UMUM<br />

GENERAL<br />

• P e n g e l o l a K a w a s a n <strong>SCBD</strong> wajib memberikan<br />

pelayanan dalam hal pengelolaan, perawatan,<br />

p e m e l i h a ra a n , d a n peningkatan Fasilitas<br />

Umum di Ruang Umum <strong>SCBD</strong> kepada Pemilik Lot,<br />

Pengguna atau External Provider yang melakukan<br />

kegiatan di <strong>Kawasan</strong> <strong>SCBD</strong>.<br />

• Pengelola <strong>Kawasan</strong> <strong>SCBD</strong> berhak dan berwenang<br />

menetapkan besaran <strong>Iuran</strong> <strong>Pengelolaan</strong> <strong>Kawasan</strong> (<strong>IPK</strong>),<br />

Uang Ja<strong>min</strong>an <strong>Iuran</strong> <strong>Pengelolaan</strong> <strong>Kawasan</strong> dan/atau Uang<br />

Ja<strong>min</strong>an Kegiatan kepada Pemilik Lot, Pengguna atau<br />

External Provider yang melakukan kegiatan-kegiatan di<br />

dalam <strong>Kawasan</strong> <strong>SCBD</strong> sesuai dengan ketentuan dalam<br />

<strong>Peraturan</strong> <strong>Kawasan</strong> <strong>SCBD</strong>. <strong>IPK</strong> dapat disesuaikan secara<br />

berkala oleh Pengelola <strong>Kawasan</strong> <strong>SCBD</strong>.<br />

• Pemilik Lot, Pengguna atau External Provider yang melakukan<br />

kegiatan di dalam <strong>Kawasan</strong> <strong>SCBD</strong> wajib membayar secara<br />

tepat waktu <strong>IPK</strong>, Uang Ja<strong>min</strong>an <strong>IPK</strong>, dan/atau Uang Ja<strong>min</strong>an<br />

Kegiatan sesuai Perjanjian <strong>Pengelolaan</strong> <strong>Kawasan</strong> yang<br />

ditandatanganinya dengan Pengelola <strong>Kawasan</strong> <strong>SCBD</strong>.<br />

• The <strong>SCBD</strong> Estate Management shall provide services<br />

concerning the management, preservation, maintenance and<br />

improvement of Public Facilities in <strong>SCBD</strong> Public Spaces to the<br />

Lot Owners, Users or External Providers carrying out activities<br />

in <strong>SCBD</strong>.<br />

• The <strong>SCBD</strong> Estate Management is entitled and authorized to<br />

deter<strong>min</strong>e the amount of the Estate Management Fees (<strong>IPK</strong>),<br />

Estate Management Fees Deposit (<strong>IPK</strong> Deposit) and/or Activity<br />

Deposit to the Lot Owners, Users or External Providers carrying<br />

out activities in <strong>SCBD</strong> as stipulated in the provisions of the<br />

<strong>SCBD</strong> Estate Regulations. <strong>IPK</strong> can be periodically adjusted by<br />

the <strong>SCBD</strong> Estate Management.<br />

• The Lot Owners, Users or External Providers carrying out<br />

activities in <strong>SCBD</strong> must pay the <strong>IPK</strong>, <strong>IPK</strong> Deposit, and/or<br />

Activity Deposit in a timely manner as stipulated in the Estate<br />

Management Agreement that is signed with the <strong>SCBD</strong> Estate<br />

Management.<br />

Umum<br />

General<br />

• Besaran <strong>IPK</strong> dan Uang Ja<strong>min</strong>an <strong>IPK</strong> ditetapkan berdasarkan<br />

total luas lantai masing-masing bangunan yang ada di<br />

dalam Lot atau ukuran-ukuran lain yang mencer<strong>min</strong>kan<br />

proporsi penggunaan Fasilitas Umum <strong>Kawasan</strong> <strong>SCBD</strong><br />

dalam pelaksanaan kegiatannya, dan “beban” yang<br />

dikontribusikan dari Lot atau Ruang Umum <strong>Kawasan</strong> <strong>SCBD</strong><br />

akibat pelaksanaan kegiatan.<br />

• The amount of the <strong>IPK</strong> and the <strong>IPK</strong> Deposit are deter<strong>min</strong>ed<br />

based on the total floor area of each buildings in the <strong>SCBD</strong><br />

