Within secondary market deals, contracts of investment services, deals at the
stock exchange and deals concerning investment are distinguished.
In the third stage, the contract of investment services related to contract types
as defined in the Civil Code will be regarded as innominate and atypical mixed
contracts. Regarding the fact that this type of contract is not included in the Civil
Code it cannot be termed as a typical and nominate type of contract. In addiction to
this, as this kind of deal is not identified by its own legal sources, I regard it as an
atypical and innominate contract.
One of the major goals of my thesis is to prove that the contract of investment
services contains the mixed characteristics of agency contracts, contracts of bailment,
together with contracts of consignment, providing sufficient reason for us to classify
contracts of investment as a kind of mixed contract that can be further divided into
the category of combined-typed contracts, which do not combine the characteristics
of different contracts, but are made up of separable mixed elements.
