Pursuant to Law n° 24/2001 of 27/4/2001, on
establishment, organization and functioning of a
health insurance scheme for government
employees (RAMA);
Pursuant to Law n° 23/2005 of 12/12/2005
establishing Military Medical Insurance (MMI)
and determining its organisation and functioning;
ADOPTS:
TITLE ONE: GENERAL PROVISIONS
Article One: Scope of this Law
This Law establishes and determines the
organisation and the management of a mutual
health insurance scheme. This Law shall
determine its functioning and beneficiaries.
Article 2: Establishment of the procedures of
mutual health insurance scheme
There is hereby established a mutual health
insurance scheme. The mutual health insurance
scheme is coordinated at the Fund which has its
headquarters at the level of each district.

TITRE PREMIER : DES DISPOSITIONS
GENERALES
Article premier: Objet de la loi
La présente loi porte création, organisation et
gestion des mutuelles de santé. Leur
fonctionnement et leurs bénéficiaires sont
déterminés par la présente loi.
Article 2: Création des mutuelles de santé
Il est créé les mutuelles de santé. Les mutuelles
de santé sont coordonnées au niveau d’un Fonds
de mutuelle de santé ayant le siège au niveau de
chaque District.

Article 3: Autonomy of mutual health
insurance Fund
The mutual health insurance Fund has a legal
personality and administrative and financial
autonomy.The mutual health insurance Fund shall
be supported by a guarantee Fund attached to the
Ministry in charge of health.
Article 4: Branches of the health insurance
Fund
The mutual health insurance Fund in each District
is composed of branches which are at the level of
health centres.
Article 5: Definitions of terms
For the purpose of this law, the following words
shall be defined as follows:
1° Health insurance Scheme: solidarity system
in which persons mutually come together with
their families and pay contributions for the
purpose of protection and receiving medical
care in case of sickness;

Le Fonds de mutuelle de santé est doté de la
personnalité juridique et de l’autonomie
administrative et financière. Le Fonds de
mutuelle de santé est renforcé par le Fonds de
garantie attaché au Ministère ayant la santé dans
ses attributions
Article 4: Sections du Fonds de mutuelle de
santé
Le Fonds de mutuelle de santé de chaque
District est constitué de sections de mutuelle de
santé au niveau des centres de santé.
Article 5: Définitions des termes
Au sens de la présente loi, les termes suivants
sont définis comme suit :
1° Mutuelle de santé : système d’entraide
mutuelle entre des personnes qui, au moyen
des cotisations versées pour elles- mêmes et
leurs familles s’organisent en vue d’une
prévention et d’obtention en cas de maladie
de soins médicaux;

2° Umunyamuryango: umuntu

cy’ubwisungane mu kwivuza;
2° member: registered person in mutual health
insurance scheme who regularly pays the
subscription or whose subscription is annually
paid for by others;
3° contribution: amount paid for by a member
in the mutual health insurance scheme;
4° deterrent fee: amount of money paid for by
a member of a mutual health insurance
scheme after receiving medical care. It is paid
in consideration of a percentage determined
by the Minister in charge of health.
5° primary care: acts relating to treatment and
immunisation carried out at the level of the
health centres and at private health
establishments that conclude a contract with
the mutual health insurance Fund.
2° Affilié : personne enregistrée dans une
mutuelle de santé et dont les cotisations sont
payées chaque année par elle ou par les
tiers ;
3° Cotisation: somme versée par une personne
affiliée à la mutuelle de santé ;
4° Ticket modérateur: somme d’argent versée
par une personne affiliée à la mutuelle de
santé après avoir bénéficié des soins
médicaux. Cette somme est versée sur la
base du pourcentage fixé par le Ministre
ayant la santé dans ses attributions;
5° Soins primaires: soins curatifs et préventifs
dispensés au niveau des centres de santé et
au niveau des établissements de santé privés
ayant signé un contrat avec le Fonds de
mutuelle de santé.

CHAPTER ONE: RESPONSIBILITIES
Article 6: Responsibilities of the mutual health
insurance Fund
The main responsibilities of the mutual health
insurance Fund are as follows:
1° paying for medical services provided to
members and their insured members;
2° receiving contributions of its members and
various aids;
3° registering members and providing them with
cards;
4° training persons in charge of mutual health
insurance scheme branches;
5° carrying out evaluation of performance of the
mutual health insurance scheme branches;
6° sensitising the population on joining the
mutual health insurance scheme;
7° training the members of the committees of the
mutual health insurance scheme of the
Villages, Cells and Sectors levels;
8° gathering and computerising documents
indicating:

