(b) engage any person whether by way of contract, agreement,<br />
understanding or undertaking, whether binding or<br />
otherwise, promote the sale of any tobacco product directly<br />
or indirectly.<br />
(2) Any person who contravenes subregulation (1) commits an<br />
offence and shall on conviction be liable to a fine not exceeding ten thousand<br />
ringgit or to imprisonment for a term not exceeding two years or to both.”.<br />
Amendment of regulation 8<br />
4. Subregulation 8(2) of the principal Regulations is amended by inserting after the<br />
word “years” the words “or to both”.<br />
Amendment of regulation 8A<br />
5. Regulation 8A of the principal Regulations is amended―<br />
(a) by substituting for subregulation (2) the following subregulation:<br />
“(2) The manufacturer or importer shall submit an application in<br />
writing to the Director every time there is a change to the retail selling<br />
price of any tobacco product referred to in subregulation (1) due to any<br />
increase in the retail selling price of the tobacco products.”; and<br />
(b) by deleting subregulation (5).<br />
Amendment of regulation 8C<br />
6. Regulation 8C of the principal Regulations is amended by substituting for<br />
subregulation (1) the following subregulation:<br />
“(1) The minimum cigarette price for each packet of twenty sticks<br />
cigarettes shall be RM 7.00.”.
