Annex I: Regulations for the prevention of pollution by oil

Regulations 4, 5

.2.6 the International Oil Pollution Prevention Certificate, when required, is endorsed to the effect

that the ship is exclusively engaged in one or more of the categories of voyages specified in

paragraphs 5.2.1 and 5.2).2 of this regu lation; and

.2.7 the quantity, time and port of discharge are recorded in the Oil Record Book.

6 The Administration may waive the requirements of regulation 28(6) for the following oil tankers if

loaded in accordance with the conditions approved by the Administration taking into account the guidelines

developed by the Organization:·

.1 oil tankers which are on a dedicated service, w ith a limited number of permutations of loading

such that all anticipated conditions have been approved in the stability information provided to the

master in accordance w ith regulation 28(5);

.2 oil tankers where stability verification is made remotely by a means approved by the Administration;

.3 oil tankers w hich are loaded w ithin an approved range of loading conditions; or

.4 oil tankers constructed before 1 January 2016 provided with approved limiting KG/GM curves

covering all applicable intact and damage stability requ irements.

Regulation 4

Exceptions

Regulations 15 and 34 of this Annex and paragraph 1.1.1 of part II -A of the Polar Code shall not apply to:

.1 the discharge into the sea of oil or oily mixture necessary for the purpose of securing the safety of

a ship or saving life at sea; or

.2 the discharge into the sea of oil or oily mixture resulting from damage to a ship or its equipment:

.2.1 provided that al l reasonable precautions have been taken after the occurrence of the damage

or discovery of the discharge for the purpose of preventing or minimizing the discharge; and

.2.2 except if the owner or the master acted either w ith intent to cause damage, or recklessly and

with knowledge that damage would probably result; or

.3 the discharge into the sea of substa nces containing oil, approved by the Administration, when

bei ng used for the purpose of combating specific pollution incidents in order to minimize the

damage from pollution. Any such discharge sha ll be subject to the approval of any Government in

whose jurisdiction it is contemplated the discharge will occur.

1 The Administration may allow any fi tting, material, appliance or apparatus to be fitted in a ship as

an alternative to that required by this Annex if such fitting, material, appliance or apparatus is at least as

effective as that required by this Annex. This authority of the Administration shall not extend to substitution

of operational methods to effect the control of discharge of oil as equivalent to those design and construction

features w hich are prescribed by regulations in this Annex.

2 The Administration which allows a fitting, material, appliance or apparatus to be fitted in a ship as

an alternative to that required by th is Annex shall communicate particulars thereof to the Organi zation for

circulation to the Parties to the Convention for their information and appropriate action, if any.
