3 4 SAHARA OCCIDENTAL Arrives a ce point, il semble nécessaire de se rkferer a deux précédents qu'il faudrait analyser de nouveau a la lumiere des circonstances de la présente aiTaire. II s'agit évidemment des affaires bien connues du Statut de la Curelie orieiifale et de I'ltrterprkialiori des traiti;~ dc paix. Le Gouvernement espagnol considère que. du fait que le Règlement de la Cour prévoit. dans son article 89. la possibilité de nommer des juges ad hoc dans la procédure consultative. lorsque l'avis est demandéau sujet d'une question juridique actuellement pendante entre Etats, on ne saurait tirer la conséquence que la Cour est toujours compétente pour connaître de ce genre de questions. si I'on tient compte surtout que. selon l'article 87 du Règlement. la Cour doit rechercher avant tout si les questions soumises pour avis ont trait a une question juridique actuellement pendante entre Etats. afin de déterminer dans quelle mesure la Cour juge applicables les dispositions du Règlement relatives a la procédure contentieuse. Si nous rapprochons cela de la disposition de I'article 68 du Statut, cela suffit pour maintenir que la Cour peut et doit examiner aussi le problème de sa compétence si. comme c'est le cas, il n'y a pas de consentement d'un Etat intéressé. Cette affirmation est solidement appuyée par les derniers considérants de l'ordonnance du 22 mai 1975 de cette Cour. faisant référence a la question de la compétence et a l'opportunité de son exercice (C.I.J. Recueil 1975. p. 6). L'opinion contraire, bas& sur l'idée que le précédent du Statut de la Carelie orientale n'aurait plus aucune valeur, n'est pas si radicale qu'on l'a prétendu dans des audiences précédentes. Si. a l'audience du 12 mai. le conseil du Gouvernement marocain nous rappelait que le précédent constitué par la Carélie orientale est périmé. appuyant cette thèse sur une citation tirée de l'opinion individuelle d'un des membres de cette Cour (C.IJ. Recueil 1971. p. 171-1731. le conseil du COUvernement de la Mauritanie. de son côte. nous disait. a l'audience du 13 mai :
