76 <strong>United</strong> <strong>Nations</strong> - <strong>Treaty</strong> <strong>Series</strong> 1969<br />

2. "Nationals" means, in relation to the Republic of Austria, the<br />

nationals of that State and,<br />

in relation to the Federal Republic of Germany, a German within the meaning<br />

of the Basic Law for the Federal Republic of Germany;<br />

3. "Legislation" means the laws, ordinances and regulations relating to<br />

the branches of social security specified in article 2, paragraph (1), which<br />

are in force in the territory of one of the Contracting States or in part of<br />

that territory;<br />

4. "Competent public authority" means, in relation to the Republic of<br />

Austria, the Federal Ministry of Finance in respect of family allowances<br />

and the Federal Ministry of Social Affairs in respect of other matters and,<br />

in relation to the Federal Republic of Germany, the Federal Minister of<br />

Labour and Social Affairs;<br />

5. "Frontier region" means the part of the territory of each Contracting<br />

State extending, in general, to a depth of up to ten kilometres on each side<br />

of the common frontier. The Austrian and German communes situated<br />

in the said region are specified in the annex to this Convention, which forms<br />

an integral part of the Convention; the competent public authorities may,<br />

by agreement, revise the list when the <strong>des</strong>ignations of communes are changed<br />

or when communes are subdivided or combined;<br />

6. "Frontier commuter" means a person who is subject to the legislation<br />

of one of the Contracting States by reason of his employment in the frontier<br />

region of that State and who is normally resident in the frontier region of the<br />

other Contracting State and returns there, as a rule, at least once a week;<br />

7. "Insurance authority" means the institute or authority appropriate<br />

for the application of the legislation, or any part thereof, specified in article 2;<br />

8. "Competent insurance authority" means the insurance authority<br />

which is competent under the relevant legislation;<br />

9. "Employment" means an employment or occupation within the<br />

meaning of the relevant legislation;<br />

10. "Contribution periods" means periods in respect of which contributions<br />

have been paid or are treated as having been paid under the legislation<br />

of one of the Contracting States;<br />

11. "Equivalent periods" means periods which are equivalent to contribution<br />

periods;<br />