Article 6: Missions du Fonds de mutuelle de
santé
Les principales missions du Fonds de
mutuelle de santé sont les suivantes:
1° payer les soins médicaux offerts aux
affiliés et à leurs ayants droit;
2° percevoir les cotisations des affiliés et les
dons divers ;
3° enregistrer les affiliés dans les registres
prévus à cet effet et leur donner des cartes ;
4° assurer la formation des gestionnaires de
sections des mutuelles de santé ;
5° faire l’évaluation des performances de
sections des mutuelles de santé ;
6° sensibiliser la population aux mutuelles de
santé ;
7° assurer la formation des membres de
comités des mutuelles de santé au niveau de
Villages, de Cellules et de Secteurs;
8° constituer une base de données des
documents faisant état de:

mutual health insurance scheme. There shall be
concluded a contract of performance between the
mutual health insurance Fund and the District
representing the Ministry of health indicating
powers, rights and the responsibilities of each

The mutual health insurance Fund shall be
directed by a Board in charge of taking decisions
which is referred to as the ‘Board of Directors’
which has full powers and permanent
responsibilities of managing the activities of the
mutual health insurance Fund, its personnel and its
property in order to fulfil its responsibilities.

Directors
The Board of Directors is responsible for:
1° providing the strategic vision and the plan of
action;
2° advising on the mutual insurance health
scheme policy;

and regulations of the mutual insurance health

Article 11: Appointment of the members of the
Board of Directors and their term of office
The Board of Directors is comprised of seven (7)
persons appointed and removed by an Order of
the Minister in charge of health. They are
designated in accordance with knowledge and
experience they posess. At least thirty (30)
percent of its members shall be women.
They have a term of three (3) years which may be
renewable only once. The Board of Directors
shall be composed of the following persons:
1° a district representative;
2° two (2) representatives of the branches of the
mutual health insurance scheme operating in
the district;
3° a representative of associations operating in a
district;
4° a representative of religious denominations;
5° a representative of health care establishments
collaborating with the mutual health
insurance Fund of the District;
6° a representative of Sectors.

leurs connaissances et leur expérience. Trente

Conseil d’Administration sont du sexe féminin.
Leur mandat est de trois (3) ans renouvelable
une seule fois. Le Conseil d’Administration est
composé de personnes suivantes :
1° un représentant du District ;
2° deux (2) représentants des sections de
mutuelle de santé oeuvrant dans le District ;
3° un représentant des associations oeuvrant
dans le District ;
4° un représentant des confessions religieuses ;
5° un représentant des établissements de santé
qui collaborent avec le Fonds de mutuelle
de santé du District ;
6° un représentant des Secteurs.

Article 12: Board of Directors and reasons for
removal of a member
The Board of Directors is directed by a
Chairperson appointed by an Order of the
Minister in charge of health and who shall be
deputised by the Vice Chairperson elected by the
members of the Board of Directors in their first
meeting.
A member of the Board of Directors may leave
such an office due to the following reasons:
1° if the term of office expires;
2° if he or she resigns in writing;
3° if he or she is no longer able to perform his or
her duties due to physical or mental disability
certified by an authorized medical doctor;
4° if he or she is assigned other duties;
5° if he or she is definitively sentenced to a term
of imprisonment equal to or exceeding six (6)
months without suspension ;
6° he or she is absent in meetings for three (3)
consecutive times in a year with no justified
reasons;
7° it is clear that he or she no longer fulfils the
requirements considered at the time of his or
her appointment in the Board of Directors;
Article 12: : Conseil d’Administration et

6° trois (3) absences consécutives dans une
année aux réunions sans raisons valables ;

8° he or she demonstrates behaviours contrary to
his or her responsibilities;
9° he or she jeopardises the interests of the
mutual health insurance scheme;
10° he or she confesses and pleads guilty of the
crime of genocide;
11° he or she dies.
Article 13: Invitation and holding of the Board
of Directors meeting and its rapporteur
The Board of Directors shall be held once in a
term in presence of at least four (4) out of seven
(7) of its members. Its Chairperson or Vice
Chairperson in case of absence of the Chairperson,
shall convene it at least fifteen (15) days before it
is held.
It may be convened in its extraordinary meeting if
considered necessary, at the invitation of its
Chairperson at own initiative, or upon request in
writing by a third (1/3) of its members at least five
(5) days before it is held.
The Director of the mutual health insurance Fund
shall attend the meetings of the Board of Directors
and serve as the rapporteur but does not vote. The
Director of the mutual health insurance Fund
shall not attend meetings of the Board of Directors
if an issue that concerns him or her is under
examination; in that case, the Board of Directors
shall elect from among itself a rapporteur.

par le Vice-Président, au moins quinze (15) jours
avant la tenue de la réunion.
Il peut se réunir en session extraordinaire en cas
de besoin, sur convocation du Président, de sa
propre initiative ou sur demande écrite d’un tiers
(1/3) de ses membres, au moins cinq (5) jours
avant la tenue de la réunion.
Le Directeur du Fonds de mutuelle de santé
participe aux réunions du Conseil
d’Administration et en est le rapporteur, mais
n’a pas le droit de vote. Il ne participe pas aux
réunions du Conseil d’Administration lorsqu’il
s’agit de l’examen d’une question le
concernant ; dans ce cas, le Conseil
d’Administration élit un rapporteur en son sein.

