Abstract<br />

Guidel<strong>in</strong>es for the application of the right to equality<br />

In 1997 the constitutional court <strong>in</strong> Harksen v Lane formula<strong>te</strong>d guidel<strong>in</strong>es for the application<br />

of the right to equality <strong>in</strong> the Constitution. The purpose of this article is to review the<br />

guidel<strong>in</strong>es <strong>af</strong><strong>te</strong>r 15 years and to propose certa<strong>in</strong> adaptations.<br />

Guidel<strong>in</strong>es to apply a right must, as far as possible, be formula<strong>te</strong>d <strong>in</strong> such a way that they are<br />

both readily understandable and well <strong>in</strong><strong>te</strong>gra<strong>te</strong>d with the other provisions of the bill of rights,<br />

<strong>in</strong>clud<strong>in</strong>g the general provisions which conta<strong>in</strong> general rules on who the people and<br />

<strong>in</strong>stitutions are who benefit fr<strong>om</strong> a right, who the people and <strong>in</strong>stitutions are who are bound<br />

by the rights and what their duties <strong>in</strong> respect of the rights are, and how non-c<strong>om</strong>pliance with<br />

the duties may be justified <strong>in</strong> <strong>te</strong>rms of limitation clauses. Measured aga<strong>in</strong>st these<br />

requirements the Harksen guidel<strong>in</strong>es are deficient <strong>in</strong> certa<strong>in</strong> respects. It is very difficult to<br />

understand and apply the Harksen guidel<strong>in</strong>es. The guidel<strong>in</strong>es are also not well <strong>in</strong><strong>te</strong>gra<strong>te</strong>d with<br />

the general provisions of the bill of rights: considerations relat<strong>in</strong>g to the requirements for the<br />

limitation of the right <strong>in</strong> section 9(1) are considered to form part of the def<strong>in</strong>ition of the right;<br />

an <strong>in</strong>c<strong>om</strong>prehensible dist<strong>in</strong>ction is made between “discrim<strong>in</strong>ation” and “unfair<br />

discrim<strong>in</strong>ation”; limitation considerations have been taken <strong>in</strong>to account to such an ex<strong>te</strong>nt <strong>in</strong><br />

def<strong>in</strong><strong>in</strong>g unfair discrim<strong>in</strong>ation that the usefulness of apply<strong>in</strong>g the general limitation clause has<br />

been questioned, etce<strong>te</strong>ra. However, the essence of the court’s views on the mean<strong>in</strong>g of<br />

“unfair discrim<strong>in</strong>ation”, namely that “unfair” applies to differentiation that impairs human<br />

dignity or that has a similar serious consequence, is sound and should be reta<strong>in</strong>ed. The <strong>te</strong>st<br />

underl<strong>in</strong>es the offensiveness of unfair discrim<strong>in</strong>ation and the ethos of a bill of rights founded<br />

on human dignity. It also provides a clear basis for the dist<strong>in</strong>ction between the first phase of a<br />

bill of rights <strong>in</strong>quiry, dur<strong>in</strong>g which the factual <strong>in</strong>fr<strong>in</strong>gement of a right is de<strong>te</strong>rm<strong>in</strong>ed and the<br />

second phase, dur<strong>in</strong>g which justification for the <strong>in</strong>fr<strong>in</strong>gement with<strong>in</strong> the framework of the<br />

general limitation clause is <strong>in</strong>vestiga<strong>te</strong>d.<br />

The follow<strong>in</strong>g adap<strong>te</strong>d guidel<strong>in</strong>es are proposed:<br />

1. Does the provision or action to which the right applies differentia<strong>te</strong> directly or<br />

<strong>in</strong>directly between people?<br />

1.1 As <strong>in</strong> the case of all other rights it must be de<strong>te</strong>rm<strong>in</strong>ed whether a c<strong>om</strong>pla<strong>in</strong>ant is<br />

pro<strong>te</strong>c<strong>te</strong>d by the right. All natural persons are pro<strong>te</strong>c<strong>te</strong>d and to the ex<strong>te</strong>nt that the<br />

rights of juristic persons are <strong>af</strong>fec<strong>te</strong>d <strong>in</strong> a way which is so serious that it can be<br />

c<strong>om</strong>pared to the violation of human dignity, juristic persons are also pro<strong>te</strong>c<strong>te</strong>d aga<strong>in</strong>st<br />

unfair discrim<strong>in</strong>ation.<br />

1.2. As <strong>in</strong> the case of all other rights it must also be de<strong>te</strong>rm<strong>in</strong>ed whether those who<br />

have allegedly viola<strong>te</strong>d the right are bound by the right. The right to equality applies<br />

to all law and b<strong>in</strong>ds all organs of sta<strong>te</strong>. The nature of the right and the duties which it<br />

imposes are such that the right is capable of be<strong>in</strong>g applied to priva<strong>te</strong> persons and<br />
