The West German Ministries’ Reaction to the Van Gend en Loos and Costa <strong>de</strong>cision 63<br />

Division of Comp<strong>et</strong>ency 1957–1963<br />

Despite A<strong>de</strong>nauer’s domination of the early FRG, ratifying the Treaty of Rome in<br />

the German Bun<strong>de</strong>stag proved to be tricky business. In May 1957, Ewald Bucher, 26<br />

the FDP parliamentarian and later Justice Minister at the time of Van Gend en Loos<br />

and Costa, published an article concerning the constitutional problems around the<br />

transferral of national comp<strong>et</strong>encies to a supranational organisation without<br />

sufficient constitutional provisions guaranteeing basic rights and the separation of<br />

powers. The article had already prompted a heated discussion in aca<strong>de</strong>mic circles, 27<br />

and was now raised in the Bun<strong>de</strong>stag’s committee by both the SPD and FDP to<br />

attack the Treaty of Rome. Defending the government’s position, Ophüls and<br />

Carstens argued that all foreign treaties were subject to the conditions of the<br />

national constitution and that the Fe<strong>de</strong>ral Constitutional Court had previously ma<strong>de</strong><br />

this statement itself in its case law. When asked what would happen were the<br />

supranational authority to issue a <strong>de</strong>cision contrary to the Basic Law, Carstens<br />

argued strongly that the Basic Law was the final and supreme source of authority<br />

for all German government agencies and that conflicting norms would simply be<br />

unenforceable. 28 Moreover, Carstens emphasised the pragmatic approach being<br />

taken by the Foreign Office, stating that making the European level i<strong>de</strong>ntical to the<br />

national would be impossible in the face of six different national systems, and the<br />

i<strong>de</strong>a was simply to create som<strong>et</strong>hing workable at the beginning, wh<strong>et</strong>her this was<br />

congruent with national standards or not.<br />

However, the argument regarding the necessary amount of “structural<br />

congruence” 29 b<strong>et</strong>ween the national and EC constitutional or<strong>de</strong>rs was far from<br />

s<strong>et</strong>tled at this point. The principle of congruence emerged from the writings of the<br />

aca<strong>de</strong>mic Hans-Jürgen Schlochauer the previous year 30 and provoked discussion<br />

not just amongst legal specialists, but also within the administration. As early as<br />

1953, discussions b<strong>et</strong>ween the Justice ministry and the Foreign Office, again<br />

represented by Ophüls, had raised the issue of many more comp<strong>et</strong>encies being<br />

transferred to the supranational level than had been foreseen by the writers of the<br />
