EXPOSE ORAL DE M. LACLETA 27 les conclusions avancées par le Gouvernement marocain en ce qui concerne les enéts desi résolutions des Nations Unies et les destinataires de ces résolutions. Vous trouverez les thèses auxquelles je me préfère dans le compte rendu de l'audience du 26 juin (IV. p. 1 50. 154 et 155). Premièrement. les effets des résolutions: pour réduire la portée des resolutions adoptées par l'Assemblée générale, ailIrmant la libre détermination du peuple du Sahara occidental, on nous a dit qu'
28 SAHARA OCCIDENTAL De même, on doit considérer, lors du déroulement dans le temps du processus de décolonisation du Sahara occidental. de 1956 a 1974. quelles ont été les attitudes des Etats intéresses au sujet du processus de décolonisation du territoire et, dans ce contexte, leurs positions concernant les problèmes de souveraineté territoriale. Le Gouvernement espagnol a effectué cet examen dans les pages 78 a 10 1 (1) de son exposé écrit. Par souci d'être le plus succinct possible, je vais me référer seulement aux points essentiels. comme l'article 56 du Règlement de ta Cour nous le demande. En premier lieu, les Gouvernements du Maroc et de la Mauritanie ont soutenu, en 1974. lors des débats de la vingt-neuvième sesssion de l'Assemblée générale, entre autres arguments, qu'il était nécessaire de solliciter un avis de la Cour sur le statut juridique du territoire au moment de sa colonisation par l'Espagne. pour que I'Assemblée générale puisse établir. a la session suivante. les conséquences opportunes au sujet du processus de décolonisation du territoire. Si la Cour juge qu'il ne s'agit pas d'un territoire nuliius, mais qu'il existe des liens juridiques entre ce territoire et l'une ou l'autre ou les deux puissances mentionnées dans la seconde question, dans ce cas. et suivant l'opinion de ces gouvernements. le paragraphe 6 de la résolution 15 14 (XV) serait applicable. Cela implique naturellement qu'on devrait suivre un processus de décolonisation différent de celui qui a été adopte jusqu'à maintenant par l'Assemblée, lequel processus nouveau serait basé sur des négociations entre ces gouvernements et la Puissance administrante, en vue de la rétrocession du territoire. Le Gouvernement espagnol a présente en détail. dans son expose écrit. les raisons qui l'empêchent d'admettre cet expoçé du probleme. raisons qui s'appuient aussi bien sur le droit général de la décolonisation que sur le droit particulier applicable au territoire. II ne peut accepter, en effet. qu'une telle fapn d'exposer le probleme soit admissible en 1974. après que l'Assemblée générale a adopte au moins huit résolutions. de 1965 a 1973. établissant le processus a suivre pour la décolonisation du territoire, au moyen d'un référendum de sa population. et réaffirmant le droit du peuple du Sahara occidental a La libre détermination et a l'indépendance. En ce qui concerne l'attitude des Etats intéressés, le Gouvernement espagnol n'estime pas justifié que la question du statut territorial du Sahara occidental au moment de fa décolonisation par l'Espagne soit suscitée a une date tardive du processus de sa décolonisation, alors que ces mèmes Etats ont admis a plusieurs reprises que l'organisation d'un référendum sous les auspices des Nations Unies était le procédé approprié pour que la population sahraouie puisse exercer ses droits a la libre détermination et a l'indépendance. Partant de cette double constatation. le Gouvernement espagnol a estime et estime que. si la Cour admet la possibilité d'exercer sa compétence dans la présente aîïaire. la question relative au statut actuel du territoire a, certainement, une priorité logique absolue sur les questions concernant son statut historique, c'est-à-dire sur la souveraineté existant au Sahara occidental au moment de sa colonisation par L'Espagne. De mime. en partant de cette conclusion. le Gouvernement espagnol a exposé une conséquence importante au sujet de l'exercice correct par la Cour de sa fonction judiciaire, a savoir qu'il est nécessaire d'admettre que les questions de souveraineté territoriale contenues dans la résolution 3292 (XXIX) se présentent devant le juge international comme questions « historiques >> et d'un simple intérêt académique : c'est-à-dire qu'elles ne constituent aucunement des vraies questions juridiques. susceptibles d'ktre résolues par la