Article 14: Taking Decisions by the Board of
Directors
Decisions of the Board of Directors shall be taken
through consensus of its members present in the
meeting; failure to do so, it shall be done through
voting. In case of failure of achieving the majority
vote, the Chairperson’s vote shall settle the
dispute.

of the Board of Directors

The members of the Board of Directors shall be
entitled to sitting allowances if they attend the
meeting of the Board of Directors. An Order of the
Minister in charge of health shall determine such
an allowance.
Article 16: Use of experts
The Board of Directors may seek assistance from
the experts when it examines an issue that requires
special expertise. The powers of the expert in the
expertise shall only relate to what has been
required.

The daily management of the mutual health
insurance Fund is entrusted to its Director who is
appointed by an Order of the Minister in charge of
health after successfully passing the test organised
by the District in conjunction with the Ministry of
health. He or she shall also be remunerated by the
mutual health insurance Fund.

The benefits of the Director and the personnel of
the mutual health insurance Fund shall be
determined by the general statute governing
Rwanda public servants, and it shall be
remunerated by the mutual health insurance Fund
of the District of their operation.
Section 3: Management and property

de santé est déterminé par Arrêté du Ministre
ayant la santé dans ses attributions.

insurance scheme branches;
3° evaluating the mutual health insurance
scheme turn up at the Sector level;

Mutual health insurance scheme affiliated
members shall seek medical care from public
hospitals and private health care establishments
which contracted with the mutual health insurance
Fund in the District in which they operate.
They may, however, seek medical care from any
health care establishment that collaborates with
mutual health insurance scheme in case they have
fallen sick in such a place where the health care
establishment is situated.
With exception of emergency case, a patient shall
benefit from medical care of the second and the
third category hospitals if he or she has a transfer
note.
An Order of the Minister in charge of health shall
determine the categories of hospitals.
Les affiliés aux mutuelles de santé bénéficient
des prestations médicales au niveau des
établissements de santé publics et privés ayant
conclu un contrat de service médical avec le
Fonds de mutuelle de santé du District dans
lequel ces établissements exercent leurs
activités.
Ils peuvent également bénéficier des prestations
médicales dans tout établissement de santé qui
collabore avec la Mutuelle de santé lorsqu’ils
tombent malades étant dans le District dans
lequel se trouve cet établissement.
A l’exception d’un cas d’urgence, le patient ne
bénéficie des soins médicaux dans les hôpitaux
de deuxième et de troisième catégories que sur
transfert médical.
Un Arrêté du Ministre ayant la santé dans ses
attributions détermine les catégories des
hôpitaux.

Article 30: Medical services covered and those
not covered by the mutual health insurance
Fund
The mutual health insurance Fund shall cover
medical services provided in health care
establishments with which it has concluded the
agreement.
It shall also cover the medicine approved in such
medical services.
The medical services which shall be covered are:
1° vaccination;
2° consultations;
3° medical surgery;
4° dental care;
5° medical radiology and scanning;
6° laboratory tests;
7° physiotherapy;
8° hospitalization;
9° supplying medicine that is on the list accepted
by mutual health insurance scheme;
10° providing pre-natal, perinatal or post natal
care;
11° ambulance fee ;
12° provision of prosthesis and orthosis not
exceeding the value approved by the mutual

Le Fonds de mutuelle de santé assure le
remboursement des prestations médicales
effectuées dans les établissements de santé ayant
conclu un contrat avec lui.
Il assure également l’achat des médicaments

The mutual health insurance scheme shall not
cover the following medical services:
1° medical certificate that is not related to the
medical sevices;

3° plastic surgery in case it is not as a result of
an accident;
4° sex change surgery;
5° occupational diseases and accidents.

Article 32: Period on which a new born baby
benefits from the parent’s health insurance
services
Notwithstanding the provisions of Article 35 of
this Law, a new born baby, if less than three (3)
months, shall be catered for on its parent’s health
insurance. Where the baby is more than three (3)
months old, the subscription to be paid shall be
equivalent to the remaining months of year.
TITLE IV: MEMBERS AND THE
REQUIREMENTS
Article 33: An obligation to hold a health
insurance
Every person who resides in Rwanda shall be
obliged to join the mutual health insurance
scheme.

