NORMES JURIDIQUES ET REFERENTIELS Organisation <strong>de</strong>s Nations UniesLe 10ème Principe du Pacte Mondial (Global Compact) <strong>de</strong>s Nations Unies -2004Depuis le Global Compact Lea<strong>de</strong>rs Summit du 24 juin 2004, le Pacte Mondial, référentielvolontaire <strong>de</strong> responsabilité sociétale <strong>de</strong>s entreprises (adopté par 428 entreprises en France) ainclus un 10ème principe <strong>contre</strong> <strong>la</strong> <strong>corruption</strong>. Ce principe renvoie à <strong>la</strong> Convention <strong>contre</strong> <strong>la</strong><strong>corruption</strong> <strong>de</strong>s Nations Unies. Il engage les participants au Pacte Mondial, non seulement àrefuser l’extorsion <strong>de</strong> fonds et toute autre forme <strong>de</strong> <strong>corruption</strong>, mais aussi à développer <strong>de</strong>spolitiques et <strong>de</strong>s programmes concrets pour enrayer <strong>la</strong> <strong>corruption</strong> dans leur sphère d’influence.<strong>Les</strong> entreprises sont invitées à rejoindre les initiatives <strong>de</strong>s gouvernements, les différentsbureaux <strong>de</strong>s Nations Unies et <strong>la</strong> société civile pour créer une économie mondiale plustransparente et sans <strong>corruption</strong>. 17principe 10 du Pacte Mondial« <strong>Les</strong> entreprises sont invitées à agir <strong>contre</strong> <strong>la</strong> <strong>corruption</strong> sous toutes ses formes y compris l’extorsion <strong>de</strong> fonds et lespots-<strong>de</strong>-vin. »En Avril 2006, une étu<strong>de</strong> <strong>de</strong> l’United Nations Office on Drugs and Crimes (UNODC) surl’imp<strong>la</strong>ntation du 10ème principe : «Business against <strong>corruption</strong>, case stories and examples”dressait un état <strong>de</strong>s lieux. La partie consacrée au reporting sur <strong>la</strong> <strong>corruption</strong> souligne le faitque celui-ci ne fait pas, pour l’instant, partie <strong>de</strong>s priorités <strong>de</strong>s entreprises. Même si <strong>la</strong> majorité<strong>de</strong>s entreprises commencent désormais à formaliser une politique <strong>de</strong> <strong>lutte</strong> <strong>contre</strong> <strong>la</strong> <strong>corruption</strong>,trop peu encore ont déployé <strong>de</strong>s actions adéquates et rapportent <strong>de</strong>ssus.Convention <strong>de</strong>s Nations Unies sur <strong>la</strong> <strong>lutte</strong> <strong>contre</strong> <strong>la</strong> <strong>corruption</strong> (dite convention<strong>de</strong> Mérida) - Décembre 2005La Convention <strong>de</strong>s Nations Unies <strong>contre</strong> <strong>la</strong> <strong>corruption</strong> est le premier instrument juridiquementcontraignant à s'appliquer à l'échelle mondiale sur cette question. <strong>Les</strong> autres instrumentsexistants ont une portée régionale et sont conçus pour fonctionner dans un cadre plusrestreint. 18 Cette convention contient notamment <strong>de</strong>s dispositions sur <strong>la</strong> prévention <strong>de</strong> <strong>la</strong><strong>corruption</strong> et <strong>de</strong>s règles organisant <strong>la</strong> coopération internationale. acquis illicitement 19 . La convention a été ouverte à <strong>la</strong> signature à Merida (Mexique), le 9décembre 2003 et est entrée en vigueur le 14 Décembre 2005. Elle contient <strong>de</strong>s dispositionssur <strong>la</strong> transparence et pointe en particulier « l’accès effectif du public à l’information »:Article 13 - Participation <strong>de</strong> <strong>la</strong> sociétéChaque Etat Partie prend <strong>de</strong>s mesures appropriées, dans <strong>la</strong> limite <strong>de</strong> ses moyens et conformément aux principesfondamentaux <strong>de</strong> son droit interne, pour favoriser <strong>la</strong> participation active <strong>de</strong> personnes et <strong>de</strong> groupes n’appartenant pasau secteur public, tels que <strong>la</strong> société civile, les organisations non gouvernementales et les communautés <strong>de</strong> personnes,à <strong>la</strong> prévention <strong>de</strong> <strong>la</strong> <strong>corruption</strong> et à <strong>la</strong> <strong>lutte</strong> <strong>contre</strong> ce phénomène, ainsi que pour mieux sensibiliser le public àl’existence, aux causes et à <strong>la</strong> gravité <strong>de</strong> <strong>la</strong> <strong>corruption</strong> et à <strong>la</strong> menace que celle-ci représente. Cette participation <strong>de</strong>vraitêtre renforcée par <strong>de</strong>s mesures consistant notamment à :a) Accroître <strong>la</strong> transparence <strong>de</strong>s processus <strong>de</strong> décision et promouvoir <strong>la</strong> participation du public à ces processus;b) Assurer l’accès effectif du public à l’information;c) Entreprendre <strong>de</strong>s activités d’information du public l’incitant à ne pas tolérer <strong>la</strong> <strong>corruption</strong>, ainsi que <strong>de</strong>s programmesd’éducation du public, notamment dans les écoles et les universités;d) Respecter, promouvoir et protéger <strong>la</strong> liberté <strong>de</strong> rechercher, <strong>de</strong> recevoir, <strong>de</strong> publier et <strong>de</strong> diffuser <strong>de</strong>s informationsconcernant <strong>la</strong> <strong>corruption</strong>. Cette liberté peut être soumise à certaines restrictions, qui doivent toutefois être prescritespar <strong>la</strong> loi et nécessaires:i) Au respect <strong>de</strong>s droits ou <strong>de</strong> <strong>la</strong> réputation d’autrui;ii) À <strong>la</strong> protection <strong>de</strong> <strong>la</strong> sécurité nationale ou <strong>de</strong> l’ordre public, ou <strong>de</strong> <strong>la</strong> santé ou <strong>de</strong> <strong>la</strong> moralité publiques.Résolution 3514 <strong>de</strong> l’assemblée générale <strong>de</strong>s Nations Unies – Décembre 1975Cette résolution <strong>de</strong>s Nations Unies condamnait entre autres, toutes les pratiques <strong>de</strong> <strong>corruption</strong>,y compris les actes <strong>de</strong> <strong>corruption</strong> commis par <strong>de</strong>s sociétés transnationales. Le texte précisenotamment qu’elle interdit <strong>la</strong> <strong>corruption</strong> au sein <strong>de</strong>s entreprises transnationales :General Assembly (…) con<strong>de</strong>mns all corrupt practices, including bribery, by transnational and other corporations, theirintermediaries and other involved, in vio<strong>la</strong>tion of the <strong>la</strong>ws and regu<strong>la</strong>tions of the host countries. Organisation <strong>de</strong> Coopération et <strong>de</strong> Développement Economique (OCDE)Convention sur <strong>la</strong> <strong>lutte</strong> <strong>contre</strong> <strong>la</strong> <strong>corruption</strong> d'agents publics étrangers dans lestransactions commerciales internationales - 1999Le 21 novembre 1997, les pays membres <strong>de</strong> l'OCDE et cinq pays non membres ont adoptécette Convention ainsi que <strong>de</strong>s commentaires re<strong>la</strong>tifs. Signée à Paris le 17 décembre 1997 elleest entrée en vigueur le 15 Février 1999.