Lots or other calculations that indicate the proportion of<br />

the Public Facility of <strong>SCBD</strong> utilization in the activity, and the<br />

“imposed load” from the <strong>SCBD</strong> Lots or <strong>SCBD</strong> Public Spaces as<br />

a result of the activity.<br />

• Uang Ja<strong>min</strong>an <strong>IPK</strong> adalah suatu dana yang wajib diberikan<br />

oleh Pemilik Lot atau Pengguna <strong>Kawasan</strong> <strong>SCBD</strong> kepada<br />

Pengelola <strong>Kawasan</strong> <strong>SCBD</strong> sebagai ja<strong>min</strong>an yang dapat<br />

digunakan apabila terjadi hal-hal yang terkait namun tidak<br />

terbatas pada cidera janji terhadap<br />

Perjanjian <strong>Pengelolaan</strong> <strong>Kawasan</strong><br />

<strong>SCBD</strong> dan/atau ketidaksesuaian/<br />

ketidakpatuhan Pemilik Lot atau<br />

Pengguna <strong>Kawasan</strong> <strong>SCBD</strong> atas<br />

ketentuan-ketentuan dalam <strong>Peraturan</strong><br />

<strong>Kawasan</strong> <strong>SCBD</strong>. Uang Ja<strong>min</strong>an <strong>IPK</strong><br />

akan digunakan untuk memulihkan<br />

setiap cidera janji terhadap Perjanjian<br />

<strong>Pengelolaan</strong> <strong>Kawasan</strong> <strong>SCBD</strong> dan/<br />

atau ketidaksesuaian/ketidakpatuhan<br />

oleh Pemilik Lot atau Pengguna<br />

tersebut di atas, serta apabila ada<br />

untuk memperbaiki setiap kerusakan<br />

Fasilitas Umum <strong>Kawasan</strong> <strong>SCBD</strong><br />

akibat kegiatan yang dilaksanakannya.<br />

“Dalam hal Pemilik<br />

Lot, Pengguna dan<br />

External Provider tidak<br />

melakukan pemulihan<br />

terhadap ketidaksesuaian/<br />

ketidakpatuhan tersebut,<br />

maka Pengelola <strong>Kawasan</strong><br />

<strong>SCBD</strong> dapat mengenakan<br />

sanksi-sanksi.”<br />

• Estate Management Fees Deposit or <strong>IPK</strong> Deposit is a fund<br />

that the Lot Owners or Users of <strong>SCBD</strong> must pay to the <strong>SCBD</strong><br />

Estate Management as a collateral for any occurrence<br />

concerning but not limited to a default on the <strong>SCBD</strong> Estate<br />

Management Agreement and/or non-conformity/noncompliance<br />

by the Lot Owners or<br />

Users of <strong>SCBD</strong> with the provisions of<br />

the <strong>SCBD</strong> Estate Regulations. The <strong>IPK</strong><br />

Deposit will be used to remedy<br />

every default on the <strong>SCBD</strong> Estate<br />

Management Agreement and/or any<br />

non-conformity/non-compliance by<br />

the Lot Owners or Users referred to<br />

above and to repair any damage to the<br />

Public Facility of <strong>SCBD</strong>, if any, resulting<br />

from the activity.<br />

• Pemilik Lot atau Pengguna wajib melakukan pembayaran<br />

atas tambahan Uang Ja<strong>min</strong>an <strong>IPK</strong> sekaligus dan seketika<br />

sejak di<strong>min</strong>ta oleh Pengelola <strong>Kawasan</strong> <strong>SCBD</strong> dalam hal :<br />