A foreigner, who enters on the Rwandan territory
shall, in a period not exceeding fifteen (15) days,
join a health insurance scheme.
Article 34: Commencement of membership
Membership shall be effective as of the time all
the required subscription fee is paid.
Article 35: Payment of subscription fee and
validity of access to medical services
A member shall pay his or her annual subscription
fee irrespective of whether he or she benefited
from medical care services.
A member who joins the mutual health insurance
scheme for the first time shall start benefiting from
medical care services thirty (30) days after he or
she pays the subscription fee.
The member shall renew his or her insurance
before the year ends. However, he or she shall
continue to receive medical care services for thirty
days (30) after the expiry of the insurance.
Tout étranger entrant sur le sol du territoire de la
République du Rwanda doit également avoir une
assurance maladie dans un délai ne dépassant
pas quinze (15) jours.
Article 34: Début d’affiliation
La qualité d’affilié commence aussitôt que la
cotisation est versée.
Article 35: Versement de la cotisation et
période de validité des prestations y relatives
L’affilié est tenu de verser sa cotisation chaque
année quand bien même il n’aurait pas bénéficié
de soins médicaux.
Tout affilié qui souscrit à la Mutuelle de santé
pour la première fois bénéficie des soins
médicaux après trente (30) jours comptés à partir
du versement de la cotisation.
L’affilié est tenu de renouveler son assurance
avant la fin de l’année. Toutefois, il continue de
bénéficier des soins médicaux dans un délai ne
dépassant pas trente (30) jours après l’expiration
de l’assurance.

Article 39: Basic contribution and modalities of
payment
The basic subscription fee of the members and the
modalities of its payment shall be determined by
an Order of the Minister in charge of health.
Article 40: Deterrent fee
Any member who benefits from medical care
services shall pay a deterrent fee. An indigent
with a due certificate from the administration shall
have his or her deterrent fee paid. The percentage
of the deterrent fee and the person responsible for
payment for the indigent shall be determined by an
Order of the Minister in charge of health.
Section 3: The property of the National
Guarantee Fund of the mutual health
insurance scheme
Article 41: Establishment of the National
Guarantee Fund of mutual health insurance
scheme
There is hereby established a National Guarantee
Fund of the mutual health insurance scheme,
which shall be under the Ministry of Health, with
its personnel and which is audited by an Auditing
Committee.
Article 39: Cotisation de base des affiliés et

La cotisation de base des affiliés et les modalités
de son paiement sont déterminées par arrêté du
Ministre ayant la santé dans ses attributions.
Article 40: Ticket modérateur
Tout affilié bénéficiant des soins médicaux
supporte le ticket modérateur. Un affilié
nécessiteux muni d’une attestation délivrée par
une autoritée administrative est exempt de
paiement de ticket modérateur. Le taux du
ticket modérateur et le responsable du paiement
du ticket modérateur pour les nécessiteux sont
déterminés par Arrêté du Ministre ayant la santé
dans ses attributions.

Article 41: Mise en place du Fonds National
de Garantie des mutuelles de santé
Il est institué un Fonds National de Garantie des
mutuelles de santé attaché au Ministère de la
Santé ; le Fonds est doté de son propre
personnel et il est contrôlé par un Comité
d’Audit.

mutual health insurance scheme shall be appointed
and managed in accordance with the general
statute governing Rwanda Public Service.
Article 42: Source of the property of National
Guarantee Fund of the mutual health insurance
scheme
The property of the National Guarantee Fund of
the mutual health insurance scheme shall come
from:
1° grants from the Health Insurance Scheme for
Government and Private Sector employees
(RAMA) which is equivalent to one per cent
(1%) of the monthly income;
2° grants from the Military Medical Insurance
(MMI) which is equivalent to one percent
(1%) of the monthly income;
3° the allocation which is equivalent to thirteen
per cent (13%) of the ordinary annual budget
of the Ministry of Health;
4° grants from each of the health insurance
companies operating in the country which is
equivalent to one per cent (1%) of the
monthly income;
5° grants from donors;
Le personnel du Fonds National de Garantie des
mutuelles de santé est nommé et géré
conformément aux dispositions des lois relatives
à la fonction publique.
Article 42: Source du Fonds National de

