of Conferring
the Refugee Status
and of Subjects of Law
in the Great Britain
The article canvasses the peculiarities of conferring the status of refugee
and of subjects of law on the example of the Great Britain.
The Great Britain employs a rather strict mechanism for conferring the
status to refugees. The policy in place in the Great Britain, like that of the
Europe, is to make stricter the migration legislation in the country. This
policy aims at simplifying the process of conferring the refugee status for
the persons who really qualify for it and hindering the entry of those
applicants in the country who do not meet the requirements.
There is not a single institution in England which is in charge or coordinates
receiving of, housing and conferring the refugee status to the applicants.
Besides, there is no hierarchy of the organizations engaged in this process.
A number of government departments participate in receiving and housing
the persons seeking the refugee status and asylum but the Ministry of Internal
Affairs (Home Office) is fully obliged to implement the migration policy.
Asylum applications are divided into 2 categories: those of the defectors
who crossed the border of the Great Britain and those of the persons
who are in the territory of the country. According to the 1999 Law on
Refugees and Immigration different legal regimes are applied for
consideration of the mentioned two categories of applications and for
conferring refugee status to them.