• Terdapat kenaikan <strong>IPK</strong> yang berakibat pada kenaikan<br />

uang ja<strong>min</strong>an; atau<br />

• Terdapat perubahan tahapan kegiatan pada Lot; atau<br />

• Uang Ja<strong>min</strong>an <strong>IPK</strong> yang ada telah digunakan untuk<br />

memulihkan kewajiban Pemilik Lot atau Pengguna yang<br />

tidak dipenuhi oleh Pemilik Lot atau Pengguna.<br />

• Uang Ja<strong>min</strong>an Kegiatan adalah suatu dana yang wajib<br />

diberikan oleh Pemilik Lot, Pengguna atau External Provider<br />

kepada Pengelola <strong>Kawasan</strong> <strong>SCBD</strong> sebagai ja<strong>min</strong>an atas<br />

kegiatan-kegiatan yang dilakukannya di dalam Lotnya<br />

atau di Ruang Umum <strong>Kawasan</strong> <strong>SCBD</strong>, dan dapat digunakan<br />

oleh Pengelola <strong>Kawasan</strong> <strong>SCBD</strong> untuk memulihkan setiap<br />

cidera janji terhadap Perjanjian <strong>Pengelolaan</strong> <strong>Kawasan</strong><br />

<strong>SCBD</strong> dan/atau ketidaksesuaian/ketidakpatuhan terhadap<br />

<strong>Peraturan</strong> <strong>Kawasan</strong> <strong>SCBD</strong>, dan/atau memperbaiki setiap<br />

kerusakan Fasilitas Umum <strong>Kawasan</strong> <strong>SCBD</strong> yang disebabkan<br />

oleh kegiatan-kegiatan tersebut. Uang ja<strong>min</strong>an ini akan<br />

dikembalikan kepada Pemilik Lot, Pengguna atau External<br />

• The Lot Owners or Users must settle the additional <strong>IPK</strong> Deposit<br />

immediately and in full upon the request of the <strong>SCBD</strong> Estate<br />

Management in the event of:<br />

• An <strong>IPK</strong> increase resulting in the deposit increase; or<br />

• A change of Activity (Vacant <strong>SCBD</strong> Lots, Construction/<br />

Development Activity, and <strong>SCBD</strong> Lots Operational Activity)<br />

in the <strong>SCBD</strong> Lot; or<br />

• The existing <strong>IPK</strong> Deposit has been used to recover any<br />

outstanding obligation of the Lot Owners or Users.<br />

• Activity Deposit is a fund that the Lot Owners, Users or External<br />

Providers must pay to the <strong>SCBD</strong> Estate Management as a<br />

collateral for the activities carried out in their respective <strong>SCBD</strong><br />

Lots or in <strong>SCBD</strong> Public Spaces. The <strong>SCBD</strong> Estate Management<br />

may use the deposit to remedy any default on the <strong>SCBD</strong><br />

Estate Management Agreement and/or non-conformity/<br />

non-compliance with the provisions of the <strong>SCBD</strong> Estate<br />

Regulations and/or to repair any damage to the Public Facility<br />

Provider, tanpa bunga, setelah dikurangi biaya-biaya<br />

yang dikeluarkan oleh Pengelola <strong>Kawasan</strong> <strong>SCBD</strong> jika ada,<br />

untuk memulihkan setiap cidera janji terhadap Perjanjian<br />

<strong>Pengelolaan</strong> <strong>Kawasan</strong> <strong>SCBD</strong> dan/atau ketidaksesuaian/<br />

ketidakpatuhan terhadap <strong>Peraturan</strong> <strong>Kawasan</strong> <strong>SCBD</strong>, dan/<br />

atau memperbaiki setiap kerusakan Fasilitas Umum<br />

<strong>Kawasan</strong> <strong>SCBD</strong>.<br />

• Besarnya Uang Ja<strong>min</strong>an Kegiatan yang ditetapkan oleh<br />

Pengelola <strong>Kawasan</strong> <strong>SCBD</strong> mencer<strong>min</strong>kan besaran risiko<br />

kerusakan Fasilitas Umum di Ruang Umum <strong>Kawasan</strong> <strong>SCBD</strong><br />

yang mungkin timbul akibat kegiatan-kegiatan yang<br />

dilakukan oleh Pemilik Lot, Pengguna atau External Provider.<br />

• Pengelola <strong>Kawasan</strong> <strong>SCBD</strong> sewaktu-waktu dapat mengundang<br />

