DUPUY 217 De ce fait. et en troisième lieu. tes efforts accomplis par le Suitan pour dégager sa responsabilité internationale n'excluent pas sa souveraineté au Noun et au Sahara occidental. mais tout au contraire la prouvent et l'afirment. En effet. si le Sultan ne se considérait pas le souverain de ces régions. il n'aurait nullement besoin de dégager sa responsabilité internationale a propos dcs actes accomplis sur ces territoires. Par ces stipulations conventionnelles visant a limiter sa responsabilité, le Sultan se place directement dans l'hypothèse d'un Etat souverain territorial. prévenant sa responsabitité internationale au moyen de mesures préventives adaptées a sa situation et consistant avertir des dangers les Etats européens. Par ailleurs. le traité de klarrakcch doit également être analyse en fonction des documents diplomatiques ayant un rapport direct avec lui. A cet égard. la lettre du 28 mai 1767 adressée par le sultan du Mar% au roi d'Espagne Charles III est tout a fail significative. d'autant que Ic conseil du Gouvcrtiement espagnol a contesté la traduction présentée par le Gouvernement marocain. La traduction présentée a la page 83 ci-dessus par le Gouvernement espagnol se détache sensiblement du vcritable sens des termes arabes et aboutit a des diiformations subslantielles. C'est ainsi qu'il est indiqué dans cetie traduction en français. effectuée par le Gouvernement espagnol. a propos des nomades. qu'aucune juridict~on ne les atteint. Or les termes arabes lut~l iurt ~rlliollrn ul?X-a,n n'ont pas. ainsi que nous l'avons vu. cette signification et doivent se traduire par l'idée dynamique qu'if est difficile de letir appliquer des décisions. Ce n'est donc pas l'idée de juridiction qui est exprimée dans ce texte. mais celle de la difficulté mati'rielle d'appliquer des décisions a une population nomade. D'autre part, a la méme page, le conseil espagnol indique que les côtes d'Agadir se trouvent sous l'égide de I'ln~ral~, c'est-à-dire, selon cette traduction, sous la protection de l'empereur du Maroc. La encore, la traduction est inexacte et cela rejaillit sur la portée du texte. Anran indique une idée de sûreté. de çécurité. Dès lors. contrairement a ce qui est allégué a la page 87 ci-dessus, ces clauses conventionnelles ne se rattachent pas une idée d'insoumission, mais a la notion d'insécurité, particulièrement pour les étrangers. De ce fait le Sultan, se conformant aux règles de la responsabilité internationale. avertit de cette situation les Etats contractants. Malgré tout, ainsi que nous l'avons note dans notre exposé oral du 3 juillet, le Sultan rembourse généralement aux Etats européens la rançon, témoignant ainsi, une nouvelle fois, de sa souveraineté au Noun et au-del& au Sahara occidental. 3. Deux remarques doivent tout d'abord etre faites a propos de cet ensen7ble de conventions. Première remarque: le conseil du Gouvernement espagnol. lors de l'audience du 21 juillet. n'a effectue en fait que l'analyse d'un seul de ces traités : le traité maroco-espagnol du le' mars 1799 : ce conseil a passc sous silence les nombreux autres traités passés avec différents Etats en 1 787. 1 79 1. 1801. 1825. 1836. 1856 et 1861. Or. ainsi que nous le verrons. cet ensemble conventionnel constitue un faisceau probatoire convergent en favcur de l'existence de la souveraineté marocaine dans cette région.
