En conséquence, l’article331.9 C.p.c. sera dorénavant appliqué par le greffier de la Cour d’appel à l’égard deces documents.C<strong>et</strong> article énonce que :« Les parties doivent reprendre possession des pièces qu’elles ont pro<strong>du</strong>ites,une fois l’instance terminée. Le contrat dans le cyberespace ouFeu le consommateurRollande Parent<strong>La</strong> Loi de protection <strong>du</strong> consommateur est désuète <strong>et</strong>mal adaptée au contrat conclu dans le cyberespace,avance M e Sylv<strong>et</strong>te Guillemard, professeure à laFaculté de droit de l’Université <strong>La</strong>val dans Le droitinternational privé face au contrat de ventecyberspatial, publié il y a quelques mois. Ellesoutient que dans le cyberespace, le consommateura laissé place à l’adhérent plus outillé <strong>et</strong>,de ce fait, ayant besoin de moins de protection.« <strong>La</strong> notion de consommation, une notion économique reprise par le droit, était utile ily a une cinquantaine d’années, quand on avait affaire à un simple indivi<strong>du</strong>passablement ignorant face à un commerçant puissant. On disait “Il y a un être fort enface d’un être faible qui a besoin d’être protégé par le droit”, fait valoir M e Guillemard.Le consommateur était faible. Il habitait le fin fond de la campagne, ne connaissaitrien <strong>et</strong> devait se déplacer pour aller ach<strong>et</strong>er une voiture dans la grande ville de<strong>Québec</strong>. Le concessionnaire chez qui il se rendait <strong>et</strong> qui avait le monopole de lamarque Y <strong>et</strong> Z savait très bien qu’une fois que l’ach<strong>et</strong>eur potentiel avait fait ses45 kilomètres à cheval, il n’allait pas repartir pour aller magasiner ailleurs. Dans cecontexte, le commerçant avait une certaine puissance sur lui. »Contrats d’adhésionAvec l’achat en ligne, la situation diffère grandement de l’achat fait en personne, faitremarquer l’avocate. Par exemple, chez Renaud Bray, l’achat d’un livre ne nécessitepas la signature d’un contrat. Par contre, sur le site d’Amazon, lors d’un tel achat, onvous invite à lire les conditions de vente <strong>et</strong> à cliquer si vous êtes disposé à lesaccepter. Dans ce dernier cas, « les précautions sont beaucoup plus grandes. Ellesprévoient notamment des façons de régler le litige, mais pas de façon judiciaire. Il y atout le service après-vente pour une machine à laver ou tout autre obj<strong>et</strong>. On vous dit :“Si vous avez une réclamation à faire, voilà où vous vous adressez.” Si le serviceaprès-vente ne vous satisfait pas, vous êtes prévenu dès le départ que la <strong>médiation</strong> estpossible. Si celle-ci échoue, il y aura l’arbitrage. Il y a toute une hiérarchie », expliqueM e Guillemard.À prendre ou à laisserLes contrats conclus par le biais <strong>du</strong> Web sont des contrats d’adhésion. « C’est àprendre ou à laisser. On ne peut pas discuter », soutient l’avocate. Le contratd’adhésion peut être plus ou moins ar<strong>du</strong> à lire, selon les sites. Ce qui pourrait donnerlieu à un litige. « Quand vous avez un hyperlien qui vous dit d’aller à tel endroit pourconnaître les conditions générales <strong>du</strong> contrat, c’est comme si on vous disait “Vousavez le contrat dans le feuill<strong>et</strong> A, <strong>et</strong> dans le feuill<strong>et</strong> B, vous avez les conditionsgénérales”. Les concepteurs des sites Web commerciaux qui s’adressent autant à desimples particuliers qu’à des commerçants doivent faire attention pour que, assezrapidement, l’ach<strong>et</strong>eur puisse prendre connaissance des conditions. On pourraitreprocher au commerçant d’avoir fait des clauses de type externe. »Est-ce bien différent des contrats hors cyberespace contenant des clauses illisibles, entout p<strong>et</strong>its caractères, incompréhensibles ? « Quand on a à dérouler des pages pourfinalement aboutir au bouton “J’accepte”, c’est comme dans un contrat papier où on aà tourner les pages. Quand je vais chez le garagiste <strong>et</strong> qu’on me présente un contrat, jene lis pas le contrat qu’on me m<strong>et</strong> sous les yeux avant d’apposer ma signature. Quandje vais sur le Web <strong>et</strong> que j’achète quelque chose, je clique, j’accepte sans lire. C’estmon problème. Au moins, le commerçant peut dire que les informations étaientdisponibles », ajoute l’avocate.L’indivi<strong>du</strong> qui décide de faire un achat par le biais d’Intern<strong>et</strong> est beaucoup mieuxinformé que celui qui se déplace d’un commerçant à l’autre dans l’espoir de trouverl’obj<strong>et</strong> qui lui convient le mieux. « Ce qui fonde une partie de la faiblesse <strong>du</strong>consommateur dans le monde traditionnel n’existe plus dans le monde virtuel. »M e Guillemard,qui a récemment vouluach<strong>et</strong>er une voiture, s’est installée à sonordinateur pour comparer quatre véhicules quil’intéressaient plus particulièrement. Elle a examiné <strong>et</strong> comparé lescaractéristiques de chacun, les garanties offertes <strong>et</strong> certains autres éléments. « J’avaisà ma disposition beaucoup d’informations. Quand je suis arrivée chez leconcessionnaire, j’étais moins ignorante que je ne l’aurais été dans le mod<strong>et</strong>raditionnel. »Même chose pour l’achat d’un livre. « Je regarde divers sites. Je fais le tour deslibraires chez moi. Je regarde leurs contrats <strong>et</strong> je fais un choix très éclairé. C’est moiqui suis forte par rapport à eux. »<strong>La</strong> force de direEn plus, dans le monde virtuel, il y a des sites d’échange d’avis de consommateurspour tel ou tel pro<strong>du</strong>it, des sites d’associations de consommateurs.
