Untuk Tahun-tahun yang Berakhir Pada Tanggal

31 Desember 2020 dan 2019

(Dalam Rupiah Penuh, Kecuali Dinyatakan Lain)

nilai ganti rugi sebesar Rp92.841.556.850.

Selisih perhitungan nilai antara Ketetapan

Walikotamadya Jakarta Utara tersebut dengan

dana ganti rugi yang diterima Perusahaan yaitu

sebesar Rp16.581.734.350 belum dicatat

sebagai pendapatan Perusahaan, karena

menurut manajemen Perusahaan:

1. Secara yuridis formal, sisa tagihan belum

dapat dikategorikan sebagai piutang

Perusahaan karena penentuan jumlah nilai

seluruh ganti rugi dilakukan secara sepihak

oleh Panitia Pengadaan Tanah untuk

Kepentingan Umum Jalan Tol Pluit -

Cilincing (Harbour Road) Kotamadya Jakarta

Utara. Tidak ada perjanjian kesepakatan

jumlah ganti rugi yang melibatkan

Perusahaan selaku entitas usaha berbadan

hukum, sehingga secara validitas, tidak ada

dasar bagi Perusahaan untuk mengakui sisa

tagihan ganti rugi sebagai piutang maupun

pendapatan;

2. Ditjen Binamarga dengan suratnya

No.T.10.100.06.06/729

tanggal

22 September 1999 yang ditujukan kepada

Gubernur DKI Jakarta, memohon untuk

mempertimbangkan agar sisa kekurangan

pembayaran ganti rugi dapat diselesaikan

tanpa ganti rugi, mengingat hal-hal berikut:

• Kondisi keuangan negara saat ini

dan ketersediaan dana Anggaran

Pendapatan dan Belanja Negara (APBN)

yang cenderung semakin terbatas, dan

• Prasarana publik yang dibangun di atas

tanah Perusahaan juga memberikan

manfaat yang sangat besar terhadap

pengembangan proyek Perusahaan.

Berdasarkan surat Perusahaan No. 048/DIR-

PJA/II/2002 tanggal 5 Februari 2002 kepada

Menteri Pemukiman dan Prasarana Wilayah,

Perusahaan telah meminta realisasi atas

kekurangan ganti rugi yang belum diterima.

Sampai dengan tanggal laporan ini,

penyelesaian selisih tersebut masih dalam

proses.

The difference in value between the Mayor's

decision and the value to be received by the

Company amounted to Rp16,581,734,350 has not

been recorded by the Company as income,

because the management believes that:

1. In formal jurisdiction, the balance due could

not been recognized as the Company's

accounts receivable since the valuation of the

compensation was made only by Committee

on Land Acquisition for public use Tol Pluit –

Cilincing Road (Harbour Road) North Jakarta.

No further agreement was made regarding the

compensation that involves the Company as a

legal entity. Thus, there is no ground for the

Company to recognize the compensation

balance due as its accounts receivable or

income;

2. Ditjen Binamarga with its letter No.T.10.

100.06.06/729 dated September 22, 1999,

addressed to the Governor of DKI Jakarta has

proposed to settle the remaining amount due

without any compensation based on the

following:

• The financial condition of the Country and

Limited National Budget (APBN) which

tends to be limited, and

• The public facilities built on the Company's

land provide significant benefits to the

Company's development project.

Based on the Company's letter No. 048/DIR-

PJA/II/2002 dated February 5, 2002 to the

Ministry of Housing and Land Development,

the Company has requested for the payment

of the compensation due. As of the report

date, the arrangement is still in progress.

b. Pada tanggal 10 Agustus 2004, Perusahaan

mengadakan perjanjian kerja sama dengan

PT Paramitha Bangun Cipta Sarana (PBCS)

untuk membangun, mengalihkan serta mengelola

hak atas sarana music stadium di area

Perusahaan seluas 39.000 m². PBCS memiliki

hak pengelolaan atas proyek tersebut selama

25 tahun. Setelah masa perjanjian berakhir,

PBCS akan mengembalikan pengelolaan kepada

cooperation agreement with PT Paramitha

Bangun Cipta Sarana (PBCS) to build, transfer

and operate the rights of a music stadium in the

Company's land that covers 39,000 sqm. PBCS

has the right to operate the project for 25 years.

return the operating to the Company. PBCS has

the option to extend the operating rights up to a
