into what can be considered a "contract for the use <strong>of</strong> the bike park"<br />

undertakes to carry the rider from downstream to upstream, and is<br />

subject to liabilities that are related to the safety conditions <strong>of</strong> the areas<br />

where the rider performs his descent to valley. It also examines the role<br />

<strong>of</strong> insurance, noting that some local regulations require the operators <strong>of</strong><br />

the bike park to provide adequate insurance cover before opening the<br />

park to the public. Also analyzed is the scenario resulting from an<br />

hypotetical collision between bikers and other traditional visitors <strong>of</strong> the<br />

mountain, both inside and outside <strong>of</strong> the bike park, exloring the liability<br />

<strong>of</strong> the operator in relation to such occurrences. Lastly it is also<br />

considered the civil liability arising from a defect on the equipments<br />

used by mountain bikers, as well as the product liability <strong>of</strong> the<br />

manufacturer <strong>of</strong> mountain bikes in relation to a non-contractual liability<br />

arising from placing on the market a defective mountain bike.<br />
