Gedurende 1993 sien <strong>die</strong> Interim-Grondwet (Wet 200 <strong>van</strong> 1993) vir <strong>die</strong> eerste keer<br />

<strong>die</strong> lig, wat dan ook Artikel 24, <strong>die</strong> administratiewe geregtigheidsklousule, bevat.<br />

Hierdié artikel het <strong>die</strong> volgende verrykende implikasies vir ons administratiefreg<br />

ingehou :<br />

• Artikel 24 het <strong>die</strong> “ouster clauses” in <strong>die</strong> ban gedoem. Die Grondwet het nou<br />

<strong>die</strong> uitspraak <strong>van</strong> Staatspresident v United Democratic Front (supra)<br />

omvergewerp. Enige bevinding wat binne <strong>die</strong> raamwerk <strong>van</strong> Artikel 24<br />

gemaak word, kan slegs geneem word nadat ʼn billike prosedure nagevolg is.<br />

• Artikel 24(c) vereis noudat ʼn openbare amptenaar skriftelik redes verskaf vir<br />

sy beslissing, behalwe waar dit reeds openbaar gemaak is.<br />

• Artikel 24(d) verlang dat ʼn administratiewe handeling geregverdig moet kan<br />

word teenoor <strong>die</strong> redes wat vir <strong>die</strong> besluit aangevoer word, met ander woorde<br />

redelikheid word as hersieningsgrond daargestel. 249<br />

• Billikheid vereis ʼn verhoor, behalwe waar <strong>die</strong> versuim om aan te hoor ʼn<br />

sekere waarde of ʼn gelyke of groter belang as <strong>die</strong> beginsel <strong>van</strong> natuurlike<br />

geregtigheid bevorder.<br />

• Die plig om billik op te tree vorm <strong>die</strong> hart <strong>van</strong> <strong>die</strong> leerstuk <strong>van</strong> legitieme<br />

verwagting.<br />

Oor <strong>die</strong> administratiewe geregtigheidsklousule laat Barrie homself soos volg uit : 250<br />

“With the advent of section 24 of the interim constitution and 33 of the 1996<br />

constitution a total new approach to administrative law has manifested itself.<br />

We now have a legal structure which declares that a bureaucracy having been<br />

appropriately empowered, can also be held accountable for its action. The<br />

right to review administrative action has been elevated to a constitutional<br />

status. Review is constitutionally entrenched on grounds of lawfulness<br />

(principle of legality), fairness (procedural and substantive) and<br />

reasonableness. Added to this is a right to written reasons for the<br />

Administrative action taken.<br />

It has been decided that administrative justice is a goal worth constitutinalising.<br />

The South African constitution will be recorded in the annals of the 20th century<br />

as an astonishing feat of goodwill, compromise, pragmatism and indefatigable<br />

effort. As stated by President Mandela in his address to the constitutional<br />
