Word die meeste hofuitsprake bestudeer waar daar te doen gekry word met PAJA,
sal opgemerk word dat daar eers bepaal moet word of daar met ʼn administratiewe
handeling te doen gekry word. Daar is hofuitsprake wat oor die aspek handel. 627
In die Gamevest (Pty) Limited v Regional Land Claims Commissioner, Northern
Province and Mpumalanga and Others628-saak betwis die appellant ʼn besluit van die
streek grondeisekommissaris om ingevolge die Wet op Herstel van Grondregte, Wet
22 van 1994 (Restitution of Land Rights Act 22 of 1994), ʼn eis van die vyfde
respondent te aanvaar. Ingevolge Artikel 11 van die Wet moes die volgende stappe
geneem word :-
(a) Die aansoeker stel die eis in.
(b) Sodra dit ontvang word, word dit in die staatskoerant afgekondig.
(c) Die kommissaris ondersoek die aangeleentheid.
(d) Die saak word ingevolge Artikel 14 na die Grondeisehof verwys.
In bogemelde saak is die eis op 3 Augustus 2000 ingedien en PAJA het eers op 30
November 2000 in werking getree. Die Hoogste Hof van Appèl moes derhalwe op
die gemenereg terugval. Die hof beslis soos volg :-
