Jakarta Utara untuk melakukan pemanggilan
ulang terhadap Perusahaan dikarenakan sampai
dengan persidangan nomor register perkara
138/Pdt.G/2020/PN.JKT.UTR diselenggarakan,
Perusahaan belum menerima relaas panggilan
sidang dan dokumen gugatan secara resmi dari
Pengadilan Negeri Jakarta Utara. Pada tanggal 8
April 2020, Pengadilan Negeri Jakarta Utara
menerbitkan surat No. W10-U4/3414/
HK.02/04/2020.MD yang ditujukan kepada Ketua
Pengadilan Negeri Bekasi perihal bantuan
panggilan sidang perkara perdata
No. 138/Pdt.G/2020/ PN.JKT.UTR kepada
PT Pembangunan Jaya Ancol Tbk (Perusahaan)
yang dalam hal ini diwakili kuasa hukumnya yang
berdomisili di Kota Bekasi untuk datang
menghadap pada persidangan umum perkara
perdata No. 138/Pdt.G/2020/PN.JKT.UTR di
Pengadilan Negeri Jakarta Utara dan di dalam
surat tersebut kuasa hukum Perusahaan juga
menjadi pihak yang ditembuskan. Berdasarkan
surat tersebut kemudian kuasa hukum
Perusahaan melakukan konfirmasi kepada
Pengadilan Negeri Jakarta Utara untuk datang
mengadap dalam persidangan umum perkara
perdata No. 138/Pdt.G/2020/ PN.JKT.UTR. Pada
tanggal 05 Mei 2020, sesuai berita cara
persidangan tanggal 05 Mei 2020, kuasa hukum
Penggugat di persidangan secara lisan
menyatakan akan mencabut gugatannya dengan
alasan karena ada kesalahan di dalam
menetapkan Pihak yaitu Tergugat yaitu Tergugat
I. Atas permohonan Penggugat tersebut, kuasa
Para Tergugat tidak keberatan dan oleh karena
perkara gugatan Penggugat No.
138/Pdt.G/2020/PN.JKT.UTR. tersebut telah
dicabut secara lisan di persidangan oleh
Penggugat, maka Majelis Hakim memandang
perlu untuk menghentikan proses perkara
gugatan No. 138/Pdt.G/2020/ PN.JKT.UTR.
tersebut dan memerintahkan Panitera
Pengadilan Negeri Jakarta Utara untuk mencoret
dalam register perkara perdata No.
138/Pdt.G/2020/PN.JKT.UTR. yang telah didaftar
tersebut. Pada tanggal 12 Mei 2020 Majelis
Hakim membacakan penetapan dalam sidang
terbuka untuk umum yang menetapkan sebagai
berikut:
Menetapkan:
1. Mengabulkan permohonan pencabutan
gugatan tersebut;
2. Memerintahkan Panitera Pengadilan Negeri
Jakarta Utara untuk mencatat dan mencoret
perkara perdata Nomor Register 138/Pdt.G/
2020/PN.JKT.UTR. atas pencabutan tersebut
ke dalam buku register perkara;

lawsuit documents formally from the North
Jakarta District Court. On April 8, 2020, the
North Jakarta District Court issued letter No.
W10-U4 /3414/HK.02/04/2020.MD addressed to
the Chairperson of the Bekasi District Court
regarding assistance for summons for civil case
hearing No. 138/Pdt.G/ 2020/PN.JKT.UTR to
PT Pembangunan Jaya Ancol Tbk (the
Company), which in this case is represented by
their attorney who is domiciled in Bekasi City to
appear before the general trial of civil case
No. 138/ Pdt.G/2020/PN.JKT.UTR at the North
Jakarta District Court and in the letter the
Company's attorney is also the party to be
copied. Based on this letter, the Company's
attorney confirmed to the North Jakarta District
Court to come to the court in the civil case
No. 138/ Pdt.G/2020/PN.JKT.UTR. On May 05,
2020, according to the trial proceedings on May
5, 2020, the Plaintiff's attorney at the trial
verbally stated that he would withdraw his
lawsuit on the grounds that there was an error in
determining the Party, namely the Defendant,
namely Defendant I. At the request of the
Plaintiff, the Defendants' attorney was not
objections and because of the Plaintiff's lawsuit
No. 138/Pdt.G/ 2020/PN.JKT.UTR. the Plaintiff
had revoked verbally at trial by the Plaintiff, so
the Panel of Judges considered it necessary to
stop the process of the lawsuit case No.
138/Pdt.G/2020/ PN.JKT.UTR. and ordered the
Clerk of the North Jakarta District Court to cross
out the civil case register No.
138/Pdt.G/2020/PN.JKT.UTR. who have
registered it. On May 12, 2020, the Panel of
Judges read out the decision in an open session
to the public which determined the following:
Determine:
1. Grants the request to withdraw the lawsuit;
2. Order the clerk of the North Jakarta District
Court to record and cross out the civil case
Register No. 138/Pdt.G/2020/PN.JKT.UTR.
for the said revocation into the case register
book;