The Government shall, on an annual basis, review
the amount of money to make sure the mutual
health insurance scheme runs properly.
Article 43: Use of finance of National
Guarantee Fund of the mutual health insurance
scheme
The finance of the National Guarantee Fund of
mutual health insurance scheme shall be used in
the following:
1° paying medical care services provided to
members of the mutual health insurance
scheme benefited from the referral hospitals;
2° assisting the mutual health insurance scheme
which went bankrupt due to various reasons;
3° allocating grants to mutual health insurance
Funds of the Districts;
4° assisting the mutual health insurance Funds in
the clearance of bills for medical treatment
provided to their respective members at health
facilities which have no existing contract with
mutual health insurance Funds they are
members .
Le Gouvernement devra, chaque année,
s’assurer de la suffisance de ces fonds en vue du
bon fonctionnement des mutuelles de santé.
Article 43: Utilisation des fonds du Fonds
National de Garantie des mutuelles de santé
Les fonds du Fonds National de Garantie des
mutuelles de santé sont utilisés aux fins
suivantes :
1° payer les factures des soins médicaux des
affiliés aux mutuelles de santé qui ont
bénéficié des soins médicaux dans des
hôpitaux nationaux de référence ;
2° venir en aide aux mutuelles de santé en
difficulté financière due à différents
facteurs ;
3° accorder des subventions aux Fonds de
mutuelle de santé des Districts ;
4° aider les Fonds de mutuelle de santé à
effectuer des compensations pour soins
médicaux obtenus par leurs affiliés auprès
des établissements sanitaires sans contrat
conclu avec les Fonds auxquels ils sont
affiliés.

Article 46: First meeting and functioning of the
audit committee of National Guarantee Fund
of the mutual health insurance scheme
The first meeting of the audit committee of
National Guarantee Fund of the mutual health
insurance scheme shall be convened and presided
over by the Minister in charge of health. The
committee shall elect among its members a
chairperson, a Vice-chairperson and a Rapporteur.
The rules and regulations of the auditing
committee shall determine its functioning.

Article 47: Responsibilities of the Audit
Committee
The Audit Committee shall be responsible for:
1° adopting the draft of internal rules and
regulations of National Guarantee Fund of the
mutual health insurance scheme to be
approved by the Minister in charge of health;
2° adopting and transmitting the draft annual
budget proposal to the Ministry in charge of
health;
3° examining and approving financial quarterly
and annual reports and submitting them to the
Minister in charge of health;
4° endorsing hospital bills paid to the hospitals at
the national level;
5° determining funds to be allocated to mutual
health insurance Funds ;
6° examining and approving grants to be
allocated to a mutual health insurance scheme
branch;
7° supervising the performance of the personnel
of the National Guarantee Fund of the mutual
health insurance scheme and submitting the
report to the Minister in charge of health;

Board of Directors.

Financial audit of the mutual health insurance
Fund shall be carried out in respect of rules

If the Office of the Auditor General of State
Finances carries out audit, a report and its copy
shall be submitted according to provisions of the
law establishing the Office of the Auditor General
of State Finances.
If audit is carried out by District internal Auditor
as well as the external auditors, the report shall be
submitted to the Board of Director, and copies
shall be reserved to the Minister in charge of
health and the District Mayor.
TITLE VI: CONTRACTS
Article 55: Contracts relating to medical
activities the mutual health insurance Fund, the
National Guarantee Fund of mutual health
insurance scheme conclude with hospitals and
pharmacies
The mutual health insurance Fund and National
Guarantee Fund of the mutual health insurance
scheme shall conclude with hospitals and
pharmacies contracts in relation with medical care
services provided to their affiliated members.
The format of such contracts mentioned in this
Article shall be determined by an Order of the
Ministry in charge of health.

Article 55: Conventions de prestations

sanitaires et les pharmacies
Le Fonds de mutuelle de santé et le Fonds
National de Garantie des mutuelles de santé
concluent, avec des établissements sanitaires et
des pharmacies, des conventions de prestations
médicales en faveur des affiliés.
La nature des conventions visées au présent
article est déterminée par Arrêté du Ministre
ayant la santé dans ses attributions.

health centres or private hospitals and
Pharmacies
The mutual health insurance scheme branches
shall conclude agreements with public health
centers or private hospitals and pharmacies in
order for the members to receive medical care or
receive medicine which is not available in the
health centers.
The format of such agreements mentioned in this
Article shall be determined by an Order of the
Minister in charge of health.
TITLE VII: ARBITRATION AND
SANCTIONS
Article 57: Arbitration committee, members
and its functioning
Before any litigation relating to the decision taken
or any other act carried out in the mutual scheme
is filed by a member or any other person to the
Courts of Law, shall be referred to the arbitration
committee. The Board of Directors of the mutual
health insurance Fund shall elect among itself the
following members who compose the arbitration
committee:
Article 56: Conventions conclues entre les

Le contenu des conventions visées au présent
article est déterminé par Arrêté du Ministre
ayant la santé dans ses attributions.
TITRE VII : DE L’ARBITRAGE ET DES
SANCTIONS
Article 57: Comité d’arbitrage, sa
composition et son fonctionnement
Un affilié ou toute autre personne doit, avant de
saisir la juridiction pour examen d’une décision
prise ou de tout autre acte commis dans une
mutuelle de santé, soumettre son litige au
Comité d’Arbitrage. Le Conseil
d’Administration d’un Fonds de mutuelle de
santé élit en son sein les membres du Comité
d’Arbitrage suivants:

