Tale ipotesi è prevista negli ordinamenti di common law, alla cui tradizione
giuridica appartiene l’istituto della joint criminal enterprise( 207 ). La forma di responsabilità
in esame si estende, infatti, a coloro che, anche se non vogliono un
evento, né assistono i complici per la sua realizzazione o li incoraggiano, pur
tuttaviasannochesussisteunrealerischio che il complice, mentre consuma
il reato programmato, realizzerà un diverso reato, del tipo di quello concordato
(«parasitic accessory liability») e, nonostante ciò, continua a collaborare al piano
comune( 208 ); il diverso reato non deve essere fondamentalmente diverso da
quello (oggettivamente) prevedibile( 209 ). L’imputato sarà chiamato a rispondere
dei crimini che pur non rientrando nello scopo o nel piano comune perseguito
(I forma di JCE), ne rappresentano una naturale e prevedibile conseguenza(
210 ) (crimini consumati nell’ambito di un ampio progetto di deportazione
della popolazione civile; anzi si ritiene che tali extended crimes finiscono
successivamente per rientrare nello scopo comune, nel senso che una volta che
iniziano a essere consumati e gli imputati, leader della JCE,nesonoconsapevoli
e li accettano, tali crimini rientrano nello scopo comune( 211 )).
In una prima fase, addirittura, la giurisprudenza del TPY non si è limitata
ad estendere la responsabilità alle conseguenze previste come rischio
reale connesso alla consumazione del reato programmato, ma si è estesa
tale forma di responsabilità anche nei confronti delle conseguenze meramente
«prevedibili». Tale forma di responsabilità è stata paragonata ad
una bomba atomica nell’arsenale del pubblico ministero( 212 ).
