Atas putusan tersebut Perusahaan mengajukan
kasasi ke MA dengan register perkara
No. 705K/Pdt/2004. Berdasarkan salinan
putusan No. 705K/Pdt/2004 tanggal
27 Juni 2007, MA yang diketuai oleh
Drs. H. Syamsuhadi Irsyad, S.H., MH
memutuskan untuk menolak kasasi Perusahaan.
Atas putusan MA tersebut, pada tanggal
3 Desember 2007 Perusahaan telah mengajukan
Memori Peninjauan Kembali (PK) kepada MA.
Pada tanggal 19 Mei 2010 MA telah
mengeluarkan putusan untuk menolak PK
yang diajukan Perusahaan. Manajemen
membentuk provisi kerugian sebesar
Rp1.078.639.289.
Manajemen berkeyakinan cadangan kerugian
telah cukup untuk menutup kemungkinan
kerugian akibat perkara hukum.
b. Pada tahun 1997 terjadi klaim atas tanah dalam
penguasaan Perusahaan yang berlokasi di
kawasan Pasir Putih, Kelurahan Ancol
(d/h Kelurahan Sunter) oleh Didi Darmawan atau
Tjoa Tjoan Yuh yang menyatakan sebagai ahli
waris Tjoa Kim Goan, pemilik tanah tersebut.
Atas klaim tersebut Perusahaan mengajukan
permohonan kepada PN Jakarta Utara
untuk menyatakan bahwa pemilik tanah
dalam keadaan tidak hadir atau
"Afwezieg". Permohonan tersebut dikabulkan
oleh PN Jakarta Utara dengan
putusan No. 600/Pdt/P/1999/PN.Jkt.Ut tanggal
25 Agustus 1999.
Sehubungan dengan keputusan tersebut, ahli
waris tanah mengajukan kasasi. Pada tanggal
11 Maret 2002, MA yang diketuai H. Suwardi
Martowirono, S.H., mengeluarkan putusan
No. 1308 K/Pdt/2000 yang amarnya berbunyi
antara lain:
1. menolak permohonan pemohon intervensi
Tjoa Tjoan Yuh;
2. mengabulkan permohonan Perusahaan;
3. menyatakan Tjoa Kim Goan dalam keadaan
tidak hadir; dan
4. memerintahkan kepada Balai Harta
Peninggalan Jakarta supaya mengurus harta
kekayaan Tjoa Kim Goan serta membela hakhaknya.
Selanjutnya, Perusahaan menjadi Terbantah I
dalam perkara perdata No. 265/Pdt/Bth/
2003/PN.Jkt.Ut dengan Kiki Basuki Tirtawidjaja
(Pembantah).

The Company appealed on the above decision to
the Supreme Court with the register
No. 705K/Pdt/2004. Based on the copy of
decision No. 705K/Pdt/2004 dated June 27,
2007, the Supreme Court lead by
Drs. H. Syamsuhadi Irsyad, S.H., MH decided to
dismiss the Company’s appeal.
Based on the Supreme Court decision, on
December 3, 2007 the Company has filed
Memory Review (PK) to the Supreme Court. On
May 19, 2010 the Supreme Court has issued a
decision to reject the proposed PK of the
Company. The management established a
provision amounted to Rp1,078,639,289.
Management believes that the allowance for
litigations are adequate to cover possible losses.
b. In 1997, Didi Darmawan a.k.a Tjoa Tjoan Yuh
declared himself as the heirs of Toa Kim Goan,
the owner of land located in Pasir Putih area,
Ancol (formerly Sunter) that is now under
authority of the Company, and claimed
ownership of the said property. Based on that
claim, the Company proposed to the District
Court of North Jakarta to declare the
owner of the land as absentia or “Afwezieg”. The
proposal was approved by the Court in decision
letter No. 600/Pdt/P/1999/PN.Jkt.Ut dated
August 25, 1999.
In relation to the decision of the Court, the land’s
heirs has filed an appeal. On March 11, 2002,
the Supreme Court lead by H. Suwardi
Martowirono, S.H., issued decision No. 1308
K/Pdt/2000 declaring the following:
1. refuse the intervention request proposed by
Tjoa Tjoan Yuh;
2. granting to the Company's proposal;
3. declare the absence of Tjoa Kim Goan; and
4. ordered Balai Harta Peninggalan Jakarta to
settle the inheritance of Tjoa Kim Goan and
protect his rights.
Furthermore, the Company becomes defendant I
in the lawsuit No. 265/Pdt/Bth/2003/PN.Jkt.Ut
with Kiki Basuki Tirtawidjaja (Accused).