1° uhagarariye Akarere;
2° uhagarariye amashami y’ubwisungane
mu kwivuza akorera mu Karere;
3° uhagarariye amavuriro akorana n’Ikigo
cy’ubwisungane mu kwivuza.

y’ubwumvikane.
Ingingo ya 58: Uko impaka hagati y’Ikigo

collaborate with mutual health insurance
Fund.
The Board of Directors shall set up instructions
governing the functioning of the arbitration
Committee.
Article 58: Modalities of settling disputes
between the mutual health insurance Fund, the
National Guarantee Fund and the contracting
parties
Disputes between the mutual health insurance
Fund , the National Guarantee Fund and the
contracting parties shall be mutually settled by
consensus. In case consesus is not obtained,
arbitration tribunal as provided by the law shall be
referred to.
In case there is any party that is not satisfied with
the decisions of the arbitration tribunal, the
dispute shall be referred to the competent courts.

Tout litige entre un Fonds de mutuelle de santé,
le Fonds National de garantie et les tiers
contractants est réglé à l’amiable. A défaut de
compromis, les parties saisissent le tribunal
d’arbitrage dans les formes prévues par la loi.
Lorsque l’une des parties n’est pas satisfaite de
la sentance arbitrale, le litige est porté devant les
juridictions compétentes.

Article 59: Settlement of conflicts arising from
inspection
Conflicts arising from medical inspection
involving a medical doctor, a medical assistant
and a pharmacist due to faults or any other fraud
in providing an affiliated member with medical
care services, or conflicts that may arise from the
implementation or interpretation of instructions
based on this Law and the documents enforcing it,
shall be mutually settled. In case consesus is not
obtained, the conflict shall be referred to the
arbitration committee as provided for by the law.
In case there is any party that is not satisfied with
the decisions of the arbitration tribunal, the
conflict shall be referred to the competent courts.
Article 60: Not holding mutual health
insurance or inciting others not to participate
in the mutual health insurance scheme
Any person who is not included in destitutes that
are supposed to be assisted and does not hold
mutual health insurance shall be liable to pay a
fine of between five thousand Rwandan francs
(5.000 Rwf) and ten thousand Rwandan francs
(10.000 Rwf).
Article 59: Règlement de litige lié à
l’inspection
Le litige sur l’inspection impliquant un
médecin, un assistant médical et un pharmacien
à la suite des erreurs médicales ou de toute autre
fraude basée sur la prestation de soins au profit
d’un affilié ou tout litige pouvant résulter de
l’application ou de l’interprétation des
instructions découlant de la présente loi est
résolu à l’amiable. A défaut d’accord amiable,
le litige est porté devant le tribunal d’arbitrage
prévu par la loi. Lorsque l’une des parties n’est
pas satisfaite de la sentence arbitrale, le litige est
porté devant les juridictions compétentes.
Article 60: Défaut d’affiliation à l’assurance
maladie ou incitantation à la non affiliation
Sera puni d’une amende de cinq mille francs
rwandais (5.000 Frw) à dix mille francs
rwandais (10.000 Rwf), quiconque, ne rentrant
pas dans la catégorie des nécessiteux, ne se sera
pas affilié à une mutuelle de santé.

Ingingo ya 61: Umucungamutungo wakoze
ibyaha
Ahanwa hakurikijwe amategeko yo mu gitabo
cy’amategeko ahana n’agenga icungamutungo
rya Leta, umucungamutungo wese :
1° wakoresheje nabi cyangwa wanyereje
umutungo w’ubwisungane mu kwivuza
kubera inyungu ze cyangwa se agamije
guteza imbere ibigo afitemo inyungu;
2° wasohoye nkana inyandiko
z’icungamutungo cyangwa se raporo
agamije gusebya ubwisungane mu
kwivuza;
3° wahaye ibisubizo bitari byo intumwa ya
Minisiteri ishinzwe ubwisungane mu
kwivuza, n’abagenzuramutungo;
Any person who incites people not to join mutual
health insurance scheme shall be liable to an
imprisonment of between seven (7) days and
ninety (90) days and to pay a fine of between fifty
thousand Rwandan francs (50.000 Frws) and two
hundred thousand Rwandan francs (200.000 Frws)
or one of the two penalties.
Article 61: Manager who commits offences
Any property manager who is guilty of one of the
following offences shall be punished in
accordance with the provisions of the criminal
Code and Laws on public property management:
1° mismanagement or embezzlement the
resources of the mutual health insurance
scheme due to his or her own interests or for
the purpose of promoting companies he or she
is interested in;
2° deliberate release of accounts documents or
reports with an intention of tarnishing the
image of mutual health insurance scheme;
3° provision of false responses to the agent of
the Ministry in charge of mutual health
insurance scheme and to the auditors;
Sera puni d’une peine d’emprisonnement allant
de sept (7) à quatre-vingt-dix (90) jours et d’une
amende de cinquante mille francs rwandais
(50.000 Frw) à deux cent mille francs rwandais
(200.000 Frw) ou de l’une de ces peines,
quiconque aura incité les autres à ne pas
s’affilier à la mutuelle de santé.
Article 61: Gestionnaire en infractions
Sera puni conformément aux dispositions du
Code pénal et à celles relatives à la gestion des
finances publiques, tout gestionnaire qui :
1° se sera rendu coupable de la mauvaise
gestion ou du détournement des fonds de la
mutuelle de santé à des fins d’intérêt
personnel ou à des fins d’enrichir les
sociétés où il détient des intérêts;
2° aura publié délibérément les documents
comptables ou des rapports en vue de ternir
l’image de la mutuelle de santé ;
3° se sera rendu coupable de fausses
déclarations à un délégué du Ministère
ayant les mutuelles de santé dans ses
attributions et aux auditeurs ;

