Article represents the updated version of the dissertation thesis prepared at<br />

the Tbilisi State University law faculty in September 2011, title of the work:<br />

Protection of third Persons’ Interests in Representation (according to the civil<br />

codes of Germany and Georgia), supervisor Davit Kereselidze, evaluation: very<br />

good (written part). Based on the principle of freedom of signing an agreement,<br />

for the party involved in representation relation, it is important, to know the name<br />

of contrahent. Interest to know the name of contrahent becomes important from<br />

the moment of representation relations. Relevant norms regulating representation<br />

relations in Georgian Civil Code contain shortcomings, that need to be addressed.<br />

Article provides an overview on the provisions and practice of Germany in regard<br />

with the third persons representation and contrahents. Taking into consideration<br />

relevant Georgian legislation and as a sum up provides an overview of survey<br />

results.<br />
