L<br />
’imposta societaria sul reddito trova la sua<br />
discipl<strong>in</strong>a nel Corporate Tax Act (promulgato<br />
nel 1949 e da allora molte volte modificato).<br />
Riguardo agli <strong>in</strong>vestitori esteri sono molto<br />
importanti i seguenti ulteriori provvedimenti:<br />
il Foreign Investment Promotion Act <strong>del</strong><br />
1998 (<strong>in</strong> seguito FIPA) che detta norme<br />
di carattere agevolativo volte a favorire gli<br />
<strong>in</strong>vestimenti diretti esteri (FDI - Foreign<br />
Direct Investments);<br />
la Special Tax Treatment Control Law <strong>del</strong> 1999<br />
(<strong>in</strong> seguito STTCL), che prevede anch’essa<br />
misure di sostegno agli <strong>in</strong>vestimenti esteri<br />
consistenti <strong>in</strong> esenzioni fiscali e <strong>in</strong> riduzioni<br />
di imposta <strong>del</strong>le imprese a capitale estero;<br />
La Law for the Coord<strong>in</strong>ation of International<br />
Tax Affairs (LCITA, 1996) che detta norme<br />
sul transfer pric<strong>in</strong>g, sui paradisi fiscali (Tax<br />
Heavens), sulle procedure di mutuo accordo<br />
(Mutual Agreements Procedures), sulla<br />
capitalizzazione sottile (Th<strong>in</strong> capitalization)<br />
e riguardo ai metodi di cooperazione<br />
<strong>in</strong>tergovernativa.<br />
L’imposta coreana sul reddito societario è<br />
articolata <strong>in</strong> due scaglioni di reddito:<br />
s<strong>in</strong>o a 200 milioni di won (ai cambi attuali<br />
1 euro = 1.555.51 won, circa 128.576 euro):<br />
10%;<br />
oltre tale soglia (sulla parte eccedente): 22%.<br />
È, <strong>in</strong>oltre, dovuta una soprattassa <strong>del</strong> 10% che<br />
porta le due aliquote, rispettivamente, all’11% e<br />
al 24,2%.<br />
L’imposta societaria dovuta non può, tuttavia,<br />
essere <strong>in</strong>feriore ad un determ<strong>in</strong>ato importo<br />
m<strong>in</strong>imo (“AMT - Alternative M<strong>in</strong>imum Tax”)<br />
M<strong>in</strong>istero <strong>del</strong>lo Sviluppo Economico<br />
calcolato sul reddito imponibile al lordo <strong>del</strong>le<br />
varie esenzioni e riduzioni d’imposta previste<br />
dalla STTCL.<br />
La AMT viene calcolata sul reddito imponibile<br />
lordo:<br />
s<strong>in</strong>o a 10 miliardi di won (circa 6.428.760<br />
euro) di reddito imponibile lordo: 10%;<br />
da 10 a 100 miliardi di won (circa 64.287.600<br />
euro) di reddito imponibile lordo: 11%:<br />
oltre tale soglia (sulla parte eccedente): 14%.<br />
Per le piccole imprese (SME - Small Enterprises,<br />
soggetti con redditi non superiore a 300.000<br />
euro), l’aliquota scende al 7%.<br />
Le stabili organizzazioni coreane di imprese<br />
estere (Branch), riguardo al reddito prodotto,<br />
sono tassate come le società di diritto locale.<br />
Nel momento <strong>in</strong> cui le stesse trasferiscono, <strong>in</strong><br />
tutto o <strong>in</strong> parte, il reddito alla casa madre, torna<br />
applicabile la “Branch profit tax” <strong>del</strong> 20%.<br />
PKF nella pubblicazione “Republic of Korea Tax<br />
Guide 2011”, p. 1, afferma che:<br />
“Foreign corporations with a permanent<br />
establishment <strong>in</strong> Korea must paycorporate<br />
<strong>in</strong>come tax on <strong>in</strong>come from Korean sources <strong>in</strong><br />
the same manner as that applied to a domestic<br />
corporation as stated above. However, if the<br />
foreign corporation has a branch <strong>in</strong> Korea and<br />
the tax treaty between Korea and the country <strong>in</strong><br />
which the foreign corporation is a resident allows<br />
imposition of a branch profit tax (BPT), then<br />
a branch profit tax is imposed on the adjusted<br />
taxable <strong>in</strong>come of the Korean branch of the foreign<br />
corporation. This branch profit tax is levied <strong>in</strong><br />
addition to the regular corporation tax under the<br />
Corporation Tax Law. The standard rate of BPT is<br />
20%, although reduced rates of between 5% and<br />
15% apply where provided for<br />
by a tax treaty. The tax is based on the ‘adjusted<br />
taxable <strong>in</strong>come’ be<strong>in</strong>g taxable <strong>in</strong>come less regular<br />
corporate <strong>in</strong>come tax and an amount deemed to<br />
have been re<strong>in</strong>vested for the operation of the<br />
permanent establishment based on the deemed<br />
capital base of the branch as if it were a separate<br />
comparable enterprise”.
