SUMMARY<br />

This thesis examines contract types providing investment services.<br />

The first part of the thesis presents how investment services developed in the<br />

Hungarian legal system. The institution of the capital market and investment sector<br />

developed in the transition period from the centrally planned economy to the market<br />

economy, therefore I will also look at what impact the transition and the change of<br />

the regime had on the regulation of contractual relationships. It will be followed by<br />

the analysis of changes in rules concerning the subject, object and content of legal<br />

relations of investment services between 1996 and 2007, that is, till the enactment of<br />

the latest major Act.<br />

The second part of the thesis attempts to identify the traditional contract types<br />

in the deals of the capital market through their characteristic features.<br />

In my view, in the legal rules of contracts providing investment services, you<br />

can mainly identify the rules of agency contracts, consignment contracts and that of<br />

bailment contracts, therefore these contract types will be subjected to a comparative<br />

analysis. Through comparing the characteristics features of the obligation in<br />

investment services and those of the contract types mentioned before, similarities and<br />

differences will be defined.<br />

Then applying the comparative method, investment services are clearly<br />

distinguished from another major institution of the capital market, namely, the<br />

investment funds.<br />

Finally, I aim at positioning the contract of investment services in the system<br />

of contracts. In order to achieve this goal, I will feature the most considerable views<br />

concerning the classification of contracts: I present the most significant theories<br />

related to the legal judgement of mixed contracts prevailing in the first half of the<br />
