La costruzione della sfera privata però sollecita ad abbandonare una<br />
visione uni<strong>di</strong>mensionale, come quella sottostante a questa impostazione,<br />
secondo la quale il potere è concentrato nelle istituzioni ed è espresso<br />
soltanto <strong>da</strong>llo Stato attraverso la legislazione. <strong>Il</strong> <strong>di</strong>ritto è certamente importante,<br />
soprattutto quando <strong>in</strong>corpora con apparenza <strong>di</strong> neutralità i prodotti<br />
delle scienze e della tecnologia, ma non bisogna <strong>di</strong>menticare quella<br />
rete complessa e ramificata, costituita <strong>da</strong>ll’<strong>in</strong>sieme dei prodotti della tecnologia,<br />
che <strong>in</strong>cide sul corpo, sulla salute, sulle con<strong>di</strong>zioni <strong>di</strong> vita 104 .<br />
Del resto, le relazioni <strong>di</strong> potere non devono essere localizzate soltanto<br />
all’<strong>in</strong>terno dello Stato, ma promanano anzi <strong>da</strong> una molteplicità <strong>di</strong> punti nel<br />
gioco non egalitario e mobile delle relazioni sociali 105 .<br />
La complessità con la quale il potere opera nel senso <strong>di</strong> con<strong>di</strong>zionare la<br />
costruzione dell’identità richiede strategie complesse, <strong>di</strong>rette anche contro<br />
altre forme <strong>di</strong> potere sociale che esercitano una funzione « <strong>di</strong>scipl<strong>in</strong>are » sul<br />
soggetto attraverso varie forme <strong>di</strong> sorveglianza e classificazione 106 .<br />
Così, riprendendo la sfi<strong>da</strong> alla <strong>di</strong>st<strong>in</strong>zione fra pubblico e privato, la<br />
« resistenza » alla pervasività del potere può essere trovata proprio nella<br />
stessa rete <strong>di</strong> relazioni <strong>di</strong> potere costruita <strong>da</strong>llo Stato, attraverso l’attribuzione<br />
<strong>di</strong> poteri a soggetti che prima non li possedevano, operando una<br />
re<strong>di</strong>stribuzione <strong>di</strong> potere non solo giuri<strong>di</strong>co, ma anche sociale <strong>da</strong>i controllori<br />
ai controllati.<br />
Ma il caso della costruzione della sfera privata è anche emblematico <strong>di</strong><br />
una elaborazione o rielaborazione delle categorie tra<strong>di</strong>zionali del <strong>di</strong>ritto<br />