Pemilik Lot, Pengguna dan External Provider, jika terindikasi<br />

adanya cidera janji terhadap Perjanjian <strong>Pengelolaan</strong><br />

<strong>Kawasan</strong> <strong>SCBD</strong> dan/atau ketidaksesuaian/ketidakpatuhan<br />

atas <strong>Peraturan</strong> <strong>Kawasan</strong> <strong>SCBD</strong>. Dalam hal Pemilik Lot,<br />

Pengguna dan External Provider tidak melakukan pemulihan<br />

terhadap cidera janji terhadap Perjanjian <strong>Pengelolaan</strong><br />

<strong>Kawasan</strong> <strong>SCBD</strong> dan/atau ketidaksesuaian/ketidakpatuhan<br />

atas <strong>Peraturan</strong> <strong>Kawasan</strong> <strong>SCBD</strong> maka Pengelola <strong>Kawasan</strong><br />

<strong>SCBD</strong> dapat mengenakan sanksi-sanksi yang diatur dalam<br />

<strong>Peraturan</strong> <strong>Kawasan</strong> <strong>SCBD</strong> ini.<br />

interest, deducted by the expenses incurred by the <strong>SCBD</strong> Estate<br />

Management, if any, to remedy every default on the <strong>SCBD</strong><br />

Estate Management Agreement and/or non-conformity/noncompliance<br />

with the <strong>SCBD</strong> Estate Regulations, and/or repair<br />

every damage to the Public Facility of <strong>SCBD</strong>.<br />

• The amount of the Activity Deposit set by the <strong>SCBD</strong> Estate<br />

Management is based on the Risk of damage to the Public<br />

Facilities in <strong>SCBD</strong> Public Spaces as a result of the activities<br />

carried out by the Lot Owners, Users or External Providers.<br />

• The <strong>SCBD</strong> Estate Management at all times may invite the<br />

Lot Owners, Users and External Providers, if any default<br />

on the <strong>SCBD</strong> Estate Management Agreement and/or nonconformity/non-compliance<br />

with the <strong>SCBD</strong> Estate Regulations<br />

is indicated. The <strong>SCBD</strong> Estate Management may impose the<br />

sanctions as stipulated in this <strong>SCBD</strong> Estate Regulations for<br />

the failure of the Lot Owners, Users and External Providers to<br />

remedy a default on the <strong>SCBD</strong> Estate Management Agreement<br />

and/or non-conformity/non-compliance with the <strong>SCBD</strong><br />

Estate Regulations.<br />

Lot atau Pengguna wajib membayar <strong>IPK</strong>-<br />

Lot, Uang Ja<strong>min</strong>an <strong>IPK</strong>, dan/atau Uang<br />

Ja<strong>min</strong>an Kegiatan.<br />

Based on the Estate Management Agreement<br />

with the <strong>SCBD</strong> Estate Management, the<br />

Lot Owners or Users are required to pay<br />

<strong>IPK</strong>-<strong>SCBD</strong> Lots, <strong>IPK</strong> Deposit, and/or Activity<br />

Umum<br />

General<br />

<strong>IPK</strong>-Lot akan digunakan oleh Pengelola <strong>Kawasan</strong> <strong>SCBD</strong> untuk<br />

membiayai pengelolaan, perawatan, pemeliharaan, dan<br />

peningkatan Fasilitas Umum di Ruang Umum <strong>Kawasan</strong> <strong>SCBD</strong>.<br />

Uang Ja<strong>min</strong>an <strong>IPK</strong>, apabila diperlukan, akan digunakan oleh<br />

Pengelola <strong>Kawasan</strong> <strong>SCBD</strong> untuk memulihkan setiap cidera<br />

janji terhadap Perjanjian <strong>Pengelolaan</strong> <strong>Kawasan</strong> <strong>SCBD</strong> dan/<br />

atau ketidaksesuaian/ketidakpatuhan terhadap <strong>Peraturan</strong><br />

<strong>Kawasan</strong> <strong>SCBD</strong> oleh Pemilik Lot atau Pengguna.<br />

