384 United Nations - Treaty Series 1969 A rticle III USE OF PROCEEDS OF THE CREDIT Section 3.01. The Borrower shall apply the proceeds of the Credit in accordance with the provisions of this Agreement to expenditures on the Project described in Schedule 2 to this Agreement. Section 3.02. Except as the Association shall otherwise agree: (i) the goods to be financed out of the proceeds of the Credit shall be procured on the basis of international competitive bidding in accordance with the Guidelines for Procurement under World Bank Loans and IDA Credits, published by the Bank in February, 1968, and in accordance with such other procedures supplementary thereto as are set forth in Schedule 4 to this Agreement; and (ii) contracts for the procurement of such goods shall be subject to the approval of the Association. When evaluating bids for the supply of furniture, prices of locally produced goods may be compared with prices of imported goods on the following basis : (i) the price of goods produced in the territories of the Borrower shall be the ex-factory price of such goods; and (ii) the price of imported goods shall consist exclusively of the c.i.f. landed cost of such imported goods, excluding customs duties or any other similar charges, plus a margin of 15 % of such cost. Section 3.03. Except as the Association shall otherwise agree, the Borrower shall cause all goods financed out of the proceeds of the Credit to be used exclusively in carrying out the Project. Article IV PARTICULAR COVENANTS Section 4.01. (a) The Borrower shall carry out the Project with due diligence and efficiency, in conformity with sound technical, financial and administrative standards and with due regard to economy, and shall at all times make or cause to be made available, promptly as needed, all funds and other resources required for carrying out the Project and for the effective utilization, staffing, equipping, operation and maintenance of the educational institutions included in the Project. (b) The Borrower shall cause the educational institutions included in the Project to be so operated as to promote the educational objectives of the Borrower and to be provided with qualified teachers and administrators in adequate numbers. L'Emprunteur veillera h ce que les fonds provenant du Crddit soient affectds conformdment aux dispositions du present Contrat aux d~penses aff~rentes au Projet ddcrit dans l'annexe 2 du prdsent Contrat. Paragraphe 3.02. A moins que l'Association n'accepte qu'il en soit autrement, i) les marchandises qui seront financdes au moyen des fonds provenant du Credit feront l'objet d'un appel d'offres international suivant les Directives relatives 4 la passation des march~s finances par les prits de la Banque mondiale et les crdits de I'IDA, publi~es par la Banque en fdvrier 1968, et conform~ment h toutes autres proc6dures compldmentaires stipul~es h l'annexe 4 du prdsent Contrat, et ii) les march6s relatifs h l'achat de ces marchandises devront 6tre approuvds par l'Association. Pour 6valuer les soumissions relatives h la fourniture de mobilier, on pourra comparer les prix des marchandises produites sur place aux prix des marchandises importoes en se basant sur les 6lments suivants : i) pour le prix des marchandises produites dans les territoires de l'Emprunteur, on consid~rera le prix desdites marchandises h la sortie de l'usine; et ii) pour le prix de marchandises import&es, on considdrera exclusivement le cofit c.a.f. h terre desdites marchandises import~es, h l'exclusion des droits de douane ou autres charges similaires, en le majorant de 15 p. 100 dudit cosit. Paragraphe 3.03. Sauf convention contraire entre l'Emprunteur et l'Association, l'Emprunteur veillera h ce que toutes les marchandises achetdes h 'aide des fonds provenant du Credit soient utilisdes exclusivement pour 1'ex6cution du Projet. Article I V ENGAGEMENTS PARTICULIERS Paragraphe 4.01. a) L'Emprunteur ex~cutera le Projet avec la diligence voulue et dans les meilleures conditions, selon les r~gles d'une saine pratique technique, financi~re et administrative et dans un esprit d'6conomie et il fournira ou fera fournir imm~diatement, au fur et h mesure des besoins, tous les fonds et autres ressources n~cessaires pour executer le Projet et faire en sorte que les 6tablissements d'enseignement qui y sont vis~s soient utilis~s, g~r6s et entretenus dans de bonnes conditions et disposent du personnel et de l'6quipement ndcessaires. b) L'Emprunteur veillera h ce que les 6tablissements d'enseignement vis~s dans le Projet soient g6r~s de mani~re h atteindre ses objectifs dans le domaine de l'enseignement et disposent du personnel enseignant et administratif competent n~cessaire.