1° Umunyamuryango ufatwa yatije ikarita ye
utari umunyamuryango cyangwa yakoresheje
ikarita yarengeje igihe;
2° Umunyamuryango ukora ubundi buriganya
bushobora guhombya ubwisungane mu
kwivuza.
Ingingo ya 63: Umukozi ukora mu ivuriro
cyangwa farumasi ukora uburiganya.
Bitabangamiye andi mategeko, ahanishwa
igifungo cy’iminsi cumi n’itanu (15) kugera ku
minsi mirongo cyenda (90) n’ihazabu
y’amafaranga kuva ku bihumbi ijana (100.000
Frw) kugeza ku bihumbi magana abiri
(200.000 Frw) cyangwa kimwe muri ibyo
bihano:
4° provision of a false or an incomplete report in
order to keep benefiting from the Government
assistance.
Article 62: Member who fraudulently uses a
member’s card
Shall be liable to the payment of a fine of between
five thousand Rwandan francs (5.000 Rwf) and
twenty thousand Rwandan francs (20.000 Rwf):
1° an affiliated member who shall lend his or her
card to a non member or one who shall use an
expired card;
2° an affiliated member who uses another fraud
which may cause bankruptcy to mutual health
insurance scheme.
Article 63: Hospital or Pharmacy member of
staff who commits fraud
Without prejudice to other laws, the following
persons shall be liable to an imprisonment of
between fifteen (15) days and ninety (90) days and
a fine of between one hundred thousand Rwandan
francs (100.000 Rwf) and two hundred thousand
Rwandan francs (200.000 Rwf) or one of the two
penalties:
4° aura fourni un rapport falsifié ou incomplet
en vue de continuer de bénéficier des
subventions de l’Etat.
Article 62 : Affilié coupable d’utilisation
frauduleuse de la carte
Sera puni d’une amende de cinq mille francs
rwandais (5.000 Frw) à vingt mille francs
rwandais (20.000 Frw) :
1° l’affilié qui aura prêté sa carte
d’affiliation à un non affilié ou aura
utilisé une carte dont la durée a expiré ;
2° l’affilé s’étant rendu coupable de toute
autre fraude susceptible de contribuer à
la faillite d’une mutuelle de santé.
Article 63 : Agent d’un établissement
sanitaire ou d’une pharmacie reconnu
coupable de fraude
Sans préjudice de la législation en vigueur, sera
puni d’un emprisonnement de quinze (15) à
quatre-vingt-dix (90) jours et d’une amende de
cent mille francs rwandais (100.000 Frw) à deux
cent mille francs rwandais (200.000 Frw) ou de
l’une de ces peines:

1° a staff member from a hospital or a pharmacy
who prepares an invoice with an intention of
causing bankruptcy to mutual health insurance
scheme;
2° a staff member from a hospital or a pharmacy
who collaborates with an affiliated member in
commiting fraud which may cause bankruptcy
to mutual health insurance scheme;
3° a staff member from a hospital or a pharmacy
who collaborates with a manager of mutual health
insurance scheme in commiting fraud with an
intention to cause bankruptcy to the medical
scheme.
TITLE VIII: TRANSITIONAL AND FINAL
PROVISIONS
Article 64: Time limit for persons mentioned in
Article 33 to have complied with provisions of
this Law
Without prejudice to Paragraph 2 of Article 33 of
this Law, persons referred to in that Article are
given a period of three (3) months from the date
this Law shall be published in the Official Gazette
of the Republic of Rwanda in order for them to
comply with provisions of this Law.
1° un agent d’un établissement sanitaire ou
d’une pharmacie qui aura établi une facture
en vue de contribuer à la faillite d’une
mutuelle de santé ;
2° un agent d’un établissement sanitaire ou
d’une pharmacie qui, en complicité avec un
affilié, se sera rendu coupable d’une fraude
susceptible de contribuer à la faillite d’une
mutuelle de santé ;
3° un agent d’un établissement sanitaire ou
d’une pharmacie qui, en complicité avec un
gestionnaire de la mutuelle de santé, se sera
rendu coupable d’une fraude visant à
contribuer à la faillite d’une mutuelle de
santé.
TITRE VIII: DES DISPOSITIONS
TRANSITOIRES ET FINALES
Article 64: Délai imparti aux personnes
visées à l’article 33 pour remplir les
conditions prévues par la présente loi
Sous réserve de l’alinéa 2 de l’article 33 de la
présente loi, les personnes visées audit article
disposent d’un délai de trois (3) mois à dater de
la publication au Journal Officiel de la
République du Rwanda de la présente loi pour se
conformer aux dispositions prévues par la
présente loi.

