Petren qui avait. un s'en souviendra. le contenu suivant : (< Est-ce que des réponses aux questions adressées à la Cour seraient de nature a apporter une clarification juridique d'une situation existant aujourd'hui et, dans ce cas, a quel égard est-ce que les réponses de la Cour auraiènt un tel effet ? » (Ci-tlessus p. 140.) Pour rédondre à cette question. nous voudrions tout dàbord, nous référer à cette hypothèse qu'envisageait justement, devant la Quatrième Comnlission, M. El as sen. représentant permanent de la Mauritanie, le 27 novembre 1974. Voici ce qu'il disait : (< le p~roblème du Sahara est global et ne peut étre compris que considéré comme tel. II est possible certes d"en clarifier un aspect mais l'homogénéité de ces régions et l'intérêt superieur des popiilations concernées ne devront en aucun cas ètre mis en cause par une clarification. L'essentiel demeure en fait pour les pays intéressés d'aboutir à une décolonisation complete de ce territoire conformément aux résolutions pertinentes des Nations Unies. Il s'agit seulement de définir de manière plus précise les modalités pratiques de cette décolonisation : c'est là I'intérèt que représente. pour l'Assemblée générale. dans la recherche de cette définition. l'avis consultatif a demander a la Cour. En effet. lorsque la Cour aura établi que ce territoire. au moment de sa colonisation. avait des liens specifiques avec le Maroc et la Mauritanie. une étape au moins dansicette recherche aura été franchie. » (Natjons Unies. doc. .4/C.4/ SR.21 17. p. 39.) Nous aimons a faire ces citations, Monsieur le Président. Messieurs de la Cour. car: elles tnontreni l'opinion de la Mauritanie a ce propos. je dirais Mi rei??pore J(OII si~specto. avant que l'avis meme ne soit posé ; et je crois qu'il y a peu de choses a dire de plus. Tout au pl~is peut-on peut-être préciser ceci : si l'on admet que le territoire faisait. pour une partie. partie integrante du Bilad ~hin~uitilet, pour l'autre, partie intégrante du Royaume du Maroc, au moment de la colonisation. le principe de l'intégrité territoriale devrait apparaitre avec plus de nètteté a l'Assemblée générale comme un principe qui a a s'appliquer dans la decolonisation. Mais. encore une fois. c'est l'Assemblée générale qui aura a trqncher la question. a peser quelle sera l'importance de cet elernent. La Requblique islamique de Mauritanie espère avoir répondu de manière aussi complète qu'il le souhqite a l'honorable juge. Nous iiendrons donc maintenant à notre seconde partie. si la Cour le permet. et nous essaierons d'examiner les deux questions qui sont posées par l'Assemblée générale.
