

of <strong>die</strong> betrokke handeling deur ʼn staatsorgaan verrig is.<br />

Die definisie <strong>van</strong> “administratiewe handeling” speel ʼn sleutelrol in <strong>die</strong> toepassing <strong>van</strong><br />

grondwetlike regte, ingevolge Artikel 33 <strong>van</strong> <strong>die</strong> Finale-Grondwet en <strong>die</strong> toepassing <strong>van</strong><br />

PAJA. Wat veral Artikel 33 aanbetref, het <strong>die</strong> howe <strong>die</strong> gemeenregtelike siening rakende<br />

administratiewe handeling drasties ingeperk of verenig. Een rede vir hier<strong>die</strong> houding, is<br />

dat daar nie meer so ʼn groot behoefte aan administratiewe hersiening bestaan, soos dit<br />

<strong>die</strong> geval was voor <strong>die</strong> inwerkingtreding <strong>van</strong> <strong>die</strong> Interim en Finale-Grondwette nie.<br />

Ter illustrasie hier<strong>van</strong>, word dit soos volg in <strong>die</strong> SARFU-saak gestel. 740<br />

“In the past, under the doctrine of parliamentary supremacy, the major source of<br />

constraint upon the exercise of public power lay in administrative law, which was<br />

developed to embrace the exercise of public power in fields which, strictly speaking,<br />

might not have constituted administration. Now, under our new constitutional order,<br />

the constraints are to be found throughout the Constitution including the right, and<br />

corresponding obligation, that there be just administrative action.”<br />

Daar kan tereg gevra word wat <strong>die</strong> howe se benadering tot <strong>die</strong> bestek <strong>van</strong> administratiewe<br />

optrede was, voordat PAJA in werking getree het. Die volgende gewysdes is <strong>van</strong><br />

toepassing :<br />

In Directory Advertising Cost Cutters v Minister for Posts Telecommunications and<br />

Broadcasting beslis regter Van Dijkhorst soos volg :<br />

“The concept (organ of state) as used in section 7(1) of the Constitution had to be<br />

limited to institutions which are an intrinsic part of government, that is part of the public<br />

service or consisting of government appointees at all levels of government – national,<br />
