LA HAYE, 31 mars (AFP) -11h12 - La <strong>de</strong>man<strong>de</strong> d'asile aux Pays-Bas d'un <strong>de</strong>s principaux chefs militaires du Parti <strong>de</strong>s Travailleurs du<br />

Kurdistanséparatistes kru<strong>de</strong>s <strong>de</strong> Turquie), Murat Karayilan, a été rej<strong>et</strong>ée en première instance, a-toOn appris <strong>de</strong> source officielle vendredi à La Haye.<br />

Sa <strong>de</strong>man<strong>de</strong>, déposée en novembre <strong>de</strong>rnier, peu après son arrivée aux Pays-bas, a été rej<strong>et</strong>ée par le service néerlandais <strong>de</strong> l'immigration <strong>et</strong> <strong>de</strong>s<br />

naturalisations (IND), a-toOn précisé <strong>de</strong> même source.<br />

Murat Karayilan peut faire appel <strong>de</strong> c<strong>et</strong>te décision.<br />

La Turquie a <strong>de</strong>mandé en février son extradition, mais l'examen <strong>de</strong> c<strong>et</strong>te requête <strong>de</strong>vrait prendre environ six mois. C<strong>et</strong>te <strong>de</strong>rnière pourra également<br />

faire l'obj<strong>et</strong> d'un recours <strong>de</strong>vant le Conseil d'Etat néerlandais, avant la décision du ministre <strong>de</strong> la Justice Benk Korthals, elle-même susceptible d'un<br />

ultime appel, selon les spécialistes <strong>de</strong> son ministère. '<br />

Murat Karayilan, 46 ans, alias "Cuma", originaire du village <strong>de</strong> Suruc, dans la province <strong>de</strong> Sanliurfa (sud-est), a <strong>de</strong>mandé l'asile politique aux<br />

Pays-Bas le 18 novembre 1999.<br />

Il était l'un <strong>de</strong>s principaux chefs militaires du PKK, avec Cemil Bayik <strong>et</strong> Osman Ocalan, frère du chef rebelle kur<strong>de</strong> Abdullah Ocalan. Depuis<br />

l'arrestation <strong>et</strong> la condamnation à mort <strong>de</strong> ce <strong>de</strong>rnier, le PKK prône une solution pacifique du problème kur<strong>de</strong> <strong>et</strong> a proclamé l'abandon <strong>de</strong> la lutte<br />

armée lancée en 1984.<br />

Dans une interview à l'agence néerlandaise ANP début mars, Murat Karayilan a affirmé être venu aux Pays-Bas afin <strong>de</strong> "poursuivre par la voie<br />

démocratique notre lutte pour la paix <strong>et</strong> la démocratie". "Je suis là pour présenter notre nouvelle stratégie pacifique à l'ensemble <strong>de</strong> nos membres",<br />

à-toi! dit.<br />

Il a affirmé que "le PKK est prêt à tout pour la paix", mais qu'il reprendrait la guerre si Abdullah Ocalan était exécuté. "Nous voulons la paix mais si<br />

notre lea<strong>de</strong>r est pendu nous ressentirons cela comme la mort <strong>de</strong> tous les Kur<strong>de</strong>s. Ce sera alors le début d'une nouvelle guerre", a-t-il déclaré.<br />

"Nous <strong>de</strong>mandons très peu, juste la reconnaissance légale <strong>de</strong> l'i<strong>de</strong>ntité kur<strong>de</strong>", a-t-il précisé dans c<strong>et</strong> entr<strong>et</strong>ien, regr<strong>et</strong>tant "qu'aucun signe positif ne<br />

soit venu d'Ankara" <strong>de</strong>puis l'abandon <strong>de</strong> la lutte armée par son parti.<br />

Controversial Article 312 on the agenda again<br />

A total of 201 cases relating to activities contravening Article 312/20f the Turkish Penal Co<strong>de</strong> (TCK)<br />

were filed in the Court of Cassation last year, of which 185 were heard and 16 werè dismissed. The article<br />

is now back on the agenda following the imprisonment of now-<strong>de</strong>funct Welfare Party (RP) Chairman Necm<strong>et</strong>tin<br />

Erbakan, reported the Anatolia news agency.<br />

The Court of Cassation sentenced those involved in 98 of the 185 cases to prison, while the remalnlng<br />

cases were overruled. Nin<strong>et</strong>y percent of the imprisonment <strong>de</strong>cisions concerned separatist activities, while<br />

the remaining constituted religiousactivities.<br />

Many politicians, writers and journalists were sentenced to jail due to their activities which contravened<br />

Article 312. Famous writer Yasar Kemal and journalist Ahm<strong>et</strong> AltanIs sentences, which have been post-<br />

,poned,were passed by the court. Prison sentences of the former mayors of Istanbul and Kayseri, ,Tayyip<br />

Erdogan and Sukru Karatepe, and Deputy Huseyin Ceylan of the closed RP had been carried out, while former<br />

Rebirth Party (YDP) Chairman Hasan CelaI Guzel is still serving a jail sentence he was given based on<br />

ArtiCle 312. International Human Rights Fe<strong>de</strong>ration (flOH) Deputy Chairman Akin Birdal has two con<strong>de</strong>mnations<br />

due to this article. He was imprisoned on Tuesday to compl<strong>et</strong>e his sentence, which was suspen<strong>de</strong>d previously<br />

due to his health. Erbakan had also been sentenced to a year in jail, and the justification for<br />

imprisoning Erbakan has not been compl<strong>et</strong>ed y<strong>et</strong>.<br />

Meanwhile, 14 imprisonment and 17 release files were passed to the Court of Cassation "relating to torture<br />

crimes. The court approved 12 of the imprisonment and 13 of the release cases while it cancelled two<br />

imprisonment and four release files. A trial involving police, known to the public as the Manisa trial,<br />

is 'among the cancelled release files. The court had <strong>de</strong>ci<strong>de</strong>d to sentence the police due to torture crimes,<br />

,and the trial is still continuing.<br />