Iri tegeko ritangira gukurikizwa ku munsi
ritangarijweho mu Igazeti ya Leta ya
Repubulika y’u Rwanda.
Article 65: Destiny of former property of the
mutual health insurance scheme
All the former property of the mutual health
insurance scheme is given to the mutual health
insurance scheme branch, the mutual health
insurance Fund or National Guarantee Fund of
the mutual health insurance scheme in accordance
with the former organ that held the property.
Article 66: Abrogating provision
All previous legal provisions contrary to this Law
are hereby repealed.
Article 67: Commencement
This Law shall come into force on the date of its
publication in the Official Gazette of the Republic
of Rwanda.
Article 65: Affectation de l’ancien patrimoine
des mutuelles de santé
Tout l’ancien patrimoine des mutuelles de santé
est transféré, selon le cas, à la section de
mutuelle de santé, au Fonds de mutuelle de santé
ou au Fonds National de Garantie de mutuelle
de santé selon la position de l’ancien
propriétaire.
Article 66: Dispositions abrogatoire
Toutes les dispositions légales antérieures
contraires à la présente loi sont abrogées.
Article 67: Entrée en vigueur
La présente loi entre en vigueur le jour de sa
publication au Journal Officiel de la République
du Rwanda.

The reservation of the Republic of Rwanda on

hereby authorized to be lifted.

This law comes into force on the day of its
publication in the Official Gazette of the
Republic of Rwanda.

After considering the reservation of the
Republic of Rwanda on Article 22 of the
International Convention on the Elimination of
All Forms of Racial Discrimination, adopted in
New York on 21 December 1965;
ADOPTS:

lifting
The reservation of the Republic of Rwanda on
Article 22 of the International Convention on
the Elimination of All Forms of Racial
Discrimination, adopted in New York on 21
December 1965, is hereby authorized to be
lifting.

The general convention of cooperation for
development between the Kingdom of Belgium
and the Republic of Rwanda, signed at Kigali
on 18 May 2004, is hereby authorized to be
ratified.
Article 2: Commencement
This Law shall come into force on the date of
its publication in the Official Gazette of the
Republic of Rwanda.

After considering the Agreement for Lauching
of Transport Agency of Central Transit Hall
signed at Dar Es Salaam on 02 September 2006,
between Government of the Republic of
Burundi, the Government of the Democratic
Republic of Congo, the Government of the
Republic of Rwanda, the Government of United
Republic of Tanzania and the Government of
the Republic of Uganda;
ADOPTS:
Article One: Authorization of ratification
The Agreement for Lauching of Transport
Agency of Central Transit Hall signed at Dar Es
Salaam on 02 September 2006, between
Government of the Republic of Burundi, the
Government of the Democratic Republic of
Congo, the Government of the Republic of
Le Sénat, en sa séance du 19 décembre 2007;
Vu la Constitution de la République du Rwanda
du 04 juin 2003, telle que révisée à ce jour,
spécialement en ses articles 62, 66, 67, 88 , 89,
90, 92, 93, 95, 108, 118, 189, 190, et 201;
Considérant l’Accord pour l’Etablissement de
l’Agence de Facilitation du Transport de Transit
du Corridor Central signé a Dar Es Salaam le
02 septembre 2006, entre le Gouvernement de
la République du Burundi, le Gouvernement de
la République Démocratique du Congo, le
Gouvernement de la République du Rwanda, le
Gouvernement de la République Unie de
Tanzanie, et le Gouvernement de la République
de l’Uganda ;
ADOPTE:
Article premier : Autorisation de ratification
L’Accord pour l’Etablissement de l’Agence de
Facilitation du Transport de Transit du Corridor
Central signé à Dar Es Salaam le 02 septembre

Article 2: Commencement
This Law shall come into force on the date of
its publication in Official Gazette of the
Republic of Rwanda.