Uang Ja<strong>min</strong>an Kegiatan, apabila diperlukan, akan digunakan<br />

oleh Pengelola <strong>Kawasan</strong> <strong>SCBD</strong> untuk memulihkan setiap<br />

cidera janji terhadap Perjanjian <strong>Pengelolaan</strong> <strong>Kawasan</strong><br />

<strong>SCBD</strong> dan/atau ketidaksesuaian/ketidakpatuhan terhadap<br />

<strong>Peraturan</strong> <strong>Kawasan</strong> <strong>SCBD</strong>, dan/atau memperbaiki setiap<br />

kerusakan Fasilitas Umum <strong>Kawasan</strong> <strong>SCBD</strong> yang disebabkan<br />

oleh kegiatan-kegiatan tersebut.<br />

Setiap pemasangan media promosi di dalam Lot, Pemilik<br />

Lot atau Pengguna, selain memperoleh izin dari instansi<br />

pemerintah yang berwenang sesuai dengan <strong>Peraturan</strong><br />

Perundang-undangan yang berlaku di Indonesia, wajib<br />

pula mendapat persetujuan dari Pengelola <strong>Kawasan</strong> <strong>SCBD</strong><br />

dan membayar <strong>IPK</strong>-Media Promosi Lot, yang besarannya<br />

ditetapkan oleh Pengelola <strong>Kawasan</strong> <strong>SCBD</strong>.<br />

The <strong>SCBD</strong> Estate Management will allocate the <strong>IPK</strong>-<strong>SCBD</strong> Lots<br />

for the funding of the management, treatment, maintenance<br />

and improvement of the Public Facilities in <strong>SCBD</strong> Public Spaces.<br />

The <strong>IPK</strong> Deposit will be allocated by the <strong>SCBD</strong> Estate<br />

Management for the remedy of every default on the <strong>SCBD</strong><br />

Estate Management Agreement and/or non-conformity/noncompliance<br />

with the <strong>SCBD</strong> Estate Regulations by the Lot Owners<br />

or Users, if necessary.<br />

The <strong>SCBD</strong> Estate Management will allocate the Activity Deposit<br />

for the remedy of every default on the <strong>SCBD</strong> Estate Management<br />

Agreement and/or non-conformity/non-compliance with the<br />

<strong>SCBD</strong> Estate Regulations by the Lot Owners or Users and/or<br />

repair every damage from the activity, if necessary.<br />

In addition to obtaining permit from the Authorized Government<br />

Agency in accordance with the prevailing Laws and Regulations<br />

in Indonesia, the Lot Owners or Users must obtain the approval<br />

of the <strong>SCBD</strong> Estate Management and pay the <strong>IPK</strong>-<strong>SCBD</strong> Lots<br />

Promotional Media for every promotional media installation in<br />

the <strong>SCBD</strong> Lots. The amount of the <strong>IPK</strong> is deter<strong>min</strong>ed by the <strong>SCBD</strong><br />

Estate Management.<br />

2.1.4 Media Promosi di dalam Lot<br />

a. Pemilik Lot atau Pengguna wajib membayar <strong>IPK</strong>-<br />

Media Promosi Lot kepada Pengelola <strong>Kawasan</strong><br />

<strong>SCBD</strong> untuk setiap pemasangan media promosi<br />

atau papan informasi yang memuat materi<br />

komersial di dalam Lot.<br />

b. Besar <strong>IPK</strong>-Media Promosi di dalam Lot<br />

ditetapkan oleh Pengelola <strong>Kawasan</strong> <strong>SCBD</strong>.<br />

2.2 IURAN PENGELOLAAN KAWASAN (<strong>IPK</strong>)<br />

RUANG UMUM KAWASAN<br />

Pemilik Lot, Pengguna atau External Provider wajib<br />

membayar <strong>IPK</strong>-Ruang Umum <strong>Kawasan</strong> untuk<br />

setiap kegiatan yang dilakukan di Ruang Umum<br />

<strong>Kawasan</strong> <strong>SCBD</strong> kepada Pengelola <strong>Kawasan</strong> <strong>SCBD</strong>.<br />

