Tutte le ordinazioni da parte del Cliente sono subordinate alle presenti
condizioni generali di vendita. Qualsiasi altra condizione inserita dal
Cliente nell’ordine, verrà considerata di nessun valore, senza obbligo di
avviso da parte nostra.
Per evitare errate interpretazioni degli ordini si prega di usare sempre,
oltre alla descrizione del materiale desiderato, il numero di codice del
particolare. Nei casi di discordanza tra il numero di codice e la parte
descrittiva sarà ritenuto valido il numero di codice.
Gli ordini proposti potranno essere, insindacabilmente, non accettati
e non potranno essere inferiori a € 600,00 IVA esclusa. L’accettazione
degli ordini stessi si intende sempre “salvo venduto” anche se ciò sia
esplicitamente espresso.
I termini di consegna eventualmente concordati hanno valore indicativo e
non comportano una tassativa responsabilità e garanzia da parte nostra.
La merce viaggia a rischio e pericolo del Cliente, anche se resa franco
destino. Il materiale inviato in ogni spedizione è sempre accompagnato
da un “DOCUMENTO DI TRASPORTO” (DdT). Poiché la firma da parte
del vettore (all’atto dello svincolo) è liberatoria nei confronti del vettore
stesso, si ricorda che eventuali discordanze o ammanchi devono essere
fatti constatare al corriere al momento della consegna e denunciato con
lettera al Corriere stesso e per conoscenza alla nostra Ditta.
Non saranno accettate altre forme di pagamento se non quelle pattuite.
In caso di inosservanza della sopraddetta condizione nonché del
mancato pagamento, ci riserviamo il diritto di sospendere ed annullare le
rimanenti consegne. L’acquirente sarà tenuto al risarcimento dei danni,
al pagamento degli interessi vigenti e non potrà avanzare pretese di
compensi od indennizzi per l’interruzione della fornitura.
La merce rimarrà comunque di nostra proprietà fino al completo
pagamento della stessa.
Eventuali reclami, di qualunque natura possano essere, devono pervenirci
per iscritto entro 20 giorni data spedizione. Per eventuali difetti occulti
tale termine è esteso a 90 giorni naturali consecutivi.
Se riconosciuti fondati, la nostra responsabilità si limita alla sostituzione
del materiale contestato, pertanto non verranno riconosciuti addebiti per
eventuali danni a cose, anche d’altri, o a persone.
La garanzia dei prodotti per vizi e difetti di qualsiasi natura ed entità ha la
durata di 24 mesi dalla data di produzione.
Non si ricevono merci di ritorno senza nostra autorizzazione. I resi
devono essere effettuati in porto franco. Se autorizzati in porto
assegnato devono viaggiare solo con corrieri da noi indicati.
I particolari inviati come campioni dovranno eventualmente essere
ritornati dal Cliente in Porto Franco. In caso contrario sarà addebitata
la spesa di trasporto che abbiamo dovuto sostenere per il ritiro della
merce.
Per eventuali contestazioni, qualunque siano le condizioni di pagamento e
di consegna, l’Autorità Giudiziaria competente è quella di Bologna.
In caso di variazione di prezzo rispetto a quello indicato nel listino (per
variazioni in più od in meno) il prezzo segnato in fattura sarà quello in
vigore alla data della bolla di spedizione della merce qualunque sia la data
di conferimento dell’ordine e della conferma dello stesso.
Non accettiamo nessuna responsabilità per eventuali errori o omissioni
su questo catalogo. Ci riserviamo il diritto di apportare su questo
catalogo qualsiasi modifica senza preavviso. E’ vietata la riproduzione
integrale e parziale del presente catalogo, senza autorizzazione scritta
rilasciata da Mupo S.r.l.
All orders received from the Customer are subject to these general
terms of sale. Any other condition that the Customer enters on the
order shall be considered null and void, and we shall not be required to
make notification.
In order to avoid erroneous interpretations of the orders, you are
requested to always use not only the description of the desired material,
but also the item code number. In the event there is disagreement
between the code number and the description, the code number shall be
regarded as valid.
Acceptance of the proposed orders can be unquestionably refused,
and the total amount of the orders can be no lower than € 600,00, VAT
excluded. Acceptance of the orders is always understood as “subject to
being unsold”, even if this is explicit.
In case the delivery terms are agreed upon, they are purely indicative
and do not entail our express liability and guarantee.
The goods travel at the Customer’s risk and peril, even if they are
delivered carriage paid. A “DELIVERY NOTE” always accompanies the
material sent in each shipment. Since the carrier’s signature affixed
at the time of consignment releases the carrier, remember that any
disagreements or shortages must be reported to the forwarding agent
at the time of delivery and notified to the forwarding agent by letter, with
a copy sent to our company.
Any forms of payment other than those agreed on shall not be
accepted. In the event you fail to comply with this condition or do
not make payment, we reserve the right to interrupt and cancel the
remaining consignments. The buyer shall be bound to pay for damages
and the current interest, and will be unable to put forward claims for
compensation or damages because the supply has been interrupted.
The goods shall in any case remain our property until full payment has
been received.
Any claims of any type whatsoever must reach us in writing within 20
days of the date of shipment. This deadline is extended to 90 consecutive
days if there are any hidden defects. If said defects are acknowledged as
valid, our liability is restricted to replacement of the disputed material,
therefore, no possible damage to things, even of others, or to persons
will be indemnified.
The warranty of the products for defects and faults of whatsoever nature
and value, lasts for 24 months from production date.
Goods cannot be returned without our authorisation. Returns must be
shipped carriage free. If authorisation is given to be shipped carriage
forward, they must travel only with forwarding agents we indicate.
In the case the Customer must return the items sent as samples, he
must ship them carriage free; otherwise, the transport charges we bear
for collecting the goods shall be charged to the Customer’s account.
The competent judicial authority for any disputes, whatever the payment
and delivery terms may be, is the Court of Bologna, Italy.
In the event the price is different than the one shown on the price list
(whether it is higher or lower), the price given on the invoice shall be the
one in effect as of the date of the delivery note of the goods, regardless
of the dates of the order and order confirmation.
We do not accept any liability for possible errors or omissions in this
catalogue. We reserve the right to make any changes to this catalogue
without prior notification. Total or partial reproduction of this catalogue
without written authorisation given by Mupo S.r.l. is prohibited.
