granted subsequently if the person concerned has not obtained it in advance<br />

for reasonable cause.<br />

(3) Article 4, paragraph (1), shall not apply to any dependant of an<br />

insured person so long as benefits may be claimed for such dependant under<br />

the legislation of the Contracting State in whose territory the dependant<br />

is resident.<br />

(4) Paragraphs (1) and (2) above shall not apply to frontier commuters<br />

or maternity benefits.<br />

Article 15<br />

(1) Benefits in kind under article 4, paragraph (1), shall be provided:<br />

In the Republic of Austria:<br />

By the Regional Sickness Fund for Manual and Salaried Workers<br />

(Gebietskrankenkasse fir Arbeiter und Angestellte) competent for the<br />

place of residence;<br />

In the Federal Republic of Germany:<br />

By the General Local Sickness Fund (Allgemeine Ortskrankenkasse) or,<br />

where it does not exist, the Land Sickness Fund (Landkrankenkasse)<br />

competent for the place of residence.<br />

(2) For the provision of benefits in kind, the legislation applicable<br />

to the insurance authority of the place of residence shall apply, with the<br />

exception of legislation concerning the duration of benefits and of the relevant<br />

legislation concerning the procedure for settling disputes.<br />

(3) Except in dire emergencies, artificial parts of the body and other<br />

major benefits in kind shall be provided only with the authorization of the<br />

competent insurance authority. A dire emergency shall be deemed to exist<br />

in cases where provision of the benefits cannot be delayed without seriously<br />

endangering the life or health of the person concerned.<br />

(4) Persons and institutions that have concluded agreements with<br />

the insurance authorities referred to in paragraph (1) above concerning<br />

the provision of benefits in kind to persons insured with the said insurance<br />

authorities and their dependants shall also be required to provide benefits<br />

in kind to the persons referred to in article 4, paragraph (1), in the same<br />

way as if the last-mentioned persons were insured with the insurance authorities<br />

referred to in paragraph (1) above or were dependants of such insured<br />

persons and as if the agreements also applied to the persons referred to in<br />

article 4, paragraph (1).<br />