Besaran <strong>IPK</strong>-Ruang Umum <strong>Kawasan</strong> ditetapkan<br />

oleh Pengelola <strong>Kawasan</strong> <strong>SCBD</strong> sesuai dengan jenis<br />

kegiatannya di Ruang Umum <strong>Kawasan</strong> <strong>SCBD</strong>.<br />

2.2.1 Event<br />

Pemilik Lot, Pengguna atau External Provider wajib<br />

membayar <strong>IPK</strong> untuk setiap event yang dilaksanakan<br />

di dalam Ruang Umum <strong>Kawasan</strong> <strong>SCBD</strong> berdasarkan<br />

Perjanjian <strong>Pengelolaan</strong> <strong>Kawasan</strong> <strong>SCBD</strong>. Besarnya<br />

<strong>IPK</strong> dan Uang Ja<strong>min</strong>an Kegiatan Event ditetapkan<br />

oleh Pengelola <strong>Kawasan</strong> <strong>SCBD</strong> sesuai dengan jenis<br />

kegiatannya.<br />

2.2.2 Media Promosi<br />

a. Pemilik Lot atau Pengguna wajib membayar<br />

<strong>IPK</strong>-Media Promosi Ruang Umum <strong>Kawasan</strong><br />

kepada Pengelola <strong>Kawasan</strong> <strong>SCBD</strong> untuk setiap<br />

pemasangan media promosi atau papan<br />

informasi yang memuat materi komersial di<br />

dalam Ruang Umum <strong>Kawasan</strong> <strong>SCBD</strong>.<br />

b. Besar <strong>IPK</strong>-Media Promosi di Ruang Umum<br />

<strong>Kawasan</strong> <strong>SCBD</strong> ditetapkan oleh Pengelola<br />

<strong>Kawasan</strong> <strong>SCBD</strong>.<br />

2.1.4. Promotional Media in the <strong>SCBD</strong> Lots<br />

a. The Lot Owners or Users must pay the <strong>IPK</strong>-<strong>SCBD</strong><br />

Lots Promotional Media to the <strong>SCBD</strong> Estate<br />

Management for every commercial promotional<br />

media or information board installation in the <strong>SCBD</strong><br />

Lots.<br />

b. Amount of <strong>IPK</strong>-<strong>SCBD</strong> Lots Promotional Media is<br />

deter<strong>min</strong>ed by the <strong>SCBD</strong> Estate Management.<br />

2.2 ESTATE MANAGEMENT FEES (<strong>IPK</strong>) FOR<br />

<strong>SCBD</strong> PUBLIC SPACES<br />

The Lot Owners, Users or External Providers must<br />

pay the <strong>IPK</strong>-<strong>SCBD</strong> Public Spaces for every activity<br />

carried out in <strong>SCBD</strong> Public Spaces to the <strong>SCBD</strong> Estate<br />

Management. The amount of the <strong>IPK</strong>-<strong>SCBD</strong> Public<br />

Spaces is deter<strong>min</strong>ed by the <strong>SCBD</strong> Estate Management<br />

based on the type of activity carried out in <strong>SCBD</strong> Public<br />

Spaces.<br />

2.2.1 Event<br />

The <strong>SCBD</strong> Estate Management Agreement requires the<br />

Lot Owners, Users or External Providers to pay an <strong>IPK</strong> for<br />

every Event organized in <strong>SCBD</strong> Public Spaces. The <strong>SCBD</strong><br />

Estate Management deter<strong>min</strong>es the amount of the <strong>IPK</strong><br />

and Event Deposit based on the type of activity.<br />

2.2.2 Promotional Media<br />

a. The Lot Owners or Users must pay <strong>IPK</strong>-<strong>SCBD</strong><br />

Public Spaces Promotional Media to the <strong>SCBD</strong><br />

Estate Management for the installation of every<br />

promotional media or information board that<br />

contains commercial material in <strong>SCBD</strong> Public<br />

Spaces.<br />

b. The amount of the <strong>IPK</strong>-<strong>SCBD</strong> Public Spaces<br />

Promotional Media is deter<strong>min</strong>ed by the <strong>SCBD</strong><br />

Estate Management.<br />
