Raül Romeva i Rueda (Verts/ALE), in writing. − To be able to better safeguard the distribution network for medicinal<br />
products it is crucial to have clear definitions not only of the scope, but also of the different actors in the supply chain.<br />
What is a falsified medicinal product? What is an active ingredient or an excipient? The Commission proposal does not<br />
provide the required clarity. The same applies for the definitions of the different actors in the chain of supply, clarifying<br />
their roles and responsibilities. It is essential to make a distinction between those actors who are already formally<br />
recognized - and which role is considered liable - and those who are outside that category, although being relevant to the<br />
liability of the distribution chain.<br />
Therefore it is important to make the distinction between traders and brokers, as well as to clarify their roles and<br />
responsibilities. The same applies for other actors, such as transporters or parallel traders. The directive should prevent<br />
confusion and should not allow any room for 'grey' areas. It should clearly identify which actors are able to operate in this<br />
domain and under which conditions. Clearer definitions will result in simpler implementation.<br />

Daciana Octavia Sârbu (S&D), in writing. − The opportunities for selling falsified medicinal products have increased<br />
rapidly in recent years. The ever-increasing risk of these medicines entering the supply chain means there is an urgent need<br />
to update the legislation. In particular, regulation of sales on the internet is notoriously difficult and can only be tackled<br />
effectively at international level. This issue was not addressed in the Commission's proposal, and the work of the ENVI<br />
committee has therefore substantially improved it by adding important safeguards for consumers who purchase medicines<br />
online. But the nature of the internet means that we cannot eliminate the risk. Consumer awareness of this risk needs to be<br />
improved, and so I welcome the inclusion of awareness-raising campaigns for the public which has been agreed as part of<br />
the compromise. The Commission is in a unique position to coordinate education campaigns for the public and must<br />
ensure that the Member States fulfil their obligations in this regard.<br />

Bart Staes (Verts/ALE), schriftelijk. − In de EU is er een zorgwekkende toename van vervalste geneesmiddelen. Ze<br />
kunnen minderwaardige, vervalste of verkeerd gedoseerde – al dan niet werkzame – bestanddelen of helemaal geen<br />
werkzame bestanddelen bevatten en vormen zo een ernstige bedreiging voor de patiënt. De directe en indirecte<br />
maatschappelijke kosten van niet-optreden bedraagt voor het bedrijfsleven zeker meer dan 10 miljard euro. Samen met de<br />
Groene fractie in het EP steun ik dit akkoord. Het past bestaande regels aan aan de tijd en introduceert<br />
veiligheidskenmerken om de identificatie, authenticatie en traceerbaarheid van het geneesmiddel te garanderen, terwijl het<br />
ook de verkoop van geneesmiddelen via het internet reguleert. Dat is één van de belangrijkste routes waarlangs vervalste<br />
geneesmiddelen op de Europese markt belanden. Naar schatting zijn geneesmiddelen die via internet worden gekocht op<br />
sites die hun werkelijke fysieke adres niet vermelden, in meer dan 50% van de gevallen vervalst.<br />
Daarom moet onderscheid worden gemaakt tussen legale postorder- of internetapotheken en de illegale distributieketen<br />
waartoe niet-gecontroleerde internetaankopen behoren. Een wettige postorderapotheek moet verbonden zijn met een wettig<br />
geregistreerde apotheek, waarbij ervoor moet worden gezorgd dat de wettige postorderapotheek voldoet aan alle wettelijke<br />
vereisten die voor apotheken in de lidstaat waar die wettelijk gevestigd zijn, van toepassing zijn.<br />

from entering the legal supply chain by increasing harmonisation, improving traceability and by ensuring that penalties are<br />
dissuasive and effective. Patient safety has to be the priority when dealing with medications.<br />

Thomas Ulmer (PPE), schriftlich. − Ich habe dem Bericht zugestimmt, weil er neue Grundlagen in der<br />
Fälschungsbekämpfung für Arzneimittel eröffnet. In Stufen werden zunächst fälschungsanfällige und später andere<br />
Arzneimittel in sicheren Verpackungen angeboten. Pharmamarketing wird durch das Verfahren der Abfrage und<br />
Lesbarkeit verhindert. Der Verbraucherschutz wird gestärkt. Die Kosten sind für die Industrie überschaubar.<br />

Viktor Uspaskich (ALDE), raštu. − Gerbiami kolegos, į ES patenkančių falsifikuotų vaistų skaičius auga kosminiu<br />
greičiu. Tai ypatingai kelia rūpestį tokioms šalims kaip Lietuva, kuri yra rytinė ES siena. Rytų <strong>Europa</strong> yra pagrindinis<br />
milijardinės vertės prekybos falsifikuotais vaistais kelias. Tai yra labai opi problema: Komisijos paskaičiavimais,<br />
kiekvienais metais 1,5 mln. dėžučių falsifikuotų vaistų yra parduodama legaliame tiekimo tinkle. Dar didesnį rūpestį kelia<br />
tai, kad kiekis išaugo beveik iki 20 %. Falsifikuoti vaistai – nebylūs žudikai. Juos platinantys žmonės yra pavojingi<br />
nusikaltėliai ir turėtų būti laikomi tokiais. Bausmės už vaistų falsifikavimą turėtų būti tokios pačios kaip ir už narkotikų<br />
kontrabandą. Tai pareikalaus geresnio koordinavimo tarp įvairių nacionalinių ir tarptautinių institucijų. Mes turime<br />
sustiprinti internetu parduodamų falsifikuotų vaistų kontrolę, nes internetas yra vienas iš pagrindinių kelių, leidžiančių<br />
falsifikuotiems vaistams patekti į europinę rinką. Anot Pasaulio sveikatos organizacijos, vienas iš dviejų internetu<br />
parduodamų vaistų yra klastotė. Aš manau, kad vienas iš mūsų prioritetų turėtų būti pastangos atkreipti visuomenės dėmesį<br />
į atsirandančią riziką perkant vaistus internetu.<br />
